Approval of Minutes - April 17, 2014

Chairman Martone moved the Maken Land Development public hearing to the end of the agenda
because the applicant was not present.
1) C.A.R.S. Inc., 333 No. Broadway - Continued Public Hearing on a Proposed Paint Booth
The applicant's architect John Lantini updated the Board on the status of the health department
permit. Mr. Lantini submitted an e-mail from Ruben Berrios of the Westchester County Health
Department (attached) and noted that the County has not yet approved the permit.
There were no comments from the public
The Planning Board has concerns about the potential health risks associated with the installation
of a paint booth at 333 North Broadway. For this reason, the applicant had been previously
asked by the Board to provide a permit to operate a paint booth from the Westchester County
Health Department. The Planning Board cannot approve the proposed proj ect without this
permit. The applicant has had a significant amount of time to get approval from the Health
Department, but they have failed to do so.

�Chairman Martone said that the Planning Board has been waiting two years for the applicant to
get approval from the Westchester County Health Department and without this permit the
application is deficient.
Motion to close the public hearing:
Moved: McCarthy

Seconded: Aridas

Vote: 7-0

Chairman Martone asked the applicant if he would like to withdraw the application or put it to a
vote. The applicant requested a vote.
Motion to deny the application as submitted based on a deficient application.

DENIED
2) The Salvation Army of Greater New York, 90 Valley Street on a request to extend a site
plan approval.
The applicant's attorney William Null of Cuddy and Feder made a request to extend the Planning
Board's site plan approval for 90 Valley Street for a one year.
Motion was made to approve the applicant' s request for a one year extension.
Moved: Martone
Seconded: DelVecchio
Vote: 7-0
APPROVED
3) Maken Land Development, 545 No. Broadway - Continued Public Hearing
The applicant was not present. Mr. McCarthy said he had received a fax from the applicant
requesting an adjournment until the June Planning Board meeting. The matter was tabled.

4) Approval of the April 17, 2014 Planning Board Minutes - Tabled
