THE PERMIT WILL BE GRANTED SUBJECT TO THE FOLLOWING TERMS, COVENANTS AND CONDITIONS

All applicants for County Permits shall file with the Permit Agent, 148 Marine Ave.-Rm. 518, White Plains,
New York, New York State Workmen's Compensation Board Standard Forms C-105.2 and DB-120.1 as proof of compliance with
the Workmen's Compensation and Disability Benefits Laws.
If an applicant or holder of a permit represents that he is not required to carry either a Workmen's Compensation policy or a
Disability Benefits policy or both, New York State Workmen's Compensation Board Standard Form C-105.21. in duplicate, shall
be filed with the Permit Agent.
Section 57 ot the Workmen's Compensation Law and Section 220, Subdivision 8 of the Disability Benefits Law provide that a
permit shall not be issued unless the above prerequisites are satisfied.

The permittee shall erect and maintain suitable barricades to adequately delineate and protect the site
during and in which his or its work is in progress. Warning flags, signs, flashing yellow lights and • . . . . .
watchmen shall be provided a s necessary. Excavated material should be stored in neat piles, so placed
as to cause the least interference with the use of the roadway or sidewalks. Where the free flow of
traffic la interfered with, the permittee shall place and maintain traffic control devices pursuant to prov i s i o n s of sections 1680 and 1682 of trre New York State Vehicle and Traffic Law. All traffic control
associated with maintenance, repair, and construction, within the highway limits, shall be carried out in
accordance with standards set forth in the New York State Manual of Uniform Traffic Control Devices, '-,"/* * *

(10) Permanent restoration of the finished pavement shall not be made until complete aettlement of the trench backfill shall
have taken place, as directed by the Commissioner. Immediately sfter backfilling the trench, aa acceptable temporary
repair of cold patch, bituminous macadam or other acceptable flexible pavement ma ten si shell be placed which shall be
aaaiatained even with the roadway surface until permanent restoration of the pavement is ordered by the Commissioaer.
If ordered bv the C o m m i s s i o n e r , c e m e n t c o n c r e t e may b e substituted for bituminous m a t e r i a l s in
temporary r e p l a c e m e n t s .
(11) At such rimes a a directed by the Commissioner, die peraaaaent replacement of pavement shall be made under the super
vision and inspection of the Commiaaioner, as follows:
(A) OB CONCRETE PAVEMENTS, which become undermined or broken the slabs shall be completely replaced on a prepared
foundation with rein breed concrete nine (9) in. thick in the proportion of 1:2:5'/$ using High Early or Quick Setting
Cement mixed by machine for at least 2 minutes. Materials and proportioning of aggregate shall be inspected aad approved by the Commissioner.
When cross-trenches are excavated vertically, without undercutting the concrete pavements, die slab shall be oeady
eat back a distance or* at least two (2) feet on each side of die outer walla of the trench aad replaced with a reinforced
concrete patch. Wbere any portion of a patch ia nearer than eight (8) feet from an expansion joint the patch shall be ex••aded to die joint. There longitudinal trenches have been made in concrete pavements, the enure slab shall be ir*
placed.

Dear Mr. Galgano:
In accordance with condition 14 of the Resolution of the
Planning Board dated September 17, 1992, the applicant makes the
following offers to the Village of North Tarrytown and will abide
by those offers:
1.

Condition 10 of Resolution-

The applicant offers to refrain from transferring title
to any of the proposed subdivision's fourteen (14) lots
until driveway permits for each of the site's four (4)
driveways proposed for Bedford Road and each of the
Site's four (4) driveways proposed for Webber Avenue have
been obtained in final form the appropriate New York
State and Westchester County approval authorities.
2.

Condition 11 of Resolution-

The applicant offers to absorb the full cost and
financial impact of the loss of any lots and to waive any
rights to claims of compensation due to a reduction in
the proposed subdivision's lot count that is the result
of the applicant's failure to obtain from the appropriate
New York State or Westchester County approval authorities
driveway curb cut permits for any of the four (4)
driveways proposed for Bedford Road or any of the four
(4) driveways proposed for Webber Avenue.

Condition 12 of Resolution'

In lieu of bonding for the proposed utilities, planting
plan and tree removal permit requirements, if the
applicant fails to complete the project, all monies held
in escrow by the Village of North Tarrytown, including
but not limited to fifteen thousand dollars ($15,000.) in
payments for recreation fees associated with this site
and any outstanding sums not previously spent for
inspection and consultant fees, shall be forfeited to the
Village and may be used by the Village to complete the
utilities and to restore the site to a vegetated state as
similar to its existing condition as is practicable.
In no case, shall the use of such monies release the
applicant from its duty to pay such recreation,
consultant and inspection fees and to complete all
utilities and plantings required by this resolution or
required by the Tree Commission of the Village of North
Tarrytown.
4.

Condition 13 of Resolution-

The applicant, at its sole cost and expense, shall repair
any public street that is damaged or subjected to unusual
wear due to the applicant's construction activity and
associated activities.
