1*
Regular meetings of the Board of Appeals shall be held in
the office of said BoaxfiLin the Corporation Rooms of the Village, or
such othernplace in (forth1 Tarrytown, H. Y* as may he designated, on
the third }§&amp;m$ of each month at'8so'clock P* M, Other meetings of
said Board may be held by adjournment from a regular meeting, or at?
the call of thte Chairman or at such time© as the Board may determine*
Written notice of the time and place of meetings, of the Board shall
he served by the clerk upon all members of the Board of Appeals by
mailing the same to, or leaving the same at, the residence or place of
business of each member, at least 48 hours before the time of such
meeting*

All.meetings and hearings of the Board of Appeals shall be
open to the public,

The Board of Appeals shall keep minutes of its proceedings,
the minutes fchall show the vote of each w&amp;m"bQX upon every question, ox
if absent or failing to vote, indicating such fact, and shall also keep
records of its examinations and other official actions*.

At all meetings of the Board of Appeals, three members
shall constitute a quorum, and the concurring vote of three members
of the Board of the Board of Appeala, or of such other number of such
members as the Village Law dhsll g$om time to time prescribe, shall
be necessary to reverse any order, requirement, decision or'determination -of- the Building Inspector, or of any administrative official
charged with the enforcement of the Village of (Hortfe Tarrytown zoning Ordinance or of any ordinance adopted pursuant^co the provisions
of the act under which said Zoning Ordinance was adopted, or to
decide in favor of the applicant any matter uponwhich it is required
to pass under any shch ordinance or to effect any variation in --such
ordinance. Such appeal may be taken by any person aggreived, or by
an officer, department board or bureau of the Village*

$o member of the Board of Appeals shall proceed to debate,
discuss an issue, put ir» motion, or offer a resolution until he shall
have addressed the Chairman and have been recognised hy him* The
Chairman, subject to these rules, shall decide all points of order or
procidure unless otherwise dlreeted by a majority of the Board in
session at that time*

as in Rule 5 hereof described, must be taken within twenty
days from the date of such order, requirement, decision or
determination, unless such twenty day period he extended in
writing noted on the records of the Board of Appeals by the
Board of Appeals or by its Chairman 9 By filing a notice of
such appeal, specifying the grounds thereof, with the Building Inspectoror other such administrative official from wh#m
the appeal is taken, and with the Clerk of the Board of Appeals.

All notices of appeal and applications for variances
from the terms of said Zoning Ordinance, specifying the grounds
thereof and stating the address of the appellant or applicant,
shall be signed by the appellant or applicant and in the form
approved by the Board of Appeals, copies of which may be procured from the Clerk of the Board* In addition to filing of
a copy of such notice of appeal or application with the Building Inspector, or other administrative official as in Rule 5
hereof described, five copies shall be filled with the Clerk of
the Beard* four copies shall b# for-the use of the Board, and
the other copy shall be retained by the Clerk as a part of the
redords of the Board. The officer from whom the appeal is taken
shall forthwith transmit to the Board of Appeals all the papers
constituting the record upon which the action appealed is taken*

Notice of the time and place of any hearing on any such
appeal or application, which time and place shall be fixed by the
Board of Appeals or by the Chairman of the Board, shall be given
by the Clerk by mailing to or personall serving the same upon
the appellant or applicant and by personally servingthe same upon
the Building Inspector, or other administrative officialas in
Rule 5 hereof described, at least ten days before the date of
such hearing. If mailed, such notice shall be addressed and
directed to the appellant or applicant at his address as stated
in said notice of appeal* Such notice shall also be published
at least once, not less than eight days before said hearing in
the official newspaper of the Village of North Tarry town and in
any other newspaper or newspapers circulating in the Village of
North Tarry town if anjt as designated from time to time by the
Board of Appeals*
Hotice of the time and place of any hearing on any such
appeal* or application, may be waived in writing by the appellant or applicant, in lieu of service of such notice upon such
appellant, or applicant, as herein have been provided*

Upon any hearing any party may appear in person or
by agent or attorney, and any property owners affected and any
person aggrieved by the order, requirement, decision or determination (5r the Building Inspector, or other administrative
official as in Rule 5 hereof described, may appear in person
or by agent or attorney and present any objections to the allowance of the appeal or application or reasons for the reversal
or affirmanoe, wholly or partly or the modification of the

Sither party to an appeal or application may produce witnesses
and have them sworn. The Clerk of the Board of Appeals shall
make or cause to be made a record of the testimony of such witnesses*

The Chairman or, in his absence, the acting Chairman, may administer oaths and compel the attendance of witnesses*
Personal serviee of a copy of a subpoena, both the original and
any copy of which shall be signed by the chairman or acting Chairman of the Board, shell be mad© at least two days before the time
of the hearing upon any witness whose attendance at such hearing
of the Board of Appeals is sought to be compelled.

Subject to any existing provisions of law, payments
for proper expenses of the Board of Appeals fron funds which
havejfegen appropriated by the Board of Trustees of the Village
of/fe&amp;M&gt; Tarrytown shall be mad© by the Treasurer of the Village
ofClorth) Tarrytown on approval by the Board of Appeals at any
meeting at which a quorum is present and upon confirmation by
the Board of Trustees, and requisitions for such payments shall
be signed by the Chairman or Acting Chairman of the Board of Appeals*

All notioes of appeal, applications and other papers
issuid by or submitted to the Board
of Appeals shall be^fcniformly

and shall"ribe typewritten* $here are excetped, however, from the
operation of this rule such of the papers constituting the record
upon which the action appealed from is taken as in their original
form are of a size different from that hereinabove in this rule
prescribed*

subject to any provisions of the Statues of the State
of Hew York, the Board of Appeals shall have authority, upon the
concurring vote of a majority of the entire number of members
of the Board at any meeting at which a quorum is present, to
promulgate, adopt and from time to time to amend or modify forms
or papers to be used by the Building Inspector or the Board of
Appeals in connection with the enforcement of said Zoning Ordinance
or of any ordinance adopted pursuant to the provisions of the act
under which said Zoning Ordinance was adopted, and any rules, regulations or directions which may appear upon any such forms or
papers so promulgated and adopted shall be a part of the rules ad
regulations of the Board of Appeals as though such rules and regulations had been incorporated herein*
15.
Any one of these aules or any part of a rule, except
provisions of the statutes of the State of New York, may be
amended, repealed, modify, suspended or waived, and any new rule
may be adopted, by the affirmative vote of a majority of the
entire number of members of the Board of Appeals at any meeting
at which a quorum is present*
16.
The Building Inspector shall, on or before the 10th
day of each month make and file with the clerk of the Board of
Appeals and with the Chairman a written report setting forth in
detail all building permits appliedfor, issued or fefused together
with a detail statement of his examinations and other activities
as Building Inspector and any recommendations or suggestions he
may desire to submit to the Board and he shall attend all meetings
of the Board of Appeals*

of July, 1929.

Mr, Morse called the Meeting to order at 8:25 P. M,
The secretary read the minutes of the previous meeting.
The same were approved as read.
Mr. Minnerly, the building inspector, filed his report
with the secretary, up to and including July 17.
Letter received from the Sleepy Hollow Manor Inc. under
date of July 15, 1929 was turned over to the secretary by the
building inspector, Mr. Minnerly.

This letter referred to the

Community Center Building now being erected in Sleepy Hollow
Manor and as the Zoning Ordinance provides that in residence
District "A" there may be erected community buildings, club
house, &amp; c , providing there is filed with the Board of Appeals,
and a duplicate copy thereof with the building inspector, an
approved application of 30% by footage of the property owners
within the district and within 1500 feet of the location of
the community building.

Mr. Morse inquired from Mr. Minnerly about building permits
that he was obliged to refuse to issue and Mr. Minnerly stated
that it had not been necessary for him to refuse any.

Mr, Morse reported the receipt of a letter from Mr,
Knauer of the Parley Organization re Minnick property on
Hunter Avenue and his reply to them.

Letter filed with

the secretary*
Building inspector, Mr. Minnerly, presented the forms
now being used for the issuance of permits and posters and
Mr. Morse suggested that they be dated when issued and the
expiration date of same added thereto.
The matter regarding the expiration date of building
permits was generally discussed by members of the board and
it was suggested that a rubber stamp be used on all permits
with the expiration date on same.
There being no further business before the meeting,
the same was adjourned at 9 P. M, to meet again on Tuesday
September 3, 1929.

Gentlemen:
I am writing in oonneotion with the proposed
building of a house in Phllipse Manor. (North side of
Hunter Ave- directly aoffees from Mr. B.O.Warren and
just east of the Allenburg house.)
About a year ago I tools: up the question of
parage setback with Mr. Minnerly and received a reply
which practically quoted the zoning ordinance, hut
which did not cover the peculiar topographical situation or otter any practical solution. I now understand
that your specific consent is necessary.to permit of
our building according to plans which meet the situation
that exists.
Whether a garage were at the hack of the lot
or attached to the house (30 feet hack) it would he
necessary to out out a drive which would he much deeper
than Mr.Warrens. It would he an additional hazzard for
children; it would he a problem when there was much
snow; and it would he difficult if not impossible to
make it sl#ktly.
The most practical and best appearing solution
that has been suggested to me is that of making the
garage doors flush with the bank .working it in with the
natural stone and using overhead disappearing doors.
Access to the house might be made from the rear of the
garage or it might be lndependant of the house entirely*
Your prompt consideration of this proposal
will be appreciated as I may desire to oommencej operations
there at an early date.
