REQUEST FOR SUBDIVISION BY MR. &amp; MRS. EDWARD GUANERI

Present:

Meeting opened at 8 p.m. by James Galgano; Public Notice was read.
Mr. Galgano advised those attending the Public Hearing that everyone
would be allowed to make comments at this point, for or against the
requested subdivision.
Frank Rey spoke first and questioned Mr, &amp; Mrs. Guaneri as to whether
or not their request for a subdivision was different from their first
request. He was informed by them that it was not different from their
request of 1981.
Mr. Pat Shafer, 124 Hunter Ave., questioned the acreage necessary for
a subdivision. He was informed that 10,000 sq. ft. were necessary.
He also questioned whether or not the property line is two feet from the
curb. Mr. Galgano told him that in different areas of the Village,
property lines are different; there doesn't seem to be a definite
regulation regarding the distance from the curb that would be the
property line.
Roman Windas advised that there are sidewalk regulations which allow
residents to put a sidewalk within five feet of the curb.
Mr. Shafer feels that this lot is very small and he does not think a
house would fit on this lot, if subdivided (based on the type of
houses that are found in this residential area). He also feels a
house on this lot would be too close to heavy traffic.
Roman Windas questioned the Planning about a letter from Mr. &amp; Mrs.
Guaneri dated March 13, 1981 requesting information regarding their
apnlication for a subdivision; he feels the Planning Board should take
another look at this letter.
After considerable discussion, it was decided that the property in
question is large enough to be subdivided, The property consists of
20,000 square feet.
Mr. Ponzini pointed out that the property which once belonged to the
school and is now a part of Guaneri's property should be shown on the
deed and there should be a copy of this in the Assessor's Office. The
question arose as to when the property originally owned by the School,
became a part of the property now in question.
Mr. Windas pointed out that the Guaneri's deed should be the same as
that in the Village record and if there is a discrepancy, the owner
should correct it. The transer of ownership of the piece of property

�from the School to the owner of the property in question does not appear
on Village records. Mrs. Guaneri advised that her deed is correct.
The Guaneris were questioned as to how much land the building on lot #1
covers (present structure on property). The Village has no record of the
size of this structure. Mr. Galgano advised the owner that the Village
must have this information and questioned them as to whether or not they
plan on building a house on lot #2 and selling it. The Guaneris said
they do plan on building on the lot and living in the house.
There was a lengthy discussion regarding the required footage behind the
house on lot #1; it should be 25 feet, extending from the rear of the
porch on the back of the house to the back property line, with a 10 ft.
minimum on one side and a total of 25 feet on both sides.
Mr. Shafer said that if the proposed subdivision and proposed structure
are not illegal, he has no objection to the plans.
The matter will be tabled for further investigation and until the
Village has sufficient information.
The meeting was recessed
and seconded by Mr. Rey.
