PLANNING BOARD WORK SESSION
November 6,2000
The meeting was called to order by Nicholas Robinson, Chair at 8:14 p.m.

Announcements:
The Chairman introduced Jim Nazemetz, Architectural Review Board Chairman. The
Chairman stated that the Planning Board work session is an informational meeting only.
Jim Nazemetz introduced the Architectural Review Board members in attendance.

a) Kendal-on-Hudson Andy Tung addressed the Board. He briefly discussed some changes to four aspects of
the site plan. They were:
1) utilities
2) access to the development
3) walking trails
4) landscaping

�Andy Tung gave an overview of the proposed layout.
He addressed the site plan changes in the following order:
1) Utilities - The utility changes were shown to the Board via an overlaid
drawing showing the original utilities and the changes. It indicated two
alternate water and sewer connections to the northern loop. Andy Tung stated
that an extensive sewer study was performed. As per this study, the proposed
changes would increase water pressure in Sleepy Hollow Manor and the
Kendal site. The former 8" line would be changed to a 12" line.
2) Access to the development - Andy Tung stated that Rockwood Road is to be
extended to the loop road that would circle the Kendal development. In the
DEIS, an alternate access was proposed. The access to the Kendal site will be
shared with James House. This would allow easier access to the James
House. Additionally, the parking for the James House would be moved.
3) Walking trails - The Kendal path would be connected to the Rockwood Hall
trail. The connection to Sleepy Hollow Manor via a walkway to Birch Close
has been eliminated. A path has been added to make an interval-walking
loop. This allows residents to walk around the entire Kendal campus.
The Chair asked if the applicant had known about Historic Hudson's idea to connect the
GM site with Rockefeller State Park.
Andy Tung responded that at this time it is not possible due to differing elevations and
current railroad conditions.
The Chair asked if the FEIS would include provisions to use Historic Hudson's idea.
Andy Tung responded that the FEIS would state that a future connection could be made
to connect the two. Andy Tung also added that it would be discussed in the FEIS.
4) Landscaping - The buffer on the loop road has been reinforced. The
landscaping around the James House has also been improved.
Steve Ebanusa (Perkins-Eastman Architects) discussed housing in the
Irvington/Tarrytown areas. He also discussed the reasoning for choosing Italianate style
architecture.
Steve Ebanusa presented three views of the proposed development to better illustrate the
intended architecture.
George Tanner asked if the main building height is still 7 stories.
Andy Tung responded yes.

�Andy Tung presented a sketch to indicate the view of the Kendal development as seen
from the Hudson River.
The Chair commented about the view from Rockwood Hall and asked the applicant to
explain how the buffer area will be maintained to keep the buffer.
Andy Tung showed a photo that would indicate how the buffer would look after 10 years
of development.
The Chair recommended keeping a comparable kind of mitigation in this area.
Dave Smith asked if any other elements are to be added to the roof line.
Steve Ebanusa responded that they added a lantern similar to the lantern on the James
House.
Andy Tung stated that Steve Ebanusa prepared a booklet as part of the FEIS. It describes
the different elements that were integrated into the architectural style used on this project.
Al DelBello stated that the FEIS would be finalized this week. He also stated that the
applicant would come before the Planning Board and the Architectural Review Board for
a formal recommendation.
Andy Tung stated that a revised site plan would be submitted with the FEIS.
The Chair asked if the applicant had given the Fire Department and Police Department a
chance to input their comments.
Andy Tung responded that only on an informal basis.
Jim Nazemetz requested an informal work session with Perking-Eastman Architects.
Steve Ebanusa agreed.
Jim Nazemetz stated that this work session would take place between Thanksgiving and
Christmas.
b) Sleepy Hollow Association/John Fremont house Dave Smith distributed a letter on the John Fremont house and property zoning analysis.
(see attached)
Dave Smith summarized the zoning analysis via three sketches.
The Chair stated that the Code could be changed to designate the John Fremont House as
a historic landmark that meets Federal and State criteria. The Chair also stated that if
landmark status were given, only three plots would be possible due to setbacks.
Nicholas Cicchetti asked if the Village could do this.

�The Chair responded that the Planning Board could make a recommendation to the
Village Board of Trustees to amend the law. The Chair also stated that this matter would
be sent to the Architectural Review Board for input.
c) Omnipoint Judson Seaburt is representing this application. He discussed the visual analysis that is to
accompany the DEIS. He stated that a detailed balloon test was recently performed.
Judson Seaburt stated that as per Dave Smith, the conditions for the balloon test were not
perfect due to the foliage.
The Chair stated that no effective notice was provided to the residents of Sleepy Hollow.
He also added that the foliage was not minimal.
Judson Seaburt stated that the applicant intends to perform another balloon test.
George Tanner stated that every resident in Sleepy Hollow Manor would need to be
noticed. Also, the test would have to be performed on two days.
Judson Seaburt stated that the applicant went ahead based on a May 18,2000 letter. He
also stated that another balloon test would be performed with proper notice provided.
George Tanner stated that the previous applicant gave notice to all residents.
Judson Seaburt responded that they followed the May 18,2000 letter and that one
representative of the Sleepy Hollow Manor Association and the Building Inspector are to
be noticed.
The Chair stated that under SEQRA, the applicant must provide data to support the DEIS.
Donna Stipo stated that there was a problem with the balloon test. She described how a
comparable balloon test was performed using a lollypop effect.
Jim Nazemetz asked how high is the tower currently.
Judson Seaburt responded 107 feet.
Jim Nazemetz asked if 15 feet are to be added to it.
Judson Seaburt responded yes.
Donna Stipo presented views from Kykuit. Photos were taken from three views that the
tower is visible from.
Donna Stipo presented views from Rockefeller State Park. Photos were taken from
Croton trailways.

�Donna Stipo also presented photos to demonstrate the balloon test from the Hudson
River. She stated that there is no impact from the lighthouse.
The Chair stated that the Planning Board would provide guidance on when to perform the
next test.
Jim Nazemetz asked what was the diameter of the antenna.
Judson Seaburt responded that it was 19" tapered but it is wider at the top. He also added
that they would try to get a dummy accelerator to simulate the appearance of the antenna.
The Chair stated that a date for the balloon test and an alternate date be provided.
Donna responded that a weekday and weekend date would be provided.
The Chair asked what notice would be provided to the Sleepy Hollow Manor residents.
George Tanner responded that 14 days should be given. All Sleepy Hollow residents
should be noticed as well. The applicant could obtain these names from the Sleepy
Hollow Manor Association.
Jim Margotta stated that the balloon test notice should be sent to him as well and he will
distribute to every board in the Village.
d) Fremont Dredging The Chair stated that the Village Board of Trustees has indicated that they want to be the
lead agency for this application. Currently, the Village Planning Board is the lead
agency. The Chair stated that if the lead agency designation is transferred, all agencies
are to be notified.
The Chair asked if scoping documents were done.
Dave Smith responded that no scoping documents were done.
The Chair stated that the Village Board of Trustees is to be informed about yielding lead
agency status. The Village Board of Trustees is to notify all agencies on their intent to
have lead agency status transferred to them.
This item will be on the Planning Board's agenda for the November 16,2000 meeting for
the purpose of transferring lead agency status to the Village Board of Trustees.
e) County House Road The Chair handed out a letter on the SEQRA requirements (see attached).

�The Planning Board went into executive session at 10:11pm to discuss matters of
litigation.
The Planning Board re-convened at 10:46 pm. No action was taken.
