PUBLIC HEARING

NORTH TARRYTOWN, N.Y.
February 16th, 1989

A Public Hearing was held before the Planning Board
of the Village of North Tarrytown on the above date.
PRESENT:

James Galgano, Chairman
Ellen Tsangaris
John O'Leary
Richard Ayers
Frank Rey

Chairman Galgano called the meeting to order at 8 P.M.
The Acting Clerk read the Public Notice to hear and
consider an application of Edward and Mary Friedner, 28 Lakeview
Avenue, North Tarrytown, N.Y. for a Final Subdivision of the
premises located at Lakeview Avenue and Pokahoe Drive known and
designated on Village Tax Assessment Map as Section,11, Block 1R,
Lot 1.
Chairman Galgano asked if there was anyone present
who would like to address the Board.
Mr. Hughes stated that several inquiries had been
received regarding "wet lands" and"flood lands". He stated
that as early as the summer of 1987 the Village had requested the
State and the County to rule on the possibility of the said area
being considered "wet lands" or being in a "flood zone". Mr. Hughes
stated that he has on file, correspondence from the Department of
Environmental Conservation, the Army Corps, of Engineers and the
County of Westchester, all stating that the construction did not
interfere with any waterways or with the outlet of Fremonts Pond.
Mr. Hughes stated it was his conclusion that the
construction would not obstruct any waterways and that a single
family residence would be constructed. He also stated that the
plans had been reviewed by Mr. George Lackowitz on behalf of the
Village.
Dr. Richard Sweet stated that the Department of Environmental
Conservation is not concerned with any wetlands less than 12.4 acres
in size, but recommended that the Village adopt an Ordinance that
would cover various other streams and waterways in the Village.
Chairman Galgano reported that the Sleepy Hollow Manor
Improvement Assoc*
had various convenants and suggested that the
Friedners contact them in order to conform with their covenants.

�-2After a discussion, Mr. O'Leary moved, seconded by
Mr. Ayers that the Final Subdivision of Section 11, Block 1-R, Lot 1
as requested by Mr. &amp; Mrs. Friedner be approved. Carried.
Mr. O'Leary moved, seconded by Mr. Ayers that, the
Public Hearing be closed. Carried.
Chairman Galgano stated that the next order of business
would be a preliminary hearing on the Amenta Project.
Mr. John Amenta submitted revised plans to each member
of the Board, stating that with the plans submitted there would be
no Zoning changes required. Mr. Amenta stated th^at two (2) catch
basins would be installed to tie in with the Mangieri property, more
trees will be planted and sufficient flood lights would be installed,
Mr. O'Leary asked if there was an artist rendition of
the new building.
Mr. Amenta stated they would have drawings made after
preliminary plans were approved by the Planning Board.
After a discussion Chairman Galgano stated that the
Planning Board would review the plans and contact the Amenta family.
Mr. Margotta, Building Inspector stated he would see
that the plans were sent to the State and County for their approval.
Mr. O'Leary moved, seconded by Mr. Ayers that the
Planning Board be the lead agency in this project. Carried.
Mr. Rey moved, seconded by Mr. O'Leary that the Minutes
of the meeting held on January 19th, 1989 be approved as submitted.
Carried.
Chairman Galgano stated that the next meeting of the
Board would be held on March 16th, 1989 at 8 P.M.
There being no further business to come before the
Board, Mr. O'Leary moved, seconded by Mr. Rey that the meeting be
duly adjourned. Carried.

WHEREAS, the aforesaid subdivision permits the

WHEREAS, the property contains no structure or
area that is listed or eligible to be listed on the
Federal Register of Historic Places or designated by
the local Historic Architectural Review Board as an
historic landmark or district and the said subdivision
complies with all regional, state and local land use
plans;

�NOW, THEREFORE BE IT RESOLVED:
1. The subdivision of the property as above
described is an unlisted action pursuant to Article
8 of the Environmental Conservation Law and Part 617
of the Rules and Regulations promulgated thereunder,
and will, in and of itself, not have a significant
effect on the environment, so that no Environmental
Impact Statement is required or need be filled
therefor.
2.

Nothing herein contained, however, shall

be deemed to indicate or suggest that subsequent
submissions for development of the property will
not require the preparation and filing of Environmental Impact Statements.
3. This resolution is a Negative Declaration
for the purposes of ArticXe 8 of the Environmental
Conservation Law, Local L^v Environmental Quality
Review Act for the Village of North Tarry town, and
will be kept on file at trie Village Hall and be
available for public examination.
