                  <text>Minutes of the Special Meeting of the
Zoning Board of Appeals of the Village
of North Tarrytown, held at the Corporation Rooms in the Village of North
Tarrytown on the 28th day of January,
1931.
Present:
Gerald B. Gould, Chairman
William C. Schmidt
John K. Mullon
David Page, Jr.
John J, Lofaro, Secretary.
Mr. Gould called the meeting to order at 8:15 P.M.
The minutes of the Regular meeting of the Board held on the
21st day of January, 1931, were read and approved.

A letter was received from the Village Clerk of North Tarrytown,
which letter bore date the 28th day of January, 1930, requesting
this Board, to investigate the matter relative to whether the
conducting of a Kindergarten or school where money is paid for the
tuition obtained would be a violation of the Village Zoning
Ordinance when such school is being conducted in a district zoned
as Residence B"
That pursuant to said request Mr. Gould telephoned Rev.
Howard D. White to appear before this Board and set forth all the
facts before us. Heir. White appeared before this Board and stated
that he has an enrollment of 32 children all of whom are under
public school age. That at the present time the attendance is
extremely small due to the fact that there is so much illness.
That the school has been in existence since 1908.

spacious and well ventilated and is completely equipped with chairs
and tables.

That instead of the project being a money making

proposition is a loss to Rev. White.

That during all the years of

the schools existence there has never been any complaints made
excepting the one made by Trustee John F. Carney.
On motion made and seconded and passed it was resolved that
the Secretary be instructed to write to the Board of Trustees
relative the findings of this Board with^regard toithe matter
referred to this Board by the abovementioned letter of January
28th, 1931. By a unanimous decision it was resolved that since
the school,operated by Rev. Howard D. Whlte,has been in existence
sinee 1908, which is 18 years prior to the passage of the Zoning
Ordinance, it is a non-conforming use under Section 7 of the
Zoning Law.
On motion of Mr. Mullon and seconded by Mr. Page and carried
it was resolved that the Secretary be instructed to write the
Board of trustees to have 5Q0 copies of forms for the Monthly
report of the Building Inspector printed pursuant to a copy or
draft prepared by the Secretary.
On Motion meeting adjourned to meet again on March 27th,1931.

Mr» White informed us that the kindergarten school which
is now being conducted by him has been In existence sin» the

Zoning Ordinance• $his seems £© be a non-conforming use
under Action 7 of the Zoning Law* Mr» Whit« further understood
that there was never any complaint registered during all this
time.
