                  <text>A regular meeting of the Planning Board was held on April 17,1997 at 8:00 PM in Village Hall,
28 Beekman Avenue, Sleepy Hollow, New York 10591

Members Present: George Hritz, Chairman

Mr. Hritz called the Planning Board meeting to order at 8:00 PM
IN THE MATTER OF MIGUEL JIMINEZ. 135 CORTLANDT STREET. SLEEPY HOLLOW
NEW YORK 10591
The proposed application is a multiple dwelling and retail unit. Mr. Ron Tumquist is the architect
for the applicant proposing a project on Cortlandt Street. The first floor includes retail space with
dwelling units on the second and third floor.
The location of site is one property away from the Rock of Salvation church. Union Hose Fire
Company is next to the church.
Mr. Hritz asked if there is a back yard there now. Yes.
Mr. Tumquist stated that he is here to show schematic drawings, he does not expect any
resolutions. It is 5ft back from the Rock of Salvation Church, they are the property line. A
planting is suggested in from the building as a buffer. The third dimensions are not developed
yet.
This project would be considered mixed use by the retail building up to the front yard. The
residential portion of the project refers to R-4 which requires 20ft which would meet the
requirements of retail but not residential.

�There is a walk way around the left side and two dwellings on the south side.
Mr. Cicchetti stated that 17 parking spots are required and 10 are proposed.
It was mentioned that is was more for the Zoning Board to decide.
There will be a lot more detail next time, this is only a basic layout. Mr.Jiminez owns the property
next door while parking can be placed on that site. This will be presented to the Zoning Board.
Mr. Caetano asked what type of retail will be occupying the space. Mr. Jiminez stated that there
will be no stores, maybe a flower shop or an antique shop would be considered, but no stores.
At this point the Planning Board is sending the application to the Zoning Board.
Mr. Caetano made a motion to declare the Planning Board as lead agency, seconded by Ms.
Sawyer-Gaylin. Motion carried in favor of circulation and the Board's intention of becoming lead
agency and referring the application to the Zoning Board.

Mr. Margotta stated that Mr. Glover had a retaining wall built, which was a railroad tie wall that is
extremely high. Some ties were tilting and a neighbor called the office. An engineer looked at it
and the wall was not properly done. It had to be taken down. Cronin Associates was the engineer
who determined it should be taken down and put in something temporary for drainage. There
were plans for a concrete wall 8ft high. Mr. Glover told Mr. Margotta that he would not be
present tonight. The temporary work appears to be working.
This wall should not have been built. A requirement is to get the Village's engineer involved.
In maKing an observation, one wall has failed to temporarily stabilize complaints about water
problems, whereas before the wall there were no problems.
Mrs. Landi's property below has experienced water damage. The water is in her
garage/basement and has washed away the top soil. Batches of hay and sand bags have been
placed to try and keep the water out. Also a tree is holding up the wall.
It was recommended by Cronin Associates that the wall be taken down.

�Ms. Gandolfo, Esq. stated that a court order should be written, a notice to appear in court due to
creating a hazardous condition on other properties and for putting up a wall without a permit.
Mr. Hritz stated that there is enough information to get the process started. This will be handled
in court.
Mr. Margotta will notify the neighbors when the court hearing is.
Mr. Caetano stated that the neighbors may want to ask Antonio Rodriques for an easement if it
would help the situation.
IN THE MATTER OF 8-9 KENDALL AVENUE. SLEEPY HOLLOW. NEW YORK (not on the
public agenda).
Mr. James Saughter, the attorney for the Hecht family who own 8-9 Kendall Avenue stated that
the property consists of an office area and a residential apartment upstairs. The tree care
company started to do some renovation without governmental approval. The work could not be
done due to funds and would like to use the warehouse offices. Mr. Barstow will be working up a
site plan for a more formal application. The use was abandoned for two years. A shampoo/ soap
manufacturing Co. was turned down.
Mr. Caetano stated that it is grandfathered. If the company is closed for one year it's
automatically gone. This should be handled through the Zoning Board.
Gordon Hecht stated that the tree company did what they wanted. When the Hechts came back
from vacation, they found out that a permit was not taken out and told them not to continue.
The intention is not to have a manufacturing company, the major manufacturing company is in
Long Island City and New Jersey. If the village approved, they would use the existing office the
way it is and take down the stuff that was put up. The tree company only does organic feeding of
roots and they have 5-6 employees who do telemarketing and work from 4 - 8 p.m. Occasionally
until 10 p.m. Two trucks leave in the morning and come back at dusk. From November until
February they are out of business and there are only the three principals in the office.
David Hecht stated that all their products are non flammable. Inside there was an active pump.
The Village has stored fire trucks in the warehouse.

�This is a non-conforming use and the applicant should have appeared before the Zoning Board.
An extended use may still need a variance. Mr. Hritz stated that this application should appear
before the Zoning Board.
Being no further business, the meeting was adjourned.
