                  <text>The Planning Board of the Village of North Tarrytown met on Thursday,
August 17, 1978 at 8:00 P.M. in the Municipal Building, 28 Beekman Avenue,
North Tarrytown, N.Y.

The first order of business was discussion of a preliminary application
for a subdivision of Section 14, Block 22, Lot 2B, property owned by
Douglas D'Arpino on Highland Avenue. Mr. D'Arpino was present and explained
to the Board that he owned a lot on Highland Avenue and he wanted to
subdivide the lot so that he could build a house on the second piece of the
lot. Board members expressed concern that he would have to use the Paper
Street to meet the setback requirements. Mr. D'Arpino informed the Board
that no part of his house would be located on the paper street. He would
only use the street for the footage requirements. He also told the Board
that the paper street would never be used as a thru street. Mr. Caro
expressed concern that the paper street would be used to help meet the
setback requirements. Mr. Caro brought up the fact that in 1977 the Village
Board of Trustees voted not to eliminate the paper street and that we would
be going against their intent if we were to allow a property owner to use
the street for this purpose. Mr. Windas stated that it is not up to the
Planning Board to determine if a house meets the zoning requirements. The
Board's only function is to decide whether the proposed subdivision should
be approved. He stated it would then be up to the property owner to apply
to the Zoning Board for approval to build.
Mr. Caro moved the question, seconded by Mr. Gasparovic. The Board
voted to approve the preliminary application for subdivision submitted by
Mr. D'Arpino.
Miss Gandolfo advised Mr. D'Arpino that he would receive written
notice that the preliminary application had been approved and that she
would notify him as to the procedure for applying for final approval.
The second order of business was a discussion of a preliminary
application for a subdivision of property owned by Anthony Gasparovic,
also known on the Village tax maps as Section 17, Block 15, Lot 15B.

The last order of business was a discussion for approval of a
preliminary application for subdivision of property located at 75 College
Avenue, also known on the Village Tax maps as Section 16, Block 14, Lot 20.
Mr. Arnold Berman, Esq. was present on behalf of the owners of the property.
He explained to the Board that the owners wanted to sell the property so
that it could be used by the new owners for a parking lot.
Mr. Gasparovic moved to approve the preliminary application, seconded
by Mr. Windas. Carried.
Miss Gandolfo advised Mr. Berman that he would receive written notice
that the preliminary application had been approved and that she would
notify him as to the procedure for applying for final approval.
There being no further business, the meeting was adjourned at 10:00 P.M
