Present: James Galgano, Acting Chairman Richard Ayers Alan Kaplan Steven Baderian Roman Windas Also Present: John Hughes, Village Attorney James Margotta, Building Inspector Joseph Gulino, Consultant. Camce Thomas Gissen, Consultant, Clarke Asso. A motion to approve the July 19, 1990 minutes as written was made by Alan Kaplan and seconded by Richard Ayers. IN THE MATTER OF THE KRINGAS SUB-DIVISION. (WEBBER MEWS) . NORTH TARRYTOWN. N. Y. Mr. Ron Turnquist, architect for the project appeared before the Board. He stated that he addressed the Board last October with a larger scaled project, but has decreased the size to 4 units. There is an existing building on Parcel B with 5 units. Proposed project will have 4 units, Unit A & D, will have 3 bedrooms, and Units B & C will have 2 bedrooms apiece. Mr. Kringas' children will be living in two of the units, and the other two units will be for sale. Mr. Turnquist stated that Parcel A would meet all the present Zoning requirements. He also stated the the proposed plan was submitted to the Mayor and Board of Trustees and they approved the plans. He also noted that the present building does not conform to Zoning Code which permits single family dwellings, and that they will require three variances. There were questions concerning the existing trees on the property, and Mr. Turnquist stated the would preserve as many as they could. Discussion tabled until next meeting of the Board. PUBLIC HEARING: Mr. Philip Zegarilli, president of the Briggsville Neighborhood Association, addressed the Board, wanted to go on record as opposing the proposed project. He also requested copies of any new plans that were submitted, so that the association may review them. IN THE MATTER OF THE SLEEPY HOLLOW CEMETERY. NORTH TARRYTOWN. NEW YORK This is a continuation of last month's hearing. 15 �Mr. Larry Nardeccia appeared before the Board on behalf of the Sleepy Hollow Cemetery and reviewed the project. He presented a letter from Deputy Commissioner Eschwielder, of the Westchester County of planning, with comments that they would like to see a buffer zone required, however the cemetery renovation was a matter of local determination. He also presented letters from the New York state Department of Transportation and the New York State Department of Environmental Conservation. The DEC letter stated that 2 items were requested. A permit would be required for piping. The letter further stated that it was not a designated wetlands. A short form EAF form was completed, the full Environmental Assessment has been completed for parts 1, 2 and 3. Under the village's local law for Wetland/Watercourse protection, Sleepy Hollow Cemetery must submit an application to receive a permit from the Planning Board in order to be inMfull compliance with the terms of this local law". Mr. Nardeccia stated that every time he asked for an application for a permit, he was told there wasn't a formal application. Mr. Windas suggestion that a formal application be submitted by following Section 61-10 of the Wetlands/Watercourse Code, articles 1 thru 6 a-k. It was further discussed that under the Village's local law, this application must be treated as a Type I action, under the requirements of the New York State Environmental Quality Review Act. This will require that the procedures of a coordinated review be followed. This requires that the Planning Board declare its intention to become lead agency, that a notice of this intention be sent to all involved agencies and that a waiting period for responses from other involved agencies be adhered to. A motion was made by Richard ning Board act as the lead process and to notify other was seconded by Alan Kaplan. Ayers that the North Tarrytown Planagency in the environmental review involved agencies of same. Motion Motion passed unanimously. There being no further business, meeting adjourned 9:20 PM.
