The Planning Board met on April 10 to review the site plan of
Tarrytown Realty Corp. (Mr. George Kahn).
[The following notes were taken by the Clerk beginning at approximately 8:45 p.m. The plans, obviously, had been under review and
any comments made up until 8:45 p.m. were not recorded.]
Present:

Residents of Webber Park spoke again of their concern for the
neighborhood with Tappan Motors expanding to the Gordon Avenue/
Broadway property. They are concerned for the safety of the children in the area because of increased, sometimes unlicensed, traffic
moving through the streets of Webber Park and excess parking of
cars on Tappan Motors property which cars are often unlicensed and
in need of repair.

Katherine Lingardo, Pine Close, spoke about the/safety in the streets
and she was informed that there had been a traffic study made and a
report was submitted to the Board. This study was an extensive one
and it suggested that the volume of traffic was not heavy. This
report was handed to several residents for their perusal.
Vincent Buonanno, Van Tassel Avenue, addressed the Board and said
that he hoped that the Board would be able to tell the residents about
each of their concerns so that they would be sure that the property
owner is within the law.
Ugo Checchi, College Avenue, asked where the property line lies. He
was informed that the property in question goes up to 10* from the
curb and the proposed building will be 13' back from the curb.
The residents are concerned regarding the lack of curbing and a sidewalk on Gordon Avenue and they were told that the Village has the
right to go back 5* from the curb for a sidewalk.
In response to residents' concern about the volume of cars parked
on Mr. Kahn's property, he stated that there will be 27 spaces provided for 18-24.employees as well as customers. Mr. Kahn has, however,
as many as 60 employees and the residents are worried about where they
will park their cars.
The Board advised that there has been an Environmental Impact Study
done which suggested a no left-hand turn sign be placed at the
Gordon Avenue/Broadway corner. Mr. Checchi questioned who will enforce
this prohibited turn.
There was also a question regarding the fencing on the property and
Mr. Peirce said that this is a Zoning question, however it does meet
the Code.

�Eugene Buonanno, Gordon Avenue, asked if the Planning and Sorting
Boards could meet together to make a decision on the site plan and
Mr. Galgano informed him that the two Boards do not meet at the
same time to consider a problem and each Board considers different
areas of the problem* Mr. Galgano also pointed out that once the
Building Inspector says the site plans meet requirements, Mr. Kahn
can proceed with his plans.
Mr. Galgano informed the residents that many of their concerns are
the concern of the Zoning Board and the Zoning Board
cannot consider these questions until the Planning Board has everything in order.
In regard to the variance which was granted to the previous owner,
Mr. Peirce advised that once a variance is granted it remains with
the land, not the owner.
Carmen Caposella, Rice Avenue, asked if Mr. Kahn could begin to build
if and when the site plan was approved; Mr. Galgano told him that it
must first go to the County Board. Mr. Caposella wanted to know
how much time there would be to register an objection once the site
plan was approved. He was informed by Mr. Margotta that if the plan
was approved, or turned down, he or Mr. Kahn could then go to the
Zoning Board of Appeals.
Mrs. Lingardo asked if the Planning Board has the power to approve the
site plan even if there is a question regarding parking. Mr. Rey
advised her that the Board mades decisions based on what they feel
is in the best interest of the community.

Mr. Buonanno asked again if it would be considered illegal if Mr. Kahn
used the parking spaces for wrecked cars. The residents feel that
he will use the space as he sees fit even though they are to be solely
for use by his employees and customers. Mr. Margotta checked on the
cars parked on Mr. Kahn's lot and the signed complaints were given
to the Court, to be held until the Zoning Board hands down a decision.
It is a violation to store junk in these "parking" spaces.
Alexander Fudali, 125 Gordon Avenue, said he is appalled by the way
George Kahn disregards the neighbors of Webber Park.
Frank Caro, 262 Farrington Avenue, said he feels it is the obligation
of the Board to insure that a proper environmental study is done;
it should not be the obligation of the citizens to prove.
Mario DiFelice wanted to know why the Dept. of Transportation was
not requested to do the Env. Impact Study; he wa? informed that they
do not do these studies.
Eileen Meade, Gordon Avenue, was informed that anyone breaking the
law- unlicensed cars being driven through the area, disobeying signs,
etc.- will be prosecuted.

�In general, the residents feel that Mr. Kahn has been in violation
of Village ordinances since 1968 and the Village has not done
anything about it.
Frank Rey feels that a variance, once granted, should cease when
ownership changes.
John O'Leary said he is not ready to vote because he does not know
the background of this situation and requested time to study it.
He requested that the question be tabled.
Frank Rey made a motion regarding Mr. O'Leary's request and
Ray Windas seconded it; all voted in favor.
Ray Windas moved that some action be taken on,
1) the variance- does it carry over to a new owner2) items #8-10 (Items to be resolved/minutes of October 24)specifically.
Mr. Windas believes that the traffic study was done by a professional
and it should be accepted or rejected by the Board; he questions
whether or not the Env. Impact Study was done properly.
He also
wants Mr. Kahn to guarantee that parking spaces will be used only by
employees and be empty at night.
Ray Dool feels that 62-30 B-4 of the Code stipulates that both sides
work together in a harmonious relationship; he is also concerned
about parking and thinks the Zoning and Planning Boards should meet
together on this problem.
Mr. Galgano said he would request Mr. Arcate to have the members of
the Zoning Board meet with the Planning Board.
