REGULAR MEETING

A regular meeting of the Sleepy Hollow Architectural Review Board
was held on Wednesday, May 23rd, ^00i at a P.M. in the Village Hall, 28
Beekman Avenue, Sleepy Hollow, New York.

Cnairman Nazemetz called the meeting to order at 9 P.M.

Cnairman Nazemetz stated that this application was continued
from trie April meeting.
Mr. Ward presented corrected plans for tne Board to review. Mr.
Ward stated he haa eliminated tne mud room which his neignbor haa objected
to.
M T . mcCartny movea, seconded by Mr. capossela to open the meeting for
public comments. Carried.
Mr. i&lt;bsen wno had objected at the April meeting did not appear to
object to the newly submitted plans.
There being no public camtents, ivir. McCarthy moved, seconded by ms.
Aloia to close the meeting for public comments. Carried.
After discussion, Mr. Caposseia moved, secondeu by Ms. Fina to
approve the plans as submitted, carried.

Mr. Tucker presented plans ana pictures and stated that the fence
would be erected on the south side of the% property and would also replace
the fence at the rear of the property, said fencing to be approximately three
feet in heignt.
i*ir. wazemetz stated tnat the rear of the property overlooKs tne
Pnilipse Manor Railroad Station.
Mr. Cartenuto stated tnat he would be installing the same type of
fence and the fence would match the fences of his neighbors.

Discussion followed regarding heignt and type of fence.
Mr. Nazemetz moved seconded by Mr. Capossella to approve Harold
and Jane "lucker application to erect a fence on tneir property. Carried.
Mr. Nazemetz moved, seconded by Mr. McCarthy to approve David &amp;
Christina Cartenuto application to erect a fence on their property. Carried.

Mr. wiapp did not appear.

Mrs. Reventini stated that the fence would be installed on top
of trie wall at tne rear of her property and would oe six feet in heignt.
she stated that the wall is approximately 11 feet high.
Ms. ilna moved, seconded oy Ms. Aioia to open the meeting for
public comments. Carried.
There ibeing no puolic comments, Mr. McCarthy moved, seconded by
Ms. Aloia to close the meeting for public comments. Carried.

Discussion followed regarding height of fence and Mrs. Reventini
was told that i£ a six foot high fence was installed she would have to appear
before the Zoning Board for a variance.
Ms. Fina moved, seconded by M S . Aloia to approve tne installation
of a five foot high fence on top of the waj.1 at the rear or the property.
Carried.
M S . Keventini agreed to a five foot high fence.

Mrs.isomer presenteu Affidavit of Proof of Mailings to tne Building

Mrs. Gomer presented plans and pictures of the property and outlined
the project for tne Board to review.
M T . Nazemetz moved, seconded by Ms. Aloia to open tne meeting for
puolic comments. Carried.
Mrs. Louis Esposito or 542 Bellwood Avenue presented a letter in which
she strongly objected to tne wall due to the impact on her thriving arborvitaft

Discussion followed regarding tne trees on the property, tne heignt
or the wall and wnere the new wall would be constructed.
Mrs. Pat Sohn, a neighbor directly across from tne property, stated
sne had no objection to the wall ana thought it was a good idea ana would
infchance the property.
Discussion followed whether tne construction of the wall would ^fe
damage tne trees on the neighbors property.
Mr. Caposseia stated tnat contractors take precautions regarding
damage to property and they are insured for damages.
Mrs. Sohn stated she felt that tne contractor would do the right
thing if he happens to aamage some of the neighbors property.
There being no further carments Ms. Fina moved, seconded by Ms.
Aloia to ciose the meeting for public comments. Carried.
Ms. Fina moved, seconded by for. Caposseia tne application be
approved as requested and if any shuobery was damaged or died witnin two
years tne applicant would replace them. Carried.
7.

VAN TASSEL (BARGAIN BUSTER, INC.)

AwNING.

Bargain Buster Inc. applicant to receive approval of awning^ that
has already been installed stated he had removed tne old "Lanac" awning
as it was dirty and faded and worn out, and ask tnat the Board approve the
awning already installea.
Applicant stated tnat he felt the awning was in good taste and was
better then some of the other awnings in tne area.
Chairman stated that the awning does not matcn the re^st of the
awnings in tnat area.
Applicant stated he was not aware that a permit was requirea in
order for him to change the awning.
Cnairman Nazemetz moved, seconded by Mr. McCarthy to open the meeting
for public comments. Carried.
There being no public comments,ttr.McCarthy moved, seconded by Ms.
Aloia to close the meeting for public comments. Carried.
Discussion followed regarding the type or lettering, tne size of the
lettering with the Board agreeing that applicants should be made to adhere
to the Code.

Chairman Nazemetz declared the motion not carried.
Applicant stated that the Board should consider what the
other awnings in the Village look like and stated Hhff would appeal the
decision of the Board in not ^approving his application.

LAfflN COURIER EXPRESS - SIGN

(CONTINUED).

Applicant stated tney had appeared at the January meeting and were
asked to make changes in their sign, and presented pictures outlining
tne signs that were installed.
Chairman Nazemetz moved, seconded ny Mr. McCarthy to open the meeting
for public comments. Carried.
There being no public comments, Chairman Nazemetz moved, seconded by
Ms. Aloia to close the meeting for public comments. Carried.

Discussion followed regarding the installation of neon lights, size of signs,
size of lettering and overall coverage of windows with signs, with the Boara
agreeing that the windows looked too cluttered and that over 60% of the windows
are covered with signs.
Attorney Lammers stated tnat several posters could be removed ana the
Board could grant a variance allowing more signs in the window than called for
in the Code.
Tne Board agreed that "LATiN COURIER EXPRESS" could remain, all posters
were to ne removed, neon lighting would go off at 10 P.M.
Chairman Nazemetz moved, seconded by Mr. McCarthy tnat the above
changes be instituted and the applicant return at tne next meeting and the
Board would inspect the premises,, after the changes were made and they would
consider it at the next meeting in June. Carried.
MINUTES
chairman Nazemetz moved, seconded by Mr. Capossela that the Minutes
of the meeting held on March 28th, 2001 be approved as sutjmitted. Carried.
Mr. McCarthy moved, seconded £&gt;y Ms. Aloia that the Minutes of
the meeting held on April 2bth, 20ul be approved as submitted, carriea.

�of the project located at Cortlandt &amp; Cedar Street it was his intentiori|to
have stores on the first floor o£ the building. It is now his intention
to^have the first floor changed to residential and ask that the Board
approve the change in plans.
chairman Nazemetz moved, seconded by Mr. McCarthy that the
application to change the first floor from ret£*l to residential be
approved as requested. Carried.
Discussion followed regarding application being approved by the
Waterfront Adivsory Committee prior to the Architectural Review Board
ruling on them.
Chairman Nazemetz stated that the next meeting of the Board would be
held on June 27th, 200l.
Tne Building Inspector was asxed to remind Mr. Antonio Kodrigues
to inform his tenant to come before tne Board for approval of tneir signs.
There being no further business to come before the Board, Mr.
Mcuarthy moved, seconded by Ms. Aloia that the same be duly adjourned,
carried.

Dear Mr. Margotta:
With reference to the construction of a four-foot retaining wall and landfill proposed to
the back yard bordering Bellwood Avenue to the property known as 9 Farrington
Avenue, now owned by the Gomer-van der Merwe's, I have to state that my husband and
I have some serious concerns.
We had requested a meeting with our newest neighbors and asked that they explain
exactly what their intentions are so that we would not object frivolously. After spending
some time with them and going over all aspects, it only confirmed my initial feeling.
Basically, while it may be the Gomer-van der Merwe's back yard, it is, in essence, our
front yard. The following are the issues as I see them:
1.

Impact to existing and thriving arborvitae: A four-foot wall on our side
would have an impact on our expensive and thriving arborvitae planted along
the side and on the gentle slope toward Bellwood. The wall would be the
highest at the front, and taper off after 15-20 feet, more or less, leaving the
trunks of the arborvitae below the wall. Our landscaper has told us that a
situation such as that would not be good for longevity of the trees. A second
point would be, although our trees are planted at least a foot back from the
property line, how would the very fact of construction in such close proximity
affect these beautiful ,living and thriving trees.

2.

Drainage: There will have to be some negative results to altering the lay of
the land in that area. Any drainage holes on our side would not only increase
flow during a heavy rain, but would no doubt wash out the roots of the
arborvitae and hydrangea growing there.

Aesthetics: The natural beauty already existing in that area would be
drastically changed from our viewpoint. As a matter of fact, I visualize it
being rather ugly, unnatural, ultimately killing the trees planted there, creating
washouts and gullies.

In summation, while my husband and I understand the Gomer-van der Merwe's desire for
an even lawn, some of us in the Manor simply do not have it. Tom Kennedy, who built
our house, constructed a railroad tie wall on the other side of our yard and we are
constantly dealing with washouts. It is usually never a good thing to change the lay of
the land.
I do not know whether there is any compromise that can solve this problem as the
Gomer-van der Merwe's seem adamant in going forward. Perhaps if they constructed it
two feet or so back from the property line between us.. just a thought. I am open to
suggestions that will allow us to maintain the natural beauty that now exists. Any
assistance will be appreciated.
