Planning Board Meeting
April 20, 2017
The meeting was called to order at 8:04 PM by Deputy Chairman Gordon Swartz.

1) Historic Hudson Valley, 381 North Broadway, Bridge and wharf alteration- Continued
public hearing
Kent Gannon is an engineer from Stantec. Mr. Gannon gave a brief overview of the project and
stated that he received additional comments from the Village Engineer and responded with a
memo. Mr. Gannon reviewed the engineer's questions and summarized the changes to the
construction plans.
Deputy Chairman Swartz solicited comments from the public.
James Natarelli requested that the project engineer provide drainage calculations to support a 10year storm for the dam bypass system and provide documentation for the DEC permit
determination.

�Deputy Chairman Swartz questioned if there is an overall master plan for the site.
Waddell Stillman is the president of Historic Hudson Valley. Mr. Stillman stated that there are
no plans to change anything else at Philipsburg Manor. There is an ongoing conversation with
the Sleepy Hollow Local Development Corporation regarding parking on the East Parcel but no
other plans for additional projects.
Clinton Smith questioned if the DEC reviewed the dam and construction plans.
Kent Gannon replied that the DEC did review the plans for the excavation and fill permit,
including the placement of the coffer dam work, but did not review the engineering of the dam.
Mr. Gannon stated that the contractor is required to provide the design of the coffer dam in
accordance with the New York State Department of Transportation's specifications, and submit
the design to the Village Engineer.
Clinton Smith questioned how long the work will take to complete.
Kent Gannon replied that the construction will take about six months depending on the
availability of materials.
There were no further comments.
Motion was made to continue the public hearing to the May 18, 2017 meeting.

2) Marcos Lozano, 30 Andrews Lane, Proposed townhouse development- Public hearing
Jonathan Villani is from Annunziata Design Consultants, Inc., representing Marcos Lozano. Mr.
Villani stated that the proposal is to construct 12 units; 8 two-bedroom units which will be
approximately 1,100 square-feet and 4 one-bedroom units which will be 755 square-feet. The
units will be split in two buildings, each with their own open space. Mr. Villani presented the
building plans and described the layout to the Board. Mr. Villani described the exterior of the
structures and indicated that the siding will be vinyl with Azek trim. The roof shingles will be
asphalt Timberland, and the railings will be composite materials.
Deputy Chairman Swartz solicited comments from the public.
Victor Mas lives at 29 Kendal Avenue, directly behind the property and is concerned about the
lack of parking in the neighborhood and the height of the buildings.
Ellen McDonough lives at 23 Kendal Avenue, behind the property, and questioned where the
parking will be placed and what will be the height of the buildings.

�Jonathan Villani replied that there will be eight garages under the building and open parking
spaces between the buildings. Mr. Villani stated that the proposed parking and the building
heights comply with the Zoning Ordinance.
Ellen McDonough stated that the buildings are too close to her property and will block the views
from the properties on Kendal Avenue.
Marie Rodriquez is the owner of 20 Andrews Lane, adjacent to the property. Ms. Rodriquez is
concerned that she will not have any privacy raising her children with twelve new apartments
next to her house. Ms. Rodriquez stated that the project is too big.
Manuel Panjon lives at 31 Kendal Avenue and stated that he shares the same concerns as his
neighbors. Mr. Panjon stated that the buildings are too big and he will not be able to see his
children playing at the park.
Victor Mas questioned the historical integrity of the Babic House. Mr. Mas stated that Sleepy
Hollow should want to retain as much of its history as possible, and that there should be a
moratorium on destroying any house older than 1900. Mr. Mas stated that the proposal will bring
down property values in the neighborhood.
Ellen McDonough stated that all of the properties in the area have had their soil remediated from
the battery plant contamination, and questioned if the project site was cleaned up.
Sean McCarthy stated that the status of the soil remediation for the property is on file at the
Building Department.
Jim Sarris lives at 7 Francis Street and asked what will be the price range of the units.
Jonathan Villani replied that the units will be market rate condominiums for sale. Mr. Villani
stated that the unit price will be comparable to other similar sized units in Sleepy Hollow.
Anthony DelVecchio asked if any variances were required.
Jonathan Villani replied that no variances are needed and that the project complies with all
aspects of the Zoning Ordinance.
Carl Aridas stated that compared to the original plan, the current plan has more parking, greater
setbacks, and an increased driveway width.
Motion was made to adjourn the public hearing until May 18, 2017 at 8:00 PM.

�3) Rosaria Greco and David Macaluso, 71 Sleepy Hollow Road, New single-family
residence- Public hearing
Vladimir Levin works for the architect, Michael Piccirillo and is representing the owners of the
property. Mr. Levin stated that his site engineer is working on the storm water design and has
been in contact with the Village Engineer to resolve his concerns. Mr. Levin stated that there is a
lot of clay on the site making the storm water system difficult to design.
Peter Basha lives at 73 Sleepy Hollow Road and questioned if any variances were required.
Vladimir Levin replied that no variances were needed.
John Petry lives at 50 Amos Street and questioned what is the distance of the side yard setback,
and the height of the building in comparison to the adjacent properties.
Vladimir Levin replied that the height will be 35 feet, measured to the mid-point of the roof.
John Petry asked what the height is to the top of the roof and cupola.
Vladimir Levin replied that the top of the cupola is about 40 feet high.
There was a discussion about the definition of the height of the building and if the cupola is
exempt from the height limit.
John Petry asked what the proposed distance of the front yard setback is.
Vladimir Levin replied that the front yard setback is 20 feet- nine inches where 20 feet is
allowed. Mr. Levin added that the northern side yard setback is 7 feet- 10 inches and the
southern side yard setback is 10 feet.
Deputy Chairman Swartz questioned if the height of the building will require approval from the
Zoning Board of Appeals.
Vladimir Levin replied that he read the Code and believes that the cupola is exempt from the
height requirement but will ask the Building Inspector too make an interpretation.
Deputy Chairman Swartz solicited comments from the Board members and staff.
Carl Aridas reviewed the proposed storm water design solutions and stated he was concerned
with the option to discharge water to the rear of the property through an easement with the
current family member.
There were no other comments.

4) The Salvation Army of Greater New York, 86-96 Valley Street &amp; 115 Wildey Street,
Community center and chapel- Discussion
Daniel Laub is an attorney with Cuddy &amp; Feder and is representing the property owner. Mr.
Laub is requesting an extension of the site plan approval for the construction of a community
center and chapel for the Salvation Army. Mr. Laub stated that a portion of the property is in the
Village of Tarrytown and he appeared before the Tarrytown Planning Board last week and
received a two year extension of their approval. Mr. Laub stated that the Salvation Army is still
committed to the project but the financing for the project is behind schedule.
Hugh Jones asked what needs to change the financial aspect of the project.
Daniel Laub replied that the Salvation Army is seeking grant opportunities and is looking at
scaling back some of their other large projects.
Anthony DelVecchio stated that this is not the first time an extension has been requested; it has
been four years and nothing has changed. Mr. DelVecchio stated he is not in favor of the
extension and that the owner should return when they are ready to start.
Carl Aridas stated that the building has been torn down and removed from the tax rolls. The site
has deteriorated in the last four years and has become unsightly. Mr. Aridas stated that if the
approval is extended it should be for a short period and should include a plan for raising funds.
There was a discussion about the length of time for an extension and conditions to be added to
the approval.
Motion was made to extend the Site Plan approval to the July 2017 Planning Board meeting with
the condition that the applicant submit a detailed construction schedule, a statement of the status
and next steps for financing the project, and a maintenance and interim improvement plan for the
site.

5) Richard Stein and Hilary Baum, 1 Ridge Street, New single-family residencePreliminary presentation
Richard Stein and Hilary Baum are the owners of the property. Richard Stein is the architect and
described the scope of the project. The house is a one-story structure split in two sections; one
side is the living, kitchen, and dining areas and the other section has three bedrooms. The
structure will have a green roof on the east side of the house and solar collectors on the west side.
The driveway will have pervious concrete and the patio will have a permeable surface. No trees
will be removed for the construction.
Carl Aridas questioned if the house will be LEEDS certified.

�Richard Stein replied that the house will not be LEEDS certified but will comply with the State
Energy Code requirements.
Richard Stein stated that the house will not have a basement or a garage, but will have a home
office for his wife, who is a food consultant.
James Natarelli stated that a percolation test will be required to design the storm water system.
Deputy Chairman Swartz solicited comments from the Board members.
