MINUTES OF MEETING

Antonio Rodrigues. 344 N. Broadway (Retail and Commercial Office Building)
The applicant for site plan review was represented at the meeting by his attorney,
John Hughes, and by his architect. The chairman opened the session by informing the
applicant that the application for site plan approval remained incomplete. The applicant
suggested an adjournment of the public hearing, which was agreed-upon.
Mr Hughes then addressed the Board. He informed the Board that the Zoning
Board of Appeals had granted certain variances that had been requested by the applicant.
There was a general discussion of the scope of the variances. With respect to the setback
from Broadway, the applicant was given a variance of 10 feet from the 20 foot setback
required by the zoning regulations. Mr. Perlmutter noted that the existing steel fram is
setback less than 10 feet from Broadway and thus it remained in violation of the Village
zoning code. There was a further discussion of setback and building orientation.
The chairman noted that, in addition to a coastal consistency form, which had still
not been provided, the applicant had not provided the Board with a landscape plan, a
drainage plan, or a lighting plan. There was a discussion of the potential impacts of
traffic exiting onto Glover Avenue and then turning south on Broadway at a dangerous
point south of the traffic light. The applicant was told to conduct a traffic study that
addressed both the impact of the commercial traffic load on Gordon Avenue and the
safety issues associated with egress onto Broadway from Gordon Avenue.
The chairman asked the Applicant what was the status of the "Philipse Plaza"
building which the Planning Board had approved for the northern portion of the property
over a year previously, and which had not been built. He asked whether the applicant
intended to proceed with that project or abandon it in favor of the current project. Mr.
Perlmutter pointed out that the approvals for Philipse Plaza had lapsed, and thus that the
applicant had no existing authorization to build it. Mr. Stever noted that the applicant did
not show Philipse Plaza on the site plan, and that if the applicant did not intend to
abandon that project he should revise his site plan to show the relationship of the two
contiguous buildings and associated parking lots.
Fox Ridge Transportation. River Street
No person representing Fox Ridge Transportation appeared before the Board. On
motion made by Mr. Perlmutter and seconded by Ms. Gaylin, the Board instructed Mr.
Margotta to contact the Village Prosecutor and proceed to terminate the unlawful use of
the premises.

The applicant presented preliminary plans which required variances. He
requested that action be deferred until he received variances he was seeking from the
ZBA No action was taken.
