Preliminary Plat Approval

WHEREAS, the Planning Board of the Village of Sleepy Hollow has reviewed a subdivision
application for the creation of an additional building lot (the Application) for property currently located
at 467 Munroe Avenue known locally as Section 115.7, Block 4, Lot 10 pursuant to the Village Zoning
Code, and to applicable laws and regulations considered pertinent to the Application. The Application is
submitted on behalf of Roger Billharz (the Applicant).
WHEREAS, the Planning Board has reviewed the following materials:
1.

Planning Board Application, dated 4/2/20, signed by Gregory M. Gall Architect;

2.

Subdivision Plat dated 5/18/20, prepared by Line &amp; Grade Surveyors, D.P.C.;

3.

Short Environmental Assessment Form, dated 4/2/20, signed by signed by Gregory M.
Gall;

4.

Review memoranda from Dolph Rotfeld Engineering an Al Engineering Company dated
4/12/20 and 4/30/20.

WHEREAS, the proposal was discussed by the Planning Board at public meetings held at Village
Hall on 4/16/20, and on 5/21/20 a public hearing was opened in which all members of the public were
invited to be heard and said public hearing was closed the same night; and
WHEREAS, in the course of its review and acting as Lead Agency pursuant to Part 617 of the
Implementing Regulations pertaining to Article 8 of the Environmental Conservation Law, the Planning
Board has made the following findings and caused, noted or conducted the following activities:
1. Received an application fee;
2. Requested, received and considered comments from the Village Engineer, Village
Planner and Building Inspector about the proposed project;
3. Requested, received and reviewed a Short Environmental Assessment Form;
NOW, THEREFORE, BE IT RESOLVED, that Planning Board, after review of the materials
submitted, public comments and recommendations and the EAF has determined that the proposed

�action is a Type II Action and makes a determination of non-significance of environmental impact; and
be it further
RESOLVED, that the said Application for a two lot subdivision as shown on the Subdivision Plat
prepared for 467 Munroe Avenue dated 5/18/20 is hereby granted approval and the Applicant may
obtain the endorsed approval of the Planning Board Chairperson on a copy of the resolution and the
appropriate subdivision plan, which endorsement shall permit the filing of the Final Plat, provided
however, that this approval shall expire one (1) year after the date of this resolution if the following
modifications and conditions have not been completed to the satisfaction of the Planning Board and the
Village Building Department, in accordance with the approved plan(s):
1. The Applicant shall pay the Village of Sleepy Hollow all application and review fees as
required by the Village Code prior to this resolution being signed.
