the Zoning Board of Appeals of the
Village of North Tarrytown, N.Y.
held at the Corporation Rooms in
said Village on the 13th day of
August, 1931.

Mr. Gould called the meeting to order at 8:15 P.M.
The minutes of the Regular Meeting of July 29th, 1931, were
read and approved.
The Building Inspector's report bearing date August 1, 1931,
was read and placed on file.
The Building Inspector's letter to Mr. Anthony Tornello
dated August 1, 1931, and letter of Sante J. Chessari under date of
August 5th, 1931,were respectively read.
Mr. Gould then stated that the purpose of this meeting was
to consider Mr. Tornello's matter and any other matter which may
come up at this time before the Board. After hearing Mr. Tornello
and Sante J. Chessari and after reading the sworn affidavits of
Joseph Martone, Joseph Chessari and A ngelo De Natale and a letter
of George Parthemore, the Board informed Mr. Tornello to submit an
appeal from the Building Inspectors decision. Upon motion of Mr.
Lofaro duly made and seconded it was resolved that a public hearing
be called on Tuesday, August 25, 1931, and further resolved that
the Building Inspector enjoin Mr. Tornello

from utilizing premises

involved £©r business purposes until the final determination of the

natter by the Board. Mr. Tornello then presented an instrument
dated August 13, 1931, soft signed by the owner of the premises
and by a number of the residents of Cedar Street and submitted
same to the Board as an Appeal from the Building Inspector's
decision.
M document dated A ugust 13th, 1931, signed by Mr. Giuseppe
Russo and by a number of residents of Cedar Street was next read.
It purported to be an application of Mr. Russo to this Board asking
permission to establish a Grocery Store on premises known as
number 19 Cedar Street. A fter due deliberation it was unanimously
agreed that the application be denied on the grounds that this
Board has no jurisdiction in the matter and the Secretary was
therefore instructed to write to Mr. Russo and notify him of its
decision. fr
The letter of Crandall, Grant and Williams, Ssgs. dated
August 6th, 1931, in reply to the letter of this Board directed to
the Railroad Building and Loan Association, owner of premises in
Philips Manor known as "Red Gables" was next read and acted upon.
In connection with this matter, the Building Inspector submitted
his report which was read. The Board was of the opinion that the
matter should be reffered to the Board of Trustees for further
action and on motion duly Aade by Mr. Schmidtt, the Secretary was
instructed to appear before the Board of Trustees on Friday evening
August 14th, 1931,
There being no further business to transact the meeting was
adjourned at 10 o'clock P.M. to meet again^n August 25tht 1951.

In the year of 1912 Mr. Tornello had rented my place
at 19 €edar Street. To run his business of General Contracting
In 1916 he ws^sdoing a rushing business that* he had to hire
the property at 20 ®edar Street. ffhich is just across the way
from my property.Than he started the transportion business,
which he has controlled for a number of years.
He than sold out the business,to a man.And theft man
could not carry it thru. So Mr.Tornello took the place and
rented it for a garage repair shop and storage place.Up as far as
July if£932..

The meaning of the word "use" i s not confined to
describing the act of using, but may also be employed to
describe that property of a thing which renders i t suitable
for a purpose.

I t seems to me that i t i s in t h i s l a t t e r

meaning that the word "use" i s employed in section 6 of
the r e s o l u t i o n .
The use of a building designed and constructed for
business i s for business, and i t s use for business exists
where the plan of the building i s not s t r u c t u r a l l y changed,
although i t may be actually occupied as a dwelling.

In

such a case the building remains available for business
notwithstanding i t s temporary use for a purpose for which
i t was not designed.
The p l a s t e r - b o a r d p a r t i t i o n i n g of the second floor
of r e a l t o r ' s building was temporary in i t s character, and
i t was constructed so as to admit of i t s easy removal.
The inherent plan and s t r u c t u r e of the second floor was
not a l t e r e d , and i t s a v a i l a b i l i t y for business remained.
The floor could be readily rendered available for business
purposes without s t r u c t u r a l changes in the building by
siftiply knocking down the l i g h t p a r t i t i o n s .
