NORTH TARRYTOWN PLANNING BOARD

December 2, 1987

Chairman Galgano called the meeting to order at 8:10 p.m.
North Tarrytown Realty Associates Site Plan
Mr. Karpel, speaking for the N. Tarrytown Realty Associates, gave
a detailed account on the history of the development . Almost 150 meetings have been held with the village, county, and state. Access to the
site was to originally to have been through Amos St., but the state,
county and village recommended access off of Bedford Road.

But, an

emergency alternative access road was needed, and Amos St. was the choice
of the fire department. It would be chained off, with bushes to discourage any use of the area other than emergency vehicles.
Mr. Karpel noted zoning regulations allowed for 17 single family
units, which was reduced to 15 units in three cluster buildings. Extra
parking -a total of 45 spaces - was supplied when only 15 spaces were
required. A turn around area was made for easier entrance/exit. Benefits
of the development are many, as this will contribute to the village
taxes-'— he estimated sveral thousand dollars per year, per unit. The
roads will be private, and maintained by the property owners, and
garbage removal will be done by a private firm.
On approval of the site plan, N. Tarrytown Assoc, will give approximately $25,000.00 for recreational purposes, and $75,000.00 will go to

a sewar rehabilitation fund.
In consideration of neighboring properties, it was said there
would be no building on heavily wooded areas, leaving the trees and
plantings as they are now, nor will roads disturb trees or bushes. A
setback from the property lines is planned for on the northern side.
It was noted that the old cottonwood trees won't be affected.
There will be 4 buildings, three with four units, and one with
three units.Each unit will have its own driveway and garage.
Mrs. Andrycich asked how high the buildings will be. She was
told they would be 2*5 stories high, approximately 35 feet high.
Mr. Hayes read his letter to the Board to all present, expressing
his concern over the development, and its being too close to property
ownners on Amos St.
When asked about setbacks, Mr. Karpel said they were in compliance
with the zoning codes. He said sewar pipes will be put in by N. Tarrytown Realty Associates, not the village.
Residents asked if they were covered by the village for any possible
damage that might occur from the blasting. They were told yes.
Concerns over bus stops and left turns onto Bedford Rd. from the
development were expressed. Mr. Zegarelli asked if there might be a
better road than Amos St. to use as an access.
Mr. Karpel said a stockade fence would be installed along the
property line at Amos St.
Some residents asked why the special fire access road was needed.
Board members explained the fire chief said it was so needed. Residents
asked for aguarantee that Amos St. would only be used for fire and/or
emergency vehicles.
Mr. Ceconi asked the Board to delay their vote so that residents
in the area might obtain a lawyer.

�Mr. Zegarelli asked if catch basins were planned for. Mr. Lackowitz
said yes, and that they would run together, with a zero runoff.

The

sanitary sewer and the storm sewer would run under the aqueduct at
different points.

A total of $75,000.00 is for the North Broadway

downhill sewer.
Mr. Hayes asked why had plans changed from 14 units to 15 units.
It was expalined that had been for 14 individual units versus the now
four buildings on the site.
A resident who lives on New Broadway asked if the board would
guarantee no new runoff?

He said depending on the competitive bidding by contractors, the cost
could range from $35 to $50 thousand.

to New Broadway could be done.
Mr. Lackowitz said the size of the sewer and the CFS can be increased
at New Broadway.
A resident asked Chairman Galgano what his feelings were regarding
having Bedford Road used as the site's entrance.

Chairman Galgano noted

that access to and from Webber Road to Route 448 is dangerous, as
there is less sight there than directly onto Bedford Road from the

Member Ray Windas said no matter which road is used, access to the
development from Bedford Road will be hard, when making a left turn.
Mr. Ceconi asked that a fence be built to keep contractors from
parking on Amos Street.

He also expressed concern about the playground

area.
A resident read from the January 26, 1987 minutes that safety
issues concerned then Mayor Zegarelli.

Mr. Zegarelli said consultant-

him, but the fire department's request for access from Amos Street
concerned him.

He asked if school buses would have difficulty entering

and leaving the development.
Business Meeting
Mr. Hayes said he would prefer a buffer hedge.

He was told the

site will have proper, lovely landscaping.
When asked, no "guesstimate" would be given as to the possible
cost of these units.
Mr. Homan read several changes in the resolution to all present.
They concerned:

Regarding

fire safety, page 4.

2.

Performance guarantee, paragraph 9, page 5.

Mr. Ceconi asked Village Attorney, John Hughes if he would give
the residents any legal advice.

Mr. Hughes declined, saying it would

be fair, as he represented the Planning Board.
Mr. windas asked the public what where they against.

Mr. Ceconi

asked for a five-foot buffer hedge at the emergency entrance/exit to
keep AMos Street safe for the children who live there.
A resident asked if North Tarrytown zoning allowed for cluster
housing?

Mr. Zegarelli said he felt cluster housing was better than

17 or 14 separate units.

Board member Frank Rey said he felt an access from Webber Rd. is
not needed. And, Amos St. will not become an access road to the
property for residents of the new development.
Mr. Ceconi said a fence and shrubbery would keep owners from
parking on Amos St.
It was asked if a dead end sign on Amos St. would help deter
traffic. The Board said they would look into this.
Mr. O'Leary asked how much a fence would cost, and said he joined
with the residents over their concerns. The developer said he couldn't
give a figure. Mr. O'Leary said the Planning Board has worked hard to
make adjustments and to help all concerned. A certificate of occupancy
will not be given by the Planning Board unless they give the site plan
their final approval.
A motion to end the public hearing was made by Mr. O'Leary,

seconded

by Mr. Rey, and carried by a unanimous vote.
BUSINESS MEETING

It was decided

that the banking of the houses be buffered as ori-

ginally planned.
Mr, windas said that on p.9, paragraph 3, the word "may" should be
changed to "will". He noted that the entrance onto Bedford Rd. may need
special treatment.
It was noted that the state DOT recommended that no light was
needed at the entrance/exit at Bedford Rd. However, the DOT will look
at the plans again before giving their final approval.
Mr. Margotta said the fence should be installed before the construction begins.
Mr. Rey said he wanted a deacceleration lane on Bedford Rd. as

an access to the entrance/exit

of the condominiums.

Mr. Jimenez suggested a higher hedge. Mr. Rey then said thattrees
and buffers should be continuous along Mr. Haye's property.
A motion for a temporary barrier to deter entrance from Amos St.
was made, along with a final barrier to be installed upon completion
of the housing, was made by "

carried by a unanimous vote.

Larry Rodrigues Site Plan
Mr. Homan said the resolution re the preliminary site plan puts
into writing all that was discussed at the last meeting.
Mr. Windas asked if all property on the site plan was in the
same zone? Mr. Margotta said yes.
Mr. Windas said he questioned the use of the property now coming
down Depeyster St. that is used as a parking lotr— was this the same
piece of land? Mr. Margotta said it was not.
Mr. Rey said p.3, paragraph 5.3 of the resolution should have the
words "in the vicinity" deleted.
Mr. Homan asked Mr. Weidle to please show a more detailed land
plan in regard to the landscaping for the next meeting. He suggested
grating around the trees.
A motion to pass said resolution for Larry Rodrigues' site plan
was made by Mr. O'Leary, seconded by Mr. Jimenez, and was carried by
a unanimous vote.
Chairman Galgano asked if there was any other pending business.
There being none, the meeting was adjourned at 10:10 p.m.

All utilities including conditions noted above shall
be reviewed and approved by the Planning Board or its
designated engineering consultant.

2.6

The applicant shall discuss with the New York State
Department of Transportation the feasibility of
providing a deceleration lane on Bedford Road for
vehicles traveling southeast wishing to enter the
site. Such deceleration lane, shall be constructed if
approved by the New York State Department of
Transportation.

Safety - The Village Fire Department has indicated the
desire for emergency access via Amos Street. For purposes
of safety, screening of vehicle lights and to restrict the
casual use of the emergency access, yet to make it
possible for emergency vehicles to gain entrance the
applicant shall install a five (5) foot tall cedar
stockade-type fence, with evergeen shrub plantings where
it can be viewed from Amos Street, to extend (finished
side out) along the entire easterly property line to
points approximately seventy-five (75) feet in from
Bedford Road and Webber Avenue so as not to interfere with
traffic sight distances. The fence shall include a locking gate, capable of being opened at least ten (10) feet
wide, to make it possible for fire, police or ambulance
vehicles to gain access.
The emergency access shall be
used only for emergency vehicles and neither the gate or
Amos Street shall be used for construction vehicles, site
workers vehicles or occupants of.the site during or after
construction.
A temporary fence may be provided during
construction but the permanent fence shall be in place
prior to the issuance of a certificate of occupancy. No
trees greather than 6" caliper shall be removed during the
fence installation and the alignment of the fence may be
adjusted as reasonably necessary to achieve its purposes.
Landscaping - All landscaping shown on the site plan shall
Ee maintained in a healthy growing condition so as to
maintain the certificate of occupancy.
A typical landscaping plan around one of the buildings shall be
submitted for approval by the Planning Board or its
designated representative.
Final review of tree cutting
shall be made by the Village Tree Committee.
Exterior Lighting - All exterior light structures shall be
screened so as to prevent glare upon adjacent properties.
All driveways and parking areas shall be contained by
stone set in concrete or poured-in-place reinforced
concrete curbs.
All parking for occupants and users of
the project shall be confined to the site.

�Review Fees - The applicant shall pay to the Village of
North Tarrytown:
7. 1 An inspection fee for construction inspection of the
proposed site plan to include buildings, drainage
system, sewage, landscaping, lighting and other site
plan elements for compliance with the approved site
plan in the amount of $5, 000.00.
7.2

A site plan escrow account pursuant to SEQR and in
the amount of $5,000.00 or such specific amount which
is billed to the Village and approved and paid for
consulting services rendered in the review of this
project, whichever is the greater amount.

7.3

A recreation fee of $1,000.00 per dwelling or
$15,000.00 for the acquisition or maintenance of
recreation facilities in the vicinity of the project
and available for use by occupants of the housing
facilities.

7.4

The above fees shall be paid prior to the signing of
the final site plan by the Chairman.

Performance Guarantee - Prior to the issuance of a certificate of occupancy, the applicant shall complete the
construction of all facilities shown on the site plan to
the satisfaction of the Building Inspector. Alternatively,
the applicant shall post a bond in an amount to be
determined by the Building Inspector to ensure the satisfactory construction
and
installation
of driveways,
parking
areas,
drainage
facilities,
water
supply
utilities, sanitary
sewers, arid landscaping.
Such
guarantee shall be satisfactory to the Village Attorney as
to form, sufficiency, and execution, and shall be issueds
by a bonding or surety company approved by the Village
Board or by the owner with security acceptable to the
Village Board. The term of the bond shall be fixed for a
period of three (3) years; however, the term may be
extended with the consent and agreement of all parties.
The guarantee shall extend for a period of one (1) year
beyond the date of completion of the required improvements
to ensure their satisfactory condition. Any defects in
construction or faulty equipment shall be repaired or
replaced by the applicant without cost to the Village.
The Planning Board reserves the right to make and shall
make a final field inspection of the project after
construction of the facilities upon notice by the Building
Inspector but before the issuance of a certificate of
occupancy.
The purpose of this final inspection is to
review the development and to require any modifications to
parking, landscaping, signs, drainage, access, paving and

�other site plan details in the interest of safety,
convenience, enjoyment of peace and quiet of adjacent
neighbors and aesthetics.
The applicant shall maintain
all elements of the approved site plan including landscaping in a neat and healthy condition so as to retain an
approved certificate of occupancy.
10.

Prior to obtaining a building permit, four (4) copies of
this final site plan as revised to meet the above
conditions shall be submitted to the Planning Board office
for final approval. This final site plan review shall be
accomplished by the Village Engineering Department or
consultant and shall incorporate all applicable conditions
of this resolution and the construction standards of the
Village of North Tarrytown as they may be appropriate.

Landscaping —
All landscaping shown on the site plan
shall be maintained in a healthy growing condition so as
to maintain the certificate of occupancy. Landscape Plan
A, dated January 1983, is attached hereto. Prior to the
issuance of a certificate of occupancy, the applicant
shall provide landscaping in accordance with the plan.
Exterior Lighting — All exterior light structures shall
be screened so as to prevent glare upon adjacent
properties.
All driveways and parking areas shall be contained
poured-in-place reinforced concrete curbs.

Review Fees — The applicant shall pay to the Village of
North Tarrytowns
5.1

An inspection fee for construction inspection of the
proposed site plan to include buildings, drainage
system, sewage, landscaping, lighting and other site
plan elements for compliance with the approved site
plan in the amount of $5,000.00.

5.2

A site plan escrow account pursuant to SEQR and in
the amount of $5,000.00 or such specific amount which
is billed to the Village and approved and paid for
consulting services rendered in the review of this
project, whichever is the greater amount.

5.3

A recreation fee of $1,000.00 per dwelling or $12,000
for the acquisition or maintenance of recreation
facilities and available for use by occupants of the
housing facilities.

5.4

The above fees shall be paid prior to the signing of
the final site plan by the Chairman.

The Planning Board reserves the right to make and shall
make a final field inspection of the project after
construction of the facilities upon notice by the Building
Inspector but before the issuance of a certificate of
occupancy.
The purpose of this final inspection is to
review the development and to require any modifications to
parking, landscaping, signs, drainage, access, paving and
other site plan details in the interest of safety,
convenience, enjoyment of peace and quiet of adjacent
neighbors and aesthetics. The applicant shall maintain
all elements of the approved site plan including landscaping in a neat and healthy condition so as to retain an
approved certificate of occupancy.

7.

Prior to obtaining a building permit, four (4) copies of
this final site plan as revised to meet the above
conditions shall be submitted to the Planning Board office
for final approval. This final site plan review shall be
accomplished by the Village Engineering Department or
consultant and shall incorporate all applicable conditions
of this resolution and the construction standards of the
Village of North Tarrytown as they may be appropriate.
