FINAL

A special meeting of the Planning Board was held on Wednesday,
October 21, 1992 at 8:00 PM in Village Hall, North Tarrytown, New
York.

IN THE MATTER OF PHELPS HOSPITAL - MRI PROJECT
This is an adjourned public hearing.
Mr. McCarthy moved, seconded by Mr. Windas, that the Planning
Board declared itself lead agency for purposes of conducting an
environmental review of the project. The motion was unanimously
adopted.
The Hospital advised that it will provide handicapped parking
spaces, as required by the ADA Act. The Hospital will provide a
revised site plan of the entire Hospital site to show the
location of the spaces. The Hospital will also show on the
revised site plan the details of the MRI building.
Phelps requested that the Village issue a conditional foundation
approval so that it could prepare the site for the MRI unit. The
Hospital agreed that the Village could grant such approval
subject to: (i) any comments of the Westchester County Planning
Department with respect to the project and (ii) the approval of
the Planning Board for the parking spaces (including the
handicapped spaces).
Phelps agreed to contribute $2400 in recreation fees based on 2
required parking spaces for the MRI building.
Dr. Salman moved, seconded by Mr. Windas, that the project should
be classified as a Type I action because the Hospital is located
in a critical environmental area and that the Planning Board has
determined that the project would not have any material adverse

�impact on the environment.

The motion was unanimously adopted.

IN THE MATTER OP THE LUBERGER ESTATE - SUBDIVISION
Mr. Spencer reported a conversation with Robert Barstow,
architect for the project, in which Mr. Barstow advised that the
berm had been removed from the parking space in back of the
commercial building and the oil tank pipe had been removed. The
oil tank is to be removed or filled with sand in accordance with
applicable laws, rules and regulations. The Planning Board wants
the tank removed. There is a question whether the garden in the
rear of the multi-family residence will be paved. The Planning
Board requested that the Building Inspector check on the status
of the project.
IN THE MATTER OF THE BEDFORD PARK PROJECT
The Board asked who was responsible for making certain that the
developer complied with the various conditions of approval of the
subdivision and site plan. The Building Inspector has primary
responsibility. There was a question whether the developer had
filed any bond required by the tree removal permit. Dr. Salman
requested that counsel review the bonding provisions of the
various resolutions to insure that there were no conflicting
provisions.
