Minutes of the egular Meeting
of the Zoning Board of Appeals
of the Village of North Tarrytown
N. X. held at the Corporation
Rooms in said Village on the 29th
day of July 1931

Present:
Gerald B. Gould, Ghairman

John J. Lofaro, Secretary

Mr. Gould called the meeting to order at 8:20 P.M.
Tfte minutes of the regular meeting of July 15,1931
were read and approved,
Mr* Morse appeared before the B oard in opposition
to the application of Edward Manton for a variation of the
side line regulation*

He stated that he understood since

the last meeting Mr. Manton revised the plans and is now
building according to the proper side line set back. Mr.
Morse talked about the general powers of the Board.

He

said that the purpose* of the Zoning Ordinance is to Stabilize the character of the buildings in the various districts*

There may arise however, circumstances wher e the

topography is such that a variance is necessary.

In all

cases he said no variance should be allowed unless of undue hardship to the owner. Fifty foot lots on Broadway
were no different than other lots in the Manor.

He said

that every member of the Pftilipse Manor Improvement As so*
elation objected to Mr. Mantons' Application.

People in

Philipse Manor want their properties protected not only be
the deed restrictions but also by the Zoning Ordinance.

He said that those who purchase property know ot* should
know the provisions of the Zoning Ordinance.
Mr. Green, secretary of the Philipse Manor Improvement
Association addressed the Board and said that at an Executive
Meeting £0 said Association duly held opposition to Mr. Mantons'
Application was registered.
Mr. Lofaro informed the Board that Mr. Minnerly, the
Building Inspector, notified him that Mr Manton revised the
plans of his building and that a Building Permit was issued by
him to Mr. Manton.
Mr. Lofaro then moved that the application of Mr. Manton
for a variation be denied.

The said motion was duly seconded

and the Board thereupon unanimously denied same.
^Mr* Anthony Tornello appeared before the Board and
stated that he desired to conduct a fruit and chichken market
on premises known as 20 Cedar St. Residence B Zone. He told
the Board that from 1919 to 1925 a fruit business and Chicken
market was conducted on said Premises by the Italian-American
Transportation Company of which he is one of its officers.
He further said that from 1925 to date the said Company has
been conducting a garage business on said premises.
Mr. ^ould was of the opinion that a mere change in
business does not terminate a non-conforming use and that
therefore a continuation 0£ business on said premises would
not be deemed a violation of the Zoning Ordinance.

The mem-

bers of the Board agreed in this contention and told Mr.
Tornello that no application was necessary.^

Mr» Sinnotts' letter bearing date July 28,1951 was read.
There being other points of law in which the Board wanted more
elucidation, the Secretary was instruet&amp;d to ask Mr, Sinnot
to be present at its next meeting.

Gentlemen:On behalf of the following real property owners
on Cedar St., in the Village of North Tarrytown:joseph Chessari, 11 Cedar St., Joseph Martone, 2I4. Cedar St.,
Frank Zingaro, 8 Cedar St., Clinton Scott, 10 Cedar St.,
G. Siracusa, 15 Cedar St., and many other real property owners on said street who I shall produce, I hereby make complaint against one, Tony Tornello, owner of premises known
as #20 Cedar St., North Tarrytown, N. Y» for violating the
Zoning Ordinance of the Village of North Tarrytown, Sec. 1^,
subdivision (5)&gt; Sec. 5&gt; subdivision (b); Sec. 7&gt; subdivision (a) and (b); Sec. 12, subdivision (h); in that said
Tornello has obtained a variance without proper hearing for
the objections of his neighbors and has even gone so far as
to do the same without a permit.
I have been informed that at the last hearing of
the Zoning Board of Appeals, Mr. Tornello presented evidence
that he had a non-conforming use for the purpose of the storage of trucks as existing before the passage of the Zoning
Ordinance.
On that evidence, the Zoning Board of Appeals granted him, so I have been informed, permission to construct a'
chicken house and conduct the business of a chicken market.
My contention is that under Sec. 1 , subdivision
(a) and (b) and pursuant to provisions of Sec. 12, subdivision
(h) that your Board has permitted Mr. Tornello an extension
of a non-conforming use without due notice and that the same
has been granted without observing the provisions of Sec. 12,
subdivision (h) regarding a public hearing on due notice. I
further contend and I shall prove this by affidavits that Mr.
Tornello1s non-conforming use ceased to exist many years ago
and that under Sec. 7, subdivision (a), he has not even the
right to utilize his property for the purpose of a public
storage.
May I, therefor, respectfully request the Zoning
Board of Appeals to notify (1) the Building Inspector to
stop the said use on Tornello1s property and order Tornello
to take down the sign which he has put up in front of said
property (2) notify Mr. Tornello of my objection and to make
application for a variance so that the neighbors whose rights

May I not inquire of the Zoning Board of Appeals whether or not the operation of a chicken house with its terrific
odor and smell is really not an industrial use and cannot be

The building inspector, in whieh fee alleges that I have
violated Section 4 of Beftidenfc B District in that I am about
to conduct business on premises I 9 tedar Street .1 e.onduerbed

I wish to appeal to your HONORABLE BOARD from the

My dear Mr. Lofaro:
Your letter of the 24th Instant addressed to
The Railroad Co-Operative Building and Loan Association
was handed to us for reply•
The Association held a mortgage on this property which it was obliged to foreclose as there were no
bidders at the sale and became the owner thereof. The
former owner, Mr. Bass, obtained a building permit in
1928 permitting him to erect this house, which was formerly a boarding house. We are informed that the
residents of Philips Manor were very much gratified at
the change from a boarding house to a high-class apartment.
It.would be impossible for the Association to
re-convert this property, and if it could, it would not
be worth the cost of the labor.
In view of the fact that the Association is
in the position of an innocent purchaser and the further
fact that the Village Issued a permit authorizing the
construction of this building which permit, by the way,
was obtained at the instance of a Mr. Charles Morosco,
one of your leading citizens, we are very much of the
opinion that no court would enforce the local ordinance
against The Railroad Co-Operative Building and Loan
Association.
If you are in the City we should be very glad
to talk the matter over with you at any time.
