Oerald B. Gould, Chairman* called the meeting to order at
8:20 P.M.
The minutes of the Regular meeting of the Board held on the
27th day of March, 19JS1, were read and approved.
The Chairman called to the attention of the Secretary that
hereafter the presence of the Building Inspector should be noted
in the minutes of the meeting.
The Building Inspector submitted his report from March 30th
to April 14f 1931 and the same was received and placed on file.
There being no further business to transact, the meeting
was adjourned At 8:35 P.M. to meet again on May 20th, 1931.

Gentlemen*
On "behalf of Sleepy Hollow Manor, Inc., owners of a two story atone
dwelling erected at No* 50 Hemlock Drive, North Tarrytown, N.Y,, on lot 5 in
block 1-A and section 11, which is also known as lot 5 in "block 3 on the revised
map of Sleepy Hollow Manor filed in the office of the Begister of the County of
Westchester on June 23rd, 1930 as map No* 36£1, I wish hereby to apply for a
variation of the provisions of the Zoning Ordinance of the Village of North
Tarrytown with respect to the front line setbacks required in an "A" Residence
District*
IJhe provisions of the Zoning Ordinance require that "buildings within
this district "be set "back 30 feet from the line of the street upon which they face.
According to a survey made September 20th, 1928 "by Denehy &amp; Clarke, Civil Engineers,
8 Church Street, White Plains, N.Y., this "building set3 "back from the line of
Hemlock Drive 28.95 ft. at its southeasterly corner and 27.48 ft, at the southwesterly corner. A survey made under date of April 24th, 1931 "by Ward Carpenter
Engineers, Inc., also of White Plains, confirms the facts shown "by the previous
survey with the exception of fractional differences in the setback measurements.
This "building is a one-family stone veneer residence, two stories in
height. Its construction was commenced in lay, 1928, at a time when the finished
roads in Sleepy Hollow Manor had not "been constructed and when the lines of the
said streets had not "been as completely staked and monumented as they now are. A
survey made "by our own engineering department, from which the "building was staked
out for construction, shows that its foundation lines were staked 30 ft, "back of
the street line. The fact that the "building was erected nearer the street may "be
due to any one of several possible causes, or a combination of the same. It is
possible that the street lines in existence at that time, "before the pavement had
heen laid out, were in error at this point. It is possible also that the stakes
were shifted accidentally, or otherwise, "by one of the contractors, or contractors'
employees, engaged in construction. It is possible also that the stakes were removed
in error and that in endeavoring to replace them the contractors measured the
lineal distance up the steep slope on which the house stands instead of measuring
the accurate horizontal distance from the street line*
Another possibility of error lies in the fact that the road at this
Point is on a decided curve which might have "been overlooked at the time the house

»a laid out "because of the unfinished nature of itie streets. In that case setback lines, measured along the side lines of the plot, would "be considerably shortQ
r from the center of the plot where the house is actually located.

The M%®%x&amp;&amp;*t delay in "bringing the matter to the attention of your
orabie Board is due to the fact that we had no knowledge of the apparent
• olation until the recent survey was made in connection with a contract for
?he 1928 survey was made for a title company and we
+ie sale of the property,
It was naturally assumed, when they insured the title,
v e r saw a oopy of it.
•nat n° conditions existed that were contrary to any law or regulation.
In requesting your Honorable Board to grant a variation from the setl3?cle requirements in this particular case, we submit the following facts8
1, The projection "beyond the setback requirements varies only from
1,05 ft* to 2,52 ft*, which projection is so slight as to he unnoticeable and
affects in no way the character of the section, or the rights or interests of
adjoining property owners. In fact, the projection is so slight as to "be in no
way apparent or objectionable,
2, The slightnesa of the encroachment is further emphasized "by the
location of the "building on a high hank considerably above the level of the street,
and "by the additional 13 ft. of setback between the edge of the road pavement and
the front line of the plot*
3, .To correct the existing condition and make the building conform to
the strict ^wfiTof the Zoning Ordinance would involve its complete demolition since
the only other alternative would be alteration work of a nature that would be prohibitively expensive and would ruin the value of the "building for residence purposes
We, therefore, respectfully submit to your Honorable Board our request for
a variation in the setback requirements of the zoning law that will permit the continuance of the above building in its present site and permit iteuse as a private
residence on the ground that every effort was made in good faith to comply with the
provisions of the Zoning Ordinance and that the present building is in no way detri
mental to, or in conflict with the character of the "A" Hesidence District in which
it is located, and that its present appearance and location are in harmony and keeping with the intent of the law in establishing such a Hesidence District. Your
consideration is requested on the further ground that compliance with the law would
involve unreasonable and unnecessary hardship on the part of the owners of the
property*
