                  <text>PLANNING BOARD meeting - May 22, 1986

Chairman Galgano called the meeting to order at 8:15 p.m. and asked
the clerk to read the public notice to all present. This public hearing
was for the purpose of approving or disapproving Armando &amp; Leda Galella's
application for subdivision of their property at 40 Depeyster Street,
North Tarrytown, New York, know as Section 16, Block 14, Lot 1.
Chairman Galgano asked if anyone present was for or against said subdivision. As no one replied in the negative, a motion to subdivide said
property was made by Mr. Rey, seconded by Mr. Dool, and was carried by a
unanimous vote.
Chairman Galgano noted a letter had been received from the County
noting "there are no issues of County or intermunicipal concern" and that
this was a decision for North Tarrytown's Planning Board. This is a new
policy on behalf of the County.
BUSINESS MEETING

Mr. Margotta noted that Mr. and Mrs. Galella's lot is large enough to
be divided. A motion to approve this subdivision was made by Mr. Rey,
seconded by Mr. Dool and carried by a unanimous vote.
The Board then turned to handling the request of Mr. Stephen Maceyak
for subdivision of his property.
Chairman Galgano said he had seen the lot being discussed. He noted
that the Planning Board has no guidelines as to cutting land and ruling on
how it is to be built upon.
Mr. Rey asked if Mr. Maceyak's plan is approved, wouldn't it be creating
non-conforming lots? Chairman Galgano noted that the front and setbacks
would all have to be approved by variances through the Zoning Board, if they
were to allow such variances .
Attorney Peirce explained that tonight's hearing was for a review of
the lot to help the Planning Board decide where lights, egresses (and other
similar decisions) are needed, as the Board would be creating two nonconforming lots if they were to approve Mr. Maceyak's request.

that at present the lot has 6,800 sq. ft. and is

500 sq. ft. short of requirements.

Mr. Margotta said that on non-conforming lots only one-family dwellings

A motion that Mr. Maceyak's preliminary plan be denied was made by
^m:. O'Leary and seconded by Mr. Rey.
Mr. Maceyak said there are other non-conforming lots in his area, and
asked if he should approach the Zoning Board. Mr. Rey noted that each lot
is approximately 20% short of required area.
Mr. Maceyak asked the Board if they had taken into consideration the
fact that some houses on his street are already like his proposed house?
Chairman Galgano reminded all that those houses were built before the Zoning
Code of 1964 went into effect.
Mr. Rey suggested expanding the present house and increase it to a twofamily dwelling.
Chairman Galgano told Mr. Maceyak he was welcomed to return, and with
an attorney if he so wished.
Chairman Galgano called a short recess at 8:30 p.m.
Chairman Galgano called the meeting back to order at 8:35 p.m. He
explained that due to lack of a Board member's presence and lack of a consensus on the next issue the rest of tonight's hearing would be postponed
until the next Board meeting.

A motion to adjourn tonight's meeting was made by Mr. Rey, seconded by
^Pb. Dool and unanimously passed.

WHEREAS, the aforesaid subdivision permits the
development of uses that are identical to those previously permitted, in that the action did not provide
for any change of zone, or approval of site plan;

and

WHEREAS, the property contains no structure or
area that is listed or eligible to be listed on the
Federal Register of Historic Places or designated by
the local Historic Architectural Review Board as an
historic landmark or district and the said subdivision
complies with all regional, state and local land use
plans;

�NOW, THEREFORE BE IT RESOLVED:
.1. The subdivision of the property as above
described is an unlisted action pursuant to Article
8 of the Environmental Conservation Law and Part 617
of the Rules and Regulations promulgated thereunder,
and will, in and of itself, not have a significant
effect on the environment, so that no Environmental
Impact Statement is required or need be filled
therefor.
2.

Nothing herein contained, however, shall

be deemed to indicate or suggest that subsequent
submissions for development of the property will
not require the preparation and filing of Environmental Impact Statements.
3.

This resolution is a Negative Declaration

for the purposes of Article 8 of the Environmental
Conservation Law, Local Law Environmental Quality
Review Act for the Village of North Tarrytown, and
will be kept on file at the Village Hall and be
available for public examination. Carried.
