WHEREAS, the Planning Board of the Village of Sleepy Hollow has reviewed a subdivision
application and lot line adjustment for properties owned by Stephens and Kent House LLC (the "S&amp;K
House" Lots 115.8-2-3.1 and 115.8-2-3.2) and the National Trust for Historic Preservation in the United
States (the "National Trust Lot" Section 115.8-2-3.3) so as to eliminate Lot 115.8-2-3.1 and distribute the
acreage between the other two lots as noted below (hereinafter the "Application") for property currently
located along County House Road and Bedford Road pursuant to the Village Zoning Code, and to
applicable laws and regulations considered pertinent to the Application. The Application is submitted on
behalf of S&amp;K House and the National Trust (collectively the "Applicant"); and
WHEREAS, the Planning Board has reviewed the following materials:
1.

Planning Board Application, dated 6/30/20, signed by John C. Schnaufer;

2.

Preliminary Subdivision Plat completed 3/11/20, prepared by H. Stanley Johnson and
Company Land Surveyors, P.C.;

3.

Short Environmental Assessment Form, dated 6/30/20, signed by John C. Schnaufer;

4.

Coastal Assessment Form, dated 6/30/20, signed by John C. Schnaufer;

WHEREAS, the Application proposes to eliminate the approximately 8.44 acre Lot 115.8-2-3.1
(owned by S&amp;K House) and a) increase the S&amp;K Lot 115.8-2-3.2 from approximately 13.502 acres to
approximately 17.626 acres and b) increase the National Trust Lot 115.8-2-3.3 from approximately 34.16
acres to approximately 38.471 acres (the "Proposed Action"); and
WHEREAS, the proposal was discussed by the Planning Board at public meetings held at Village
Hall on 7/16/20, and on 9/17/20 a public hearing was opened on 9/17/20 in which all members of the
public were invited to be heard and said public hearing was closed the same night; and
WHEREAS, in the course of its review and acting as Lead Agency pursuant to Part 617 of the
Implementing Regulations pertaining to Article 8 of the Environmental Conservation Law, the Planning
Board has made the following findings and caused, noted or conducted the following activities:

Received an application fee;

2.

Requested, received and considered c o m m e n t s from the Village Engineer, Village Planner
and Building Inspector about the proposed project;

3.

Requested, received and reviewed a Short Environmental Assessment Form;

NOW, T H E R E F O R E , BE IT RESOLVED, that Planning Board, after review of the materials submitted,
public c o m m e n t s and recommendations and the EAF has determined that the proposed action is a Type
II Action and makes a determination of non-significance of environmental impact; and be it further
RESOLVED, that the said Application for a preliminary subdivision and lot line adjustment as
s h o w n on the Subdivision Plat prepared for S&amp;K House and the National Trust dated 3/11/20 is hereby
granted approval and the Applicant may obtain the endorsed approval of the Planning Board Chairperson
on a copy of the resolution and the appropriate subdivision plan, which endorsement shall permit the
filing of the Final Plat, provided however, that this approval shall expire one (1) year after the date of this
resolution if the following modifications and conditions have not been completed to the satisfaction of
the Planning Board and the Village Building Department, in accordance with the approved plan(s):
1.

The Applicant shall pay the Village of Sleepy Hollow all application and review fees as
required by the Village Code prior to this resolution being signed.
