                  <text>The Planning Board of the Village of North Tarrytown, met on
Wednesday, July 20, 1983, at 7:35 P.M. in the Municipal Building,
28 Beekman Avenue, North Tarrytown, N.Y.
Present:

Steven Salman, Temp. Chairman
James Galgano
Joseph Ruscigno
Frank Rey
Robert Pon^ini, Counsel

The meeting was called to order by Chairman Salman and then
read a resolution (see attached) pertaining to the request for
sub-division by Dr. &amp; Mrs. Murray Schole.
After a short discussion by the Board, Mr. Galgano moved
and seconded by Mr. Ruscigno that the resolution be adopted.
Carried unanimously.
Counsel Ponzini then advised Dr. &amp; Mrs. Schole that the
verdict of the Planning Board could be appealed, if they so desired.
Chairman Salman then read a re&amp;plution (see attached) concerning
a sub-division request by the Rockefeller family.
The property in question would be given to the State of New York
for a Public Park.
Mr. Galgano moved and seconded by Mr. Ruscigno that the motion
be adopted. Carried unanimously.
Mr. Galgano moved and seconded by Mr. Rey that the meeting be
adjourned. Carried.
Meeting adjourned at 7:55.

WHEREAS, a public hearing was held by the North Tarrytown
Planning Board on June 30th, 1983 for approval of a subdivision/partition plat entitled, "Map of Property Belonging to the Rockefeller Family, Town of Mount Pleasant and Town of Greenburgh,
Westchester County, New York, Scale 1" = 100', dated November 1,
1982 prepared by H. Stanley Johnson, Land Surveyor, 173 Lexington
Avenue, Mount Kisco, New York," and
WHEREAS, the application fee pr&amp;scribed by law was duly paid
with respect to the lots shown on the subdivision/partition plat,
and
WHEREAS, the Planning Board has discussed this matter at a
public meeting and has determined that the proposed subdivision/
partition plat is in accordance with the Village's subdivision
regulations except as may be noted below, and
WHEREAS, the public was provided with an opportunity to be
heard on said applications, and
WHEREAS, the Planning Board as Lead Agency, has received and
reviewed an environment impact statement regarding the subject
property and its long-range use, which environmental impact
statement is entitled, "Master Plan and Draft Environmental Impact
Statement, Proposed State Park, Rockefeller Property, Pocantico
Hills, New York, Executive Summary prepared for New York State
Office of Parks, REcreation and Historic Preservation, Empire
State Plaza, Agency Building 1, 17th Floor, Albany, NY 12238,
PRepared by Sasaki Associates, Inc., assisted by Cross Group, Inc.
Hartgen Archeological Associates," prepared October 1, 1982, and
WHEREAS, as a result of its review of said environmental
impact statement the Planning Board has determined that little or
no adverse impact will result from the proposed subdivision and
the Board hereby issues a negative declaration in recognition of a
major commitment of lands to permit open space, recreation and
historic preservation purposes, and

WHEREAS, in the course of its review the Planning Board h ^ s
also:
1.

Requested, received and reviewed various maps and oth-ier
supportive information from the applicant, Greenrock
Corporation, from Robert W. D. Snyder, President,
Greenrock Corporation and a multicolored map entitle&lt;23,
"Ownership of Property After Partition, Exchanges, GSLfts
and Sales," undated;

2.

Had opportunity for field trips to the property on
various occasions, or has prior independent knowledge of
the various locations;

3.

Made a determination that although extensive in natutrre,
the subdivision may be considered as a minor
subdivision;

4.

Determined as a result of the above review that all
applicable requirements of the Village Planning
Regulations have been met except as may be noted below.

NOW, THEREFORE, BE IT RESOLVED, that said application be s n d
hereby is approved subject to the following conditions, and t h ^ t
the Chairman of the Planning Board is authorized to endorse t h ^
Planning Board's approval on said plat upon compliance by the
applicant with these modifications and conditions, provided,
however, that this conditional approval shall expire six m o n t h s
from the date of this resolution if the applicant has not complied
with such modifications and conditions:
1.

Recreation: In recognition of the fact that the
applicant intends to donate approximately 747 acres c^&gt;f
land to the State of New York for the purpose of
creating a new State Park and to donate approximately 86
acres to Sleepy Hollow Restorations National
Preservation the Planning Board hereby waives any
potential requirement for recreation land or money i.xz\
lieu thereof that may presently be proscribed by law^j

2.

This subdivision is for partition purposes and is no-*
for the purpose of creating building lots except as mtay
now exist on the official map of the Village of Nortln
Tarrytown or as otherwise permitted under the Zoning
Laws of the Village of North Tarrytown;

RESOLUTION:

Subdivision, Dr. Murray L. Schole and Pauline
Schole, his wife, 487 Munroe Avenue, Section 14,
Block 16, Lot 1L.

WHEREAS, a public hearing was held by the North Tarrytown
Planning Board on June 30th, 1983 for approval for a subdivision
of the parcel known and designated on the official tax map of the
Village of North Tarrytown as Section 14, Block 16, Lot 1L, and
WHEREAS, the application fee proscribed by law was duly paid
with respect to the lot shown on the subdivision plat, and
WHEREAS, the Planning Board has discussed this matter at a
public meeting and determined that the proposed subdivision is not
in accordance with the Village's subdivision regulations, and
WHEREAS, the public and the applicants were given adequate
opportunity to be heard, and
WHEREAS, the Planning Board as Lead Agency has determined
that said subdivision would impose a negative impact upon the
surrounding environment, and
WHEREAS, as a result of its review of said negative environmental impact, the Board has determined that said subdivision is
not consistent with the master plan nor the welfare of the Village
of North Tarrytown, and
WHEREAS, (a) in the course of its review, the Planning Board
has had opportunity to make field trips to the property on various
occasions or has independent knowledge of the property as it is
situated; (b) made a determination that said subdivision is not
in compliance with the rules and regulations of the Planning Board
of the Village of North Tarrytown; (cM.ts has determined that no
building would be permitted on the adjoining subdivided lot
without a variance from the Zoning Board of Appeals of the Village
of North Tarrytown; and (d) determined that on a prior occasion
the Zoning Board of the Village of North Tarrytown has failed to
grant the variance for the development of the parcel of land into
a single-family home because of a rear lot set back violation,
and
WHEREAS, the Planning Board has had an opportunity to review
the letter of Victor R. Page, Building Inspector and Code Enforcement Officer dated April 8th, 1983, to Mr. John Arcate, Chairman,

Zoning Board of Appeals of the Village of North Tarrytown, a copy
of which is attached hereto and made a part hereof. In that
letter Mr. Page concludes that the assessment records indicate
that the lot was originally designated as one parcel of land and
has been carried on the assessment rolls as such ever since, and
WHEREAS, the Planning Board, after reviewing all of the
evidence submitted and testimony presented concludes that the
adjoining lots have been merged into one parcel.
NOW, THEREFORE, BE IT RESOLVED, that the application be and
hereby is denied for failure to comply with the rules and regulations of the Planning Board of the Village of North Tarrytown, for
its negative impact on the surrounding environment and for its
adverse effect upon the master plan of the Village of North
Tarrytown and the general welfare of its/residents.

It is highly possible the Town of Mt. Pleasant did not pick
up the subdivision properly and it is possible the Title
Search Company, in using the records of the Town of Mt.Pleasant,, arrived at the wrong conclusion.
Dr. Schole has owned this property for over twenty-five
(25) years, and suddenly discovers he is receiving a
tax bill with the improper designation of his property.
In my opinion, the variance should not be granted.
