A Regular Meeting of the Planning Board of the Village
of North Tarrytown was held on the above date.

Chairman Galgano called the meeting to order at 8 P.M.
J. Tornello -254-256 No. Broadway- Alterations to Service Station.
Mr. Wiedle of Frederick P. Clark Associates, Consultants
for the Village of North Tarrytown presented a Draft memorandum
for their perusal regarding the Tornello Project. (Copy of memo
in Official Minutes)
A discussion followed regarding screening, entrance
and exitways, canopy etc.
Chairman Galgano stated that the matter should be
referred to the Zoning Board. Mr. O'Leary moved, seconded by
Ms. Tsangaris t hat the Tornello Project be referred to the
Zoning Board. CARRIED.
MASSARO and PALUETTI Proposed Dwelling Unit Addition- 6 family to
7 family dwelling. (Corner of Valley Street and Chestnut Street)
Mr. Wiedle presented a Memorandum to the Board Members
regarding the proposed changes. (Copy in Official Minutes)
A discussion followed regarding minimum lot size, setbacks,
maximum height and parking.
Mr. O'Leary moved, seconded by Ms. Tsangaris that the
matter be referred to the Zoning Board. CARRIED.
JOYNER PROJECT-Cinton Street Proposed Residential Development
Mr. Wiedle presented a Memorandum to the Board Members
regarding the Joyner Project. (Copy in Official Minutes)
A discussion followed regarding parking spaces, floor
plans, conversion of the existing residence to a two-family
residence, and the new three proposed dwelling units.- It was

�-2bited that the existing building is non-conforming with regard
to front and side yard setbacks, and a variance may be required.
The applicant was directed to submit more complete utility plans
including water, sewer, gas and electric, sidewalk improvements
etc.
Mr. O'Leary moved, seconded by Ms. Tsangaris that the
applicant be referred to the Zoning Board. Carried.
AMENTA PROJECT - PROFESSIONAL OFFICE BUILDING - Northeast Corner
OF Broadway (Route 9) and Chestnut Street.
Mr. Wiedle presented a Draft Resolution for Final Site
Plan/Sub-Division Approval for the Board's perusal.
After a discussion Mr. O'Leary moved, seconded by Mr.
Ayers that the Resolution be adopted after approval by the
Village Attorney. CARRIED. (COPY IN OFFICIAL MINUTES).
Mr. Joseph Gulino, Representing Charles Manganaro,
Consulting Engineers for the Village presented a memorandum
regarding various items which need to be addressed. (COPY OF
MEMO IN OFFICIAL MINUTES).
WAYNE JEFFERS, (UNCLE JERRY'S RESTAURANT) - 410 North Broadway
The following items were discussed by the Board:
Curb cuts, sidewalk along Gordon Avenue, unstable rock,
on-site parking, loading zone, canopy in service station area,
utilities, storm drainage, water supply and sewage disposal
facilities, landscaping, buffers, signs and lighting.
The Village Attorney was instructed to prepare a Final
Site Plan Resolution to be presented*to the Board at their next
meeting.
Mr. O'Leary moved, gecon^ed by Mr. Ayers that the
Minutes of November 16th, 19 89 be approved as submitted. CARRIED.
It was noted that the Minutes of the October, 1989
meeting had not been received by the Board members.
Chairman Galgano stated that due to the complexity of
the proposed Halpern Project he felt that the Planning Board
should appoint a sub-committee to meet separately from the regular
Planning Board.
There being no further business to come before the Board,
Mr. O'Leary moved, seconded by Mr. Ayers that the meeting be duly
adjourned. CARRIED.

FINAL SITE PLAN/SUBDIVISION APPROVAL
PROPOSED: PROFESSIONAL OFFICE BUILDING
OWNER:

AND CHESTNUT STREET

WHEREAS, the Planning Board of the Village of North Tarrytown
has reviewed an application for final subdivision approval and
final site plan approval (the Application) pursuant to Zoning
Ordinance Article VIII, Site Plan Review, and the Village
Subdivision Regulations, to construct a professional office
building, including related off-street parking, landscaping, storm
drainage and other supporting utilities and facilities, on a site
approximately 37,104 square feet in size; and
WHEREAS, said property is proposed to be subdivided into two
separate parcels; one containing the existing office building on
approximately 17,035 square feet, hereinafter known as Parcel A;
the other parcel hereinafter known as Parcel B, to contain the
proposed professional office building on the remaining 20,069
square feet, as shown on one drawing (S-l) prepared in the offices
of David Graham Architects in conjunction with a perspective sketch
prepared in the office of James Piccone and Associates, identified
as follows:
1.

S-l "Site Development Plan Prepared for S. Amenta", dated
2/16/89, last revised 6/22/89; and

2.

Perspective Sketch entitled: Armonk Office Building, undated;
filed "Armonk Office Building," prepared in the office of
James Corrado Piccone &amp; Associates, Architects, Ossining, New
York.

WHEREAS, in the course of its review and acting as Lead
Agency, in site plan and subdivision review, pursuant to provisions
of Article 8 of the Environmental Conservation Law, (SEQR) the
Planning Board has made the following findings and caused, noted or
conducted the following activities:
1.

Billed and received a site plan application fee of $910 for
the action under site plan review, $25 for the action under
subdivision review for a combined initial fee of $935; still
to be paid is the SEQR review fee, noted below.

2.

Caused field inspections to be made of the property under
review and its surrounding areas, pursuant to Article VIII of
the Village Zoning Ordinance.

�3.

Requested, received and reviewed an Environmental Assessment
Form (EAF) in compliance with SEQR;

4.

Held a duly noticed public hearing in on July 20, 1989 at
which time all interested persons were given an opportunity to
comment and be heard on the proposed
site plan and
subdivision.

5.

After the review of field conditions, recommendations and EAF,
as well as other matters noted herein, has determined that the
proposed Action of site plan review and related subdivision is
an Unlisted type and hereby issues a "Negative Declaration,"
determination of non-significant environmental impact; and

WHEREAS, the Applicants have received from the Zoning Board of
Appeals:
1)

a variance for provision of parking spaces, which do not meet
the definition under Article 2, Section 62-4 of the Zoning
Code;

2)

a variance for the provision of 39 parking spaces for the
proposed professional office building, when 40 such spaces are
required in accordance with Article 3, Section 62-14 of the
Zoning Ordinance and;

3)

a variance for Article 4, Section 62-8 for the proposed use of
the site for a professional office building which is not
specifically listed in the Schedule of permitted or accessory
uses for the C-l Highway Commercial Zoning District; and

WHEREAS, the small parking lot for the existing building on
proposed Parcel A, located off Chestnut Street, is proposed to be
expanded to add 4 additional parking spaces which will involve
relocating and reconstructing the existing stone retaining wall on
the east side of said parking area;
NOW, THEREFORE, BE IT RESOLVED, that said
site plan
application and site plan drawings noted above be and hereby are
granted site plan approval and subdivision approval and that the
Applicant may obtain the endorsed approval of the Planning Board
Chairman, or his designated agent, as authorized by the Planning
Board, on a copy of the site plan and subdivision plat, when
revised as necessary to show compliance with the following
conditions, which endorsement shall permit filing in the office of
the Village Building Department and Westchester County Clerk (for
subdivision purposes) for purposes of obtaining a building permit
in accordance with this resolution
and all building code
requirements, provided, however, that this approval shall expire
six (6) months from the date of this resolution if the following
modifications and conditions have not been completed to the

�satisfaction of the Planning Board and the Applicant has not
obtained a building permit:
1.

Utilities - Storm drainage, water supply and sewage disposal
facilities shall have been approved in writing on the site
plan and subdivision plat by the Village Engineer as
designated by the Village Board of Trustees, including but not
limited to the following:
1.1

Storm water runoff provisions shall comply with the
Planning Board's policy of "zero" increase in rate of
runoff.

1.2

The Applicant shall submit a written report, with back-up
calculations to the satisfaction of the Village Engineer,
indicating his intention to provide adequate fire flow,
water supply and water pressure for the site development.

1.3

The written approval of the Village Engineer regarding
all concerns expressed in a memorandum to James T.
Margotta, Village Building Inspector, from Joseph A.
Gulino of Charles A. Manganaro, Consulting Engineers,
entitled "Proposed Professional Office Building - Amenta
&amp; Sons, Village of North Tarrytown, NY, AMCE #1340",
shall be obtained for his file. (Copy attached).

2.

Exterior Lighting - All exterior light structures shall be
screened so as to prevent glare upon adjacent properties and
shall be of the halide or incandescent variety.

3.

All driveways and parking areas shall be contained by pouredin-place reinforced concrete or cut stone curbs. The wall
proposed to be reconstructed adjacent to the southerly side of
parking space #8 on Parcel A shall be limited to 2' in height
above grade and shall be parallel and abutting the adjacent
property boundary to facilitate vehicular entrance to parking
space #4.

4.

The proposed loading zone for Parcel B shall be located on
Parcel B in the general vicinity of parking spaces numbered 510 in a specific location which minimizes any possible
conflict with vehicle movements; and

5.

The four easternmost parking spaces located along the north
side of the existing office building on proposed Parcel A,
shall be designated as "small cars only", as shall be the two
parking spaces on the southwestern corner of the proposed
professional office building on proposed Parcel B, indicated
on the site plan as spaces 38 and 39. The parking space
indicated as #19 on Parcel B, in the proposed underground
parking area for the proposed professional office building,
shall be designated as "handicapped parking only," as shall

�the parking space opposite the entry on the north side of the
existing office building on proposed Parcel A, indicated on
the site plan as space #21. A screened trash collection
facility shall be shown on the site plan and maintained at the
northerly end of the parking lot on Parcel A, adjacent to the
building.
The parking access, drainage and landscaping approvals at the
New York State Route 9 entrance are contingent on the approval
of the State Department of Transportation (DOT). The large
tree located immediately to the north of the proposed driveway
access to Parcel B shall be maintained in a healthy growing
condition until such time as the Applicant is directed to
remove said tree, in writing, by the the New York State
Department of Transportation, or the DOT removes said tree of
its own volition.
The Applicant shall submit a Final Plat subdivision pursuant
to Section 11 of the Subdivision Regulations of the Village of
North Tarrytown for Planning Board review and approval, which
plat shall be prepared by a licensed surveyor and shall show
all data listed therein as deemed pertinent by the Planning
Board.
The site plan shall be amended to show "no left hand turn"
from the northerly parking lot, shared by Parcel and Parcel B,
onto Broadway (Route 9). The Applicants shall revise the plan
to indicate the appropriate signage to control the restriction
of such movement.
By acceptance of this resolution, the Applicant agrees that
should the Village determine the presently approved parking
and traffic flow plan causes a future severe traffic problem,
said determination to be made by the Village of North
Tarrytown, with input from the New York State Department of
Transportation, then the Village may require the Applicant to
amend and, if necessary, reconstruct the approved parking plan
and/or traffic flow pattern controls.
Review and Recreation Fees - The Applicant shall pay to the
Village of North Tarrytown:
10.1 An inspection fee for the construction inspection of the
proposed site plan to include buildings, drainage system,
sewage, landscaping, lighting and other site plan
elements, for compliance with the approved site plan in
the amount of $1,000.
10.2 The site plan escrow amount pursuant to SEQR and in the
amount of $10,000 or 4% of the total project cost,
whichever is less, which shall be used for consulting
services rendered in the review of the project.

�10.3 A recreation fee of $14,000, based upon the sum of $1,000
per theoretical building lot.
10.4 The above fees shall be paid prior to the signing of the
final site plan and subdivision plat by the Chairman.
Signage on the premises shall be subject to the approval of
the Architectural Review Board, which agency's recommendations
shall be a condition of this Site Plan/Subdivision resolution
of approval.
The Applicant shall submit an easement agreement in recordable
form to the satisfaction of the Village Attorney for the
common use of the entrance way and parking spaces accessed
from Broadway (Route 9) by both the existing office building
on Parcel A and the proposed office building on Parcel B. All
easements shall be noted on the final site plan and final
subdivision plat.
The site plan shall be amended to revise the bulk regulations
schedule for Parcel B to correct the provided side yard
notations of 5 feet and 20 feet to 0 feet and 20 feet, to
correct the provided building height from 34 feet to the
revised elevation, to correct the required parking calculation
and to indicate the correct net rentable square footage of
12,000 feet as opposed to the 11,700 as indicated on the plan.
Revise the site plan to reference and note the dates (and the
appropriate sections of the Zoning Code) of the variances
which have been granted for the subject application.
The site plan shall be revised to indicate the provision of
catch basins and the appropriate pitch to the underground
parking area, so as to collect and remove any water which may
enter the garage through the various windows and openings, the
foregoing to be approved by the Village Engineer or his
designated agent.
A note shall be added to the site plan indicating that the
"finished" side of the wood fence surrounding Parcel B shall
face towards the adjacent properties.
The site plan shall receive approval from the Architectural
Review Board, which agencie's recommendations shall be a
condition of this resolution.
The site plan shall be revised as appropriate to indicate the
widening or redesign of the garage entrance so as to permit
improved visibility of the outdoor parking area and vehicles.

�19.

The Applicant shall obtain the signed professional seal of
architect James Piccone on that portion of the site plan and
notations for which Mr. Piccone is responsible.

20.

The Planning Board reserves the right to make a final field
inspection of the project after construction of the
facilities, upon notice by the Building Inspector but before
the issuance of a Certificate of Occupancy. The purpose of
this final inspection is to review the development and to
require any modifications to parking, landscaping, signs,
drainage, access, paving and other site plan details, as built
drawings of same, which do not comply with the approved plan.
The Applicant shall maintain all elements of the approved site
plan, including landscaping in a neat and healthy condition so
as to retain an approved Certificate of Occupancy.

21.

Prior to the issuance of a Certificate of Occupancy, the
Applicant shall submit to the Village Building Inspector a
mylar reproduction of the site plan, as constructed, and
subdivision plat, as filed in the County Clerk's office, to be
filed in the office of the Village Building Department for
reference by the Village.

22.

This resolution of site plan/subdivision approval is
conditional upon the execution of a lease agreement between
the Village of North Tarrytown and the Applicant for four (4)
parking spaces on the site. The four (4) parking spaces are
numbered and designated as Numbers 10, 11, 12 and 13 on the
Site Development Plan referred to above. This lease shall be
satisfactory, with respect to both form and substance, to the
Village Attorney, prior to execution by the appropriate
Village Official.

central business district and Beekman Avenue, the heart of the
Village, and as it terminates the view along the Beekman Avenue
corridor.

The Master Plan for census tract 116 of the Village of

North Tarrytown, New York, prepared by RPPW, Incorporated states
"The impression gained by travelers from the north as they pass

However, we do

not recommend any action which would promote further investment
in automotive related uses in this area or in uses or proposals
which are contrary to Village planning goals and objectives.

As per my recent telephone conversation with Mr. Amenta, it was agreed
that the items or comments listed below would be addressed:
A) The existing and proposed sanitary sewer connections, as well as the
potable water system should be shown. Show all utilities on Broadway
(Route 9).
B) The calculations of sewage flow from the proposed building should be
submitted.
C) The proposed domestic water connection and sprinkler system should
have separate line connections with backflow prevention systems.
D) Confirmation of the existence of a curb/wall isolating the site
drainage is to be submitted.
In addition, a letter from Lackowitz Engineering confirming their
recommendation of the storm drainage system was submitted to us.
Accordingly, final recommendation will be made to the Planning Board
once the necessary items have been addressed.

landscaping, storm drainage and other supporting utilities and
facilities, on a site approximately 37,104 square feet in size;
and
WHEREAS, said property is proposed to be subdivided into two
separate parcels; one containing the existing office building on
approximately 17,035 square feet, hereinafter known as Parcel A;
the other parcel hereinafter known as Parcel B, to contain the
proposed professional office building on the remaining 20,069
square feet, as shown on one drawing (S-l) prepared in the
offices of David Graham Architects in conjunction with a
perspective sketch prepared in the office of James Piccone and
Associates, identified as follows:

WHEREAS, in the course of its review and acting as Lead
Agency, in site plan and subdivision review, pursuant to
provisions of Article 8 of the Environmental Conservation Law,
(SEQR) the Planning Board has made the following findings and
caused, noted or conducted the following activities:
1.

Billed and received a site plan application fee of $910 for
the action under site plan review, $25 for the action under
subdivision review for a combined initial fee of $935; still
to be paid is the SEQR review fee, noted below.

�2.

Caused field inspections to be made of the property under
review and its surrounding areas, pursuant to Article VIII
of the Village Zoning Ordinance.

3.

Requested, received and reviewed an Environmental Assessment
Form (EAF) in compliance with SEQR;

4.

Held a duly noticed public hearing in on July 20, 1989 at
which time all interested persons were given an opportunity
to comment and be heard on the proposed site plan and
subdivision.

5.

After the review of field conditions, recommendations and
EAF, as well as other matters noted herein, has determined
that the proposed Action of site plan review and related
subdivision is an Unlisted type and hereby issues a
"Negative Declaration," determination of non-significant
environmental impact; and

WHEREAS, the Applicants have received from the Zoning Board
of Appeals:
1)

a variance for provision of parking spaces, which do not
meet the definition under Article 2, Section 62-4 of the
Zoning Code;

2)

a variance for the provision of 39 parking spaces for the
proposed professional office building, when 40 such spaces
are required in accordance with Article 3, Section 62-14 of
the Zoning Ordinance and;

3)

a variance for Article 4, Section 62-8 for the proposed use
of the site for a professional office building which is not
specifically listed in the Schedule of permitted or
accessory uses for the C-l Highway Commercial Zoning
District; and

WHEREAS, the small parking lot for the existing building on
proposed Parcel A, located off Chestnut Street, is proposed to
be expanded to add 4 additional parking spaces which will involve
relocating and reconstructing the existing stone retaining wall
on the east side of said parking area;
NOW, THEREFORE, BE IT RESOLVED, that said site plan
application and site plan drawings noted above be and hereby are
granted site plan approval and subdivision approval and that the
Applicant may obtain the endorsed approval of the Planning Board
Chairman, or his designated agent, as authorized by the Planning
Board, on a copy of the site plan and subdivision plat, when
revised as necessary to show compliance with the following
conditions, which endorsement shall permit filing in the office
of the Village Building Department and Westchester County Clerk

�(for subdivision purposes) for purposes of obtaining a building
permit in accordance with this resolution and all building code
requirements, provided, however, that this approval shall expire
six (6) months from the date of this resolution if the following
modifications and conditions have not been completed to the
satisfaction of the Planning Board and the Applicant has not
obtained a building permit:
1-

Utilities - storm drainage, water supply and sewage disposal
facilities shall have been approved in writing on the site
plan and subdivision plat by the Village Engineer as
designated by the Village Board of Trustees, including but
not limited to the following:
1.1

Storm water runoff provisions shall comply with the
Planning Board's policy of "zero" increase in rate of
runoff.

1.2

The Applicant shall submit a written report, with
back-up calculations to the satisfaction of the Village
Engineer, indicating his intention to provide adequate
fire flow, water supply and water pressure for the site
development.

1.3

The written approval of the Village Engineer regarding
all concerns expressed in a memorandum to James T.
Margotta, Village Building Inspector, from Joseph A.
Gulino of Charles A. Manganaro, Consulting Engineers,
entitled "Proposed Professional Office Building Amenta &amp; Sons, Village of North Tarrytown, NY, AMCE
#1340", shall be obtained for his file. (Copy
attached).

2.

Exterior Lighting - All exterior light structures shall be
screened so as to prevent glare upon adjacent properties and
shall be of the halide or incandescent variety.

3.

All driveways and parking areas shall be contained by
poured-in-place reinforced concrete or cut stone curbs. The
wall proposed to be reconstructed adjacent to the southerly
side of parking space #8 on Parcel A shall be limited to 2'
in height above grade and shall be parallel and abutting the
adjacent property boundary to facilitate vehicular entrance
to parking space #4.

4.

The proposed loading zone for Parcel B shall be located on
Parcel B in the general vicinity of parking spaces numbered
5-10 in a specific location which minimizes any possible
conflict with vehicle movements; and

5.

The four easternmost parking spaces located along the north
side of the existing office building on proposed Parcel A,

�shall be designated as "small cars only", as shall be the
two parking spaces on the southwestern corner of the
proposed professional office building on proposed Parcel B,
indicated on the site plan as spaces 38 and 39. The parking
space indicated as #19 on Parcel B, in the proposed
underground parking area for the proposed professional
office building, shall be designated as "handicapped
parking only," as shall the parking space opposite the entry
on the north side of the existing office building on
proposed Parcel A, indicated on the site plan as space #21.
A screened trash collection facility shall be shown on the
site plan and maintained at the northerly end of the parking
lot on Parcel A, adjacent to the building.
The parking access, drainage and landscaping approvals at
the New York State Route 9 entrance are contingent on the
approval of the State. Department of Transportation (DOT).
The large tree located immediately to the north of the
proposed driveway access to Parcel B shall be maintained in
a healthy growing condition until such time as the Applicant
is directed to remove said tree, in writing, by the the New
York State Department of Transportation, or the DOT removes
said tree of its own volition.
The Applicant shall submit a Final Plat subdivision pursuant
to Section 11 of the Subdivision Regulations of the Village
of North Tarrytown for Planning Board review and approval,
which plat shall be prepared by a licensed surveyor and
shall show all data listed therein as deemed pertinent by
the Planning Board.
The site plan shall be amended to show "no left hand turn"
from the northerly parking lot, shared by Parcel and Parcel
B, onto Broadway (Route 9). The Applicants shall revise the
plan to indicate the appropriate signage to control the
restriction of such movement.
By acceptance of this resolution, the Applicant agrees that
should the Village determine the presently approved parking
and traffic flow plan causes a future severe traffic
problem, said determination to be made by the Village of
North Tarrytown, with input from the New York State
Department of Transportation, then the Village may require
the Applicant to amend and, if necessary, reconstruct the
approved parking plan and/or traffic flow pattern controls.
Review and Recreation Fees - The Applicant shall pay to the
Village of North Tarrytown:
10.1 An inspection fee for the construction inspection of
the proposed site plan to include buildings, drainage
system, sewage, landscaping, lighting and other site

�plan elements, for compliance with the approved site
plan in the amount of $1,000.
10.2 The site plan escrow amount pursuant to SEQR and in the
amount of $10,000 or 4% of the total project cost,
whichever is less, which shall be used for consulting
services rendered in the review of the project.
10.3 A recreation fee of $14,000, based upon the sum of
$1,000 per theoretical building lot.
10.4 The above fees shall be paid prior to the signing of
the final site plan and subdivision plat by the
Chairman.
11.

Signage on the premises shall be subject to the approval of
the Architectural Review Board, which agency*s
recommendations shall be a condition of this Site
Plan/Subdivision resolution of approval.

12.

The Applicant shall submit an easement agreement in
recordable form to the satisfaction of the Village Attorney
for the common use of the entrance way and parking spaces
accessed from Broadway (Route 9) by both the existing
office building on Parcel A and the proposed office
building on Parcel B. All easements shall be noted on the
final site plan and final subdivision plat.

13.

The site plan shall be amended to revise the bulk
regulations schedule for Parcel B to correct the provided
side yard notations of 5 feet and 20 feet to 0 feet and 20
feet, to correct the provided building height from 34 feet
to the revised elevation, to correct the required parking
calculation and to indicate the correct net rentable square
footage of 12,000 feet as opposed to the 11,700 as indicated
on the plan.

14.

Revise the site plan to reference and note the dates (and
the appropriate sections of the Zoning Code) of the
variances which have been granted for the subject
application.

15.

The site plan shall be revised to indicate the provision of
catch basins and the appropriate pitch to the underground
parking area, so as to collect and remove any water which
may enter the garage through the various windows and
openings, the foregoing to be approved by the Village
Engineer or his designated agent.

16.

A note shall be added to the site plan indicating that the
"finished" side of the wood fence surrounding Parcel B
shall face towards the adjacent properties.

�17.

The site plan shall receive approval from the Architectural
Review Board, which agencie's recommendations shall be a
condition of this resolution.

18.

The site plan shall be revised as appropriate to indicate
the widening or redesign of the garage entrance so as to
permit improved visibility of the outdoor parking area and
vehicles.

19.

The Applicant shall obtain the signed professional seal of
architect James Piccone on that portion of the site plan and
notations for which Mr. Piccone is responsible.

20.

The Planning Board reserves the right to make a final field
inspection of the project after construction of the
facilities, upon notice by the Building Inspector but before
the issuance of a Certificate of Occupancy. The purpose of
this final inspection is to review the development and to
require any modifications to parking, landscaping, signs,
drainage, access, paving and other site plan details, as
built drawings of same, which do not comply with the
approved plan. The Applicant shall maintain all elements of
the approved site plan, including landscaping in a neat and
healthy condition so as to retain an approved Certificate of
Occupancy.

21.

Prior to the issuance of a Certificate of Occupancy, the
Applicant shall submit to the Village Building Inspector a
mylar reproduction of the site plan, as constructed, and
subdivision plat, as filed in the County Clerk's office, to
be filed in the office of the Village Building Department
for reference by the Village.

22.

This resolution of site plan/subdivision approval is
conditional upon the execution of a lease agreement between
the Village of North Tarrytown and the Applicant for four
(4) parking spaces on the site. The four (4) parking spaces
are numbered and designated as Numbers 10, 11, 12 and 13 on
the Site Development Plan referred to above. This lease
shall be satisfactory, with respect to both form and
substance, to the Village Attorney, prior to execution by
the appropriate Village Official.

As requested, we have reviewed the plans submitted for sketch
plan approval of the conversion of an existing single-family
dwelling to a two-family dwelling and the construction of three
attached dwelling units on the adjacent property located along
the east side of Clinton Street. The applicants have submitted
one sheet of plans for review entitled "Proposed Three Family
Dwelling and Conversion to a Two-Family Dwelling - Site Plan,
Driveway Elevation" prepared by Robert Stanziale, AIA, undated.
Although the plans have changed somewhat from the original
proposal back in October, most of the comments of our October 19,
1989 memo (attached) still apply, specifically review comments 1
and 3 through 12.
We have the following additional review
comments:

The applicants should prepare a

As requested, we have reviewed an application for site plan
approval for the conversion of an existing basement garage to a
proposed basement "handicap" dwelling unit within a three-story
frame apartment building containing six existing dwelling units
located on the corner of Valley Street and Chestnut Street in a
C-2 General Commercial Zoning District.
The applicants have
submitted a plan entitled "Proposed Handicap Dwelling Unit Floor
Plan - Site Plan" dated December 4, 1989, prepared by Julius
Twyne, Jr., Architect.
Review Comments
The Planning Board has no alternative
application for the following reasons:

Minimum Lot Size. This residential development is regulated
under the R-5 Residence District Standards which requires a
minimum lot size of 5,000 square feet for the first three
dwelling units and 1,500 square feet for each additional
unit.
The existing site area is presently somewhat less
than 4,000 square feet in area yet contains six existing
dwelling units which require a minimum lot size of 9,500
square feet. The proposal would make this property further
non-conforming and that it would add an additional dwelling
unit and require a minimum lot size of 11,000 square feet.

2.

Maximum Coverage.
Again under R-5 Standards, the maximum
coverage of the site is 30%.
The existing structure
presently covers approximately 45% of the site area.

3.

Yard Setbacks.
The existing building is currently nonconforming with regard to the rear, front and side yard
setback requirements.

4.

Maximum Height. The maximum permitted height for a building
in this zoning district is 45 feet. The applicants have not
indicated the existing height of the building.

5.

Parking.
The existing building presently contains an
existing two-car basement garage with no additional offstreet parking. The existing six dwelling units within this
structure presently require a minimum of nine (and most

�likely twelve) off-street parking spaces, and is therefore
non-conforming due to a shortage of between 7 and 10 parking
spaces.
The proposal would remove the existing two-car
garage for conversion to a handicap apartment and
additionally require three more parking spaces, thereby
eliminating all off-street parking spaces on the property
and increasing the lack of required off-street parking
spaces to between 12 and 15 parking spaces depending on the
number of bedrooms in the existing units.

1.2

The Applicant shall submit a written report, with
back-up calculations to the satisfaction of the Village
Engineer, indicating his intention to provide adequate
fire flow, water supply and water pressure for the site
development.

1.3

The written approval of the Village Engineer regarding
all concerns expressed in a memorandum to James T.
Margotta, Village Building Inspector, from Joseph A.
Gulino of Charles A. Manganaro, Consulting Engineers,
entitled "Proposed Professional Office Building Amenta &amp; Sons, Village of North Tarrytown, NY, AMCE
#1340", shall be obtained for his file. (Copy
attached).

2.

Exterior Lighting - All exterior light structures shall be
screened so as to prevent glare upon adjacent properties and
shall be of the halide or incandescent variety.

3.

All driveways and parking areas shall be contained by
poured-in-place reinforced concrete or cut stone curbs. The
wall proposed to be reconstructed adjacent to the southerly
side of parking space #8 on Parcel A shall be limited to 2'
in height above grade and shall be parallel and abutting the
adjacent property boundary to facilitate vehicular entrance
to parking space #4.

4.

The proposed loading zone for Parcel B shall be located on
Parcel B in the general vicinity of parking spaces numbered
5-10 in a specific location which minimizes any possible
conflict with vehicle movements; and

5.

The four easternmost parking spaces located along the north
side of the existing office building on proposed Parcel A,

�shall be designated as "small cars only", as shall be the
two parking spaces on the southwestern corner of the
proposed professional office building on proposed Parcel B,
indicated on the site plan as spaces 38 and 39. The parking
space indicated as #19 on Parcel B, in the proposed
underground parking area for the proposed professional
office building, shall be designated as "handicapped
parking only," as shall the parking space opposite the entry
on the north side of the existing office building on
proposed Parcel A, indicated on the site plan as space £21.
A screened trash collection facility shall be shown on the
site plan and maintained at the northerly end of the parking
lot on Parcel A, adjacent to the building.
The parking access, drainage and landscaping approvals at
the New York State Route 9 entrance are contingent on the
approval of the State Department of Transportation (DOT).
The large tree located immediately to the north of the
proposed driveway access to Parcel B shall be maintained in
a healthy growing condition until such time as the Applicant
is directed to remove said tree, in writing, by the the New
York State Department of Transportation, or the DOT removes
said tree of its own volition.
The Applicant shall submit a Final Plat subdivision pursuant
to Section 11 of the Subdivision Regulations of the Village
of North Tarrytown for Planning Board review and approval,
which plat shall be prepared by a licensed surveyor and
shall show all data listed therein as deemed pertinent by
the Planning Board.
The site plan shall be amended to show "no left hand turn"
from the northerly parking lot, shared by Parcel and Parcel
B, onto Broadway (Route 9). The Applicants shall revise the
plan to indicate the appropriate signage to control the
restriction of such movement.
By acceptance of this resolution, the Applicant agrees that
should the Village determine the presently approved parking
and traffic flow plan causes a future severe traffic
problem, said determination to be made by the Village of
North Tarrytown, with input from the New York State
Department of Transportation, then the Village may require
the Applicant to amend and, if necessary, reconstruct the
approved parking plan and/or traffic flow pattern controls.
Review and Recreation Fees - The Applicant shall pay to the
Village of North Tarrytown:
10.1 An inspection fee for the construction inspection of
the proposed site plan to include buildings, drainage
system, sewage, landscaping, lighting and other site

�plan elements, for compliance with the approved site
plan in the amount of $1,000.
10.2 The site plan escrow amount pursuant to SEQR and in the
amount of $10,000 or 4% of the total project cost,
whichever is less, which shall be used for consulting
services rendered in the review of the project.
10.3 A recreation fee of $14,000, based upon the sum of
$1,000 per theoretical building lot.
10.4 The above fees shall be paid prior to the signing of
the final site plan and subdivision plat by the
Chairman.
Signage on the premises shall be subject to the approval of
the Architectural Review Board, which agency's
recommendations shall be a condition of this Site
Plan/Subdivision resolution of approval.
The Applicant shall submit an easement agreement in
recordable form to the satisfaction of the Village Attorney
for the common use of the entrance way and parking spaces
accessed from Broadway (Route 9) by both the existing
office building on Parcel A and the proposed office
building on Parcel B. All easements shall be noted on the
final site plan and final subdivision plat.
The site plan shall be amended to revise the bulk
regulations schedule for Parcel B to correct the provided
side yard notations of 5 feet and 20 feet to 0 feet and 20
feet, to correct the provided building height from 34 feet
to the revised elevation, to correct the required parking
calculation and to indicate the correct net rentable square
footage of 12,000 feet as opposed to the 11,700 as indicated
on the plan.
Revise the site plan to reference and note the dates (and
the appropriate sections of the Zoning Code) of the
variances which have been granted for the subject
application.
The site plan shall be revised to indicate the provision of
catch basins and the appropriate pitch to the underground
parking area, so as to collect and remove any water which
may enter the garage through the various windows and
openings, the foregoing to be approved by the Village
Engineer or his designated agent.
A note shall be added to the site plan indicating that the
"finished" side of the wood fence surrounding Parcel B
shall face towards the adjacent properties.

The site plan shall receive approval from the Architectural
Review Board, which agencie's recommendations shall be a
condition of this resolution.

18.

The site plan shall be revised as appropriate to indicate
the widening or redesign of the garage entrance so as to
permit improved visibility of the outdoor parking area and
vehicles.

19.

The Applicant shall obtain the signed professional seal of
architect James Piccone on that portion of the site plan and
notations for which Mr. Piccone is responsible.

20.

The Planning Board reserves the right to make a final field
inspection of the project after construction of the
facilities, upon notice by the Building Inspector but before
the issuance of a Certificate of Occupancy. The purpose of
this final inspection is to review the development and to
require any modifications to parking, landscaping, signs,
drainage, access, paving and other site plan details, as
built drawings of same, which do not comply with the
approved plan. The Applicant shall maintain all elements of
the approved site plan, including landscaping in a neat and
healthy condition so as to retain an approved Certificate of
Occupancy.

21.

Prior to the issuance of a Certificate of Occupancy, the
Applicant shall submit to the Village Building Inspector a
mylar reproduction of the site plan, as constructed, and
subdivision plat, as filed in the County Clerk's office, to
be filed in the office of the Village Building Department
for reference by the Village.

22.

This resolution of site plan/subdivision approval is
conditional upon the execution of a lease agreement between
the Village of North Tarrytown and the Applicant for four
(4) parking spaces on the site. The four (4) parking spaces
are numbered and designated as Numbers 10, 11, 12 and 13 on
the Site Development Plan referred to above. This lease
shall be satisfactory, with respect to both form and
substance, to the Village Attorney, prior to execution by
the appropriate Village Official.

Tornello - CITGO Service Station Canopy - Sketch Site
Plan Review

As requested, we have reviewed the application for sketch site
plan approval for the construction of a proposed canopy over
three existing gas pumps for the CITGO gasoline service station
located on the southeast corner of Broadway/Route 9 and Hudson
Street.
The Applicants have submitted one sheet of plans
entitled "Survey of Property Prepared for John Tornello Situate
Village of North Tarrytown, Town of Mount Pleasant", prepared by
John J. Muldoon, dated November 4, 1989.
GENERAL REVIEW COMMENTS
The Applicants have not shown sufficient information to
adequately review this application.
The Applicants should be
required to submit a revised site plan indicating at least the
following information:
A location map, existing zoning, the
proximity to public/quasi-public uses, all information necessary
to indicate compliance with Section 62-19 of the Zoning CodeGasoline Service Stations, existing site contours, drainage,
curbs, sidewalks, existing landscaping, tank locations, parking,
location of nearby traffic lights and a zoning bulk
diagram/compliance schedule.
In general, we do not recommend any action on the part of the
Village Planning Board or Zoning Board of Appeals which would
allow further investment, intensification and strengthening of
such automotive uses along the Route 9 corridor, in particular,
at this most important intersection in the Village.
This
proposal is another example of why North Tarrytown should proceed
with its study of long range planning goals to hasten the
rejuvenation of the Village's central business area and
surrounding residential areas, and not prolong the existence of
inappropriate and unattractive uses in critical areas.
This proposal is in compliance with the permitted uses within the
Zoning District, but is one that may be detrimental to the
Village as a whole. The zoning in this area should be considered
for change from C-l Highway Commercial to a new zone that would
prohibit automotive related businesses and would allow a limited
range of non-residential uses that do not generate excessive peak
hour traffic, such as certain professional offices, as well as
multi-family uses that would help buffer the adjacent residential
districts.
Such a limited commercial zone would further the

�planning objectives of the Village of improving the visual image
of the Village, easing the traffic situation at Beekman and Route
9 and adding to the compatibility the surrounding residential
areas.
Although no rezoning of this area has occurred, we feel that such
a "cleansing" of the existing uses in this critical area for the
Village is essential to the rejuvenation of the Village of North
Tarrytown.
The Village Board of Trustees, the Zoning Board of
Appeals and the Planning Board should be encouraging such new
uses and improvements in anticipation of these legislative acts.
The impact of this proposal goes far beyond the limits of the
particular property boundaries. This property is one of the most
visible properties within the Village; it signals the entrance
to the central business district and Beekman Avenue, the heart of
the Village. The Master Plan for census tract 116 of the Village
of North Tarrytown, New York, prepared by RPPW, Inc. states "The
impression gained by travelers from the north as they pass the
intersection of Broadway and Beekman Avenue, the major entrance
to the business area, is negative and uninviting. At present,
some main features of this intersection are service station
signs, large paved areas, and a vacant building.
Not an
inviting scene for motorists driving through the Beekman Avenue
shopping district."
(Page 7).
That Plan continues on to
recommend the beautification of the intersection of Beekman and
Broadway to serve as an inviting entrance point to the central
business area.
A subsequent study of the Broadway/ Beekman Avenue/ Bed ford Road
intersection area was prepared for the Zoning Committee of North
Tarrytown by Frederick P. Clark Associates back in September of
1988. This plan essentially agrees with the conclusions of the
1980 RPPW Master Plan, and proposes the rezoning of this critical
area for the Village to prohibit automotive related uses in this
area and to permit limited commercial development on this
property as discussed above. The Planning Board and Zoning Board
of Appeals should consider the recommendations of these two
Village documents when considering such proposals.
The Planning Board should be concerned with more than the issue
of a canopy for this gas station, but with the overall
improvement and conformity of the property with the zoning code
and the long term planning goals and objectives of the Village of
North Tarrytown.
SPECIFIC REVIEW COMMENTS
It appears that this application is non-conforming with respect
to the existing zoning in several respects:

proposal constitutes an expansion and alternatives of a nonconforming use in violation of the Zoning Code.

CONCLUSIONS AND RECOMMENDATIONS
With regard to this particular application, the Planning Board
has no alternative but to deny the application for at least the
violations of the Zoning Code as noted above and to require the
information requested at the beginning of this memo if any and
all such variances are granted by the ZBA.
In general, we do not recommend any action by the Planning Board
or the Zoning Board of Appeals which would promote further
investment in automotive related uses in this area or in uses or
proposals which are contrary to Village planning goals and
objectives.
Having said this, we must also caution against
arbitrary or capricious actions which might deny an Applicant's
rights under current zoning.

As per my recent telephone conversation with Mr. Amenta, it was agreed
that the items or comments listed below would be addressed;
A) The existing and proposed sanitary sewer connections, as well as the
potable water system should be shown. Show all utilities on Broadway
(Route 9) .
D) The calculations of sewage flow from the proposed building should be
submitted.
C) The proposed domestic water connection and sprinkler system should
have separate line connections with backflow prevention systems.
D) Confirmation of the existence of a curb/wall isolating the site
drainage is to be submitted.
In addition, a letter from Lackowita Engineering confirming their
recommendation of the storm drainage system was submitted to us.
Accordingly, final recommendation will be made to the Planning Board
once the necessary items have been addressed.
