                  <text>Minutes of the Regular meeting of the
Zoning Board of Appeals of the Village
of North Tarrytown held at the Corporation Rooms in the Village of North
Tarrytown on the 17th day of September,
1930.
present:
Gerald B. Gould, Chairman
William C. Schmidt
John K. Mullon
David Page, Jr.
John J. Lofaro, Secretary.
Mr. Gould called the meeting to order at 8s25 P.M.
The Secretary read the minutes of a regular meeting of the Board
held on July 24, 1929, and the minutes of the organization meeting held
on September, 11th, 1930. Tn© same inrere approved das read.
A letter

recieved from H.D. Minich under date of September 14,

1930, was read and acted upon by the Board.

On motion of Mr. Lofaro

and seconded by M r . page it was resolved that the Secrefc&amp;ry be instructed
to answer said letter as follows:

It is clear from the rough sketches which you enclosed
that permission to carry out the plan would require a
variation in the set back building line as provided in the
Zoning Law.
We are enclosing a printed copy of the Zoning Ordinance
and call your attention to Section 12 Paragraph H4, which will
be found at the top of page 20 and which provides that any
variation in the set back can only be made upon due hearing.
The Board feels that this particular situation requires
careful study of the further development of the entire block
and is not prepared at the present time to call a public
hearing on this specific case on its own motion. "

On motfcoa of Mr. Schmidt and seconded by Mr. Mullon, the Secretary
was instructed to write to the Philips Manor Improvement Association,
Mr. Howard Beebe, Secretary, Harrington Avenue, the following letter:

The Zoning Board of Appeals is giving consideration to
the possibility of varying the set back regulation as they
may apply to parts of Hunter Avenue where unusual topographical
conditions seem to possibly may make compliance with Zoning

�Ordinance impossible* We would suggest that the proper
committee of your association give this matter your
consideration and we will welcome from you any suggestions you have along this line, bearing in mind, of
course, the importance of maintaining the standards
of appearance that prevail In that section.
The next regular meeting of this Board will be held
on Wednesday, October 15, 1930, and an expression of
your views will be greatly appreciated. ,f
The next matter before the Board was the question of the rights
of an owner of vacant property In a Residence A Zone to store second
hand building material on premises in such a manner as to make the
premises unsightly.

It was unanimously decided that the Board had

no jurisdiction In the matter and that the same be referred to the
Police Department on the grounds of nuisance*
On motion of Mr. Mullon and seconded by Mr. Page,!therSecretary
was instructed to write a letter to the Building Inspector, as follows:
"
We call your attention to an apparent violation
of Section 4 Paragrph 9 of the Zoning Ordinance, by
one Mr. John Sprince of 59 Howard Street, In maintaining a business and displaying a business sign in
Residence B Zone.
We wish that you take up this matter and report
to this Board at our next regular meeting on October
15th, 1930.
We also call attention to the tool house or shed
on Merlin Avenue which has been erected at that point
and maintained there for the past six months without
building construction. ff
Mr. Gould turned over to the Secretary a letter received from the
Board of Trustees under date of Amg&amp;st 15, 1929, relative to the filing
cabinet for plans for the Building Inspector and directed thet Secretary
to call the Building Inspector's attention to the fact that the Board
of Trustees authorized the purchase of said cabinet and awaits the
receipt of advice from the Building Inspector as to just what he requires*
Mr. Gould instructed the Secretary to wftfcte to the Board of Trustees
the following letter:

Board of Trustees have necessary slips printed
and Inserted in the Zoning Ordinance.
We also call attention to the fact that
Section 12 A has never been amended to comply
with term with regard to initial appointment of
members of the Board of Appeals. w
There being no further business before the Board, meeting was
[adjourned at 11 P.M. to meet again on Wednesday, October 15, 1930.

Dear Sirs
This will acknowledge and thank you for your
letter of September 24th*
I quite agree that the situation requires
careful study and I most certainly do not want to propose
anything that would not be an acknowledged improvement*
Of course, I feel that already I have taken into consideration the general interest, as well as my own, but I should
much prefer to have my judgment carefully checked "before
anything is done*
Tour letter however leaves me in doubt as to
how to proceed as regards the public hearing*
I infer
that a petition may be presented but I do not know whether
this would be advisable if you are already planning to take
up the question as a matter of routine*
The only difficulty is that I had in mind
beginning construction as soon as these matters oould be
straightened out and it of course has a direct bearing on
procedure and resulting bids which I should like to secure
as soon as possible*
In faot I had hoped to have these
preliminaries out of the way so that I oould complete arrangements next week*
