Y., held at the Club Rooms of the Res2? e 52!? ComPany in said Village on the 28th day of August, 1931. Present Gerald B. Gould, Chairman William C. Schmidt David Page, Jr. John K. Million John J. Lofaro, Secretary John J. Sinnott, Corporation Counsel Ma?. Gould ©ailed the meeting to order at 8:50 P. M. He stated that the purpose of this meeting was to go over the testimony taken at the public hearing held on August 25, 1951 on the matter of the appeal of Carmela Tornello and to render a decision affirming or denying the Building Inspector's order therein. Mr. Lofaro asked Mr* Sinnott if Mr. Tomello presented to him any books, records or memoranda, which would show the length of time Mr. Tomello used the premises in question r for business. Mr. Sinnott informed the Board that Mr. Tornello did exhibit such books, but were in rather a crude form. He said that Mr. Tomello had no books or records to show the operation of a Garage either prior to the enactment of the Zoning Ordinance or since. That the last entry made in the records so exhibited was about 1926 and that from 1926 to date no record of any business transaction was kept. Mr. Schmidt then went into detail as to the continuity ot business conducted on the premises in question. He was of the opinion that the testimony showed such continuity of use up to #B&y 1, 1951. He there- upon moved that "It is the opinion of the Board that prior to the enactment of the Zoning Ordinance and up to July, 1931, the premises known as #20 Cedar Street, were used as a garage, repair storage business and that such business should be permitted to continue and be conducted thereon". The said motion was duly seconded by Mr. Lofaro and the Board unanimously carried same. Mr. Gould asked Mr. Sinnott for a legal definition of the word "use" as used in the Zoning Ordinance. He said that the next question to decide was whether or not the use of the premises, as garage, repair and storage business, could be changed to any other business or use. MT* Sinnott was of the opinion that the term "Use" as applied to business does not limit it to a particular kind of %( business and that one business may be substituted for another provided it does not come within a prohibited business under the meaning and intent of the Zoning Ordinance* Mr* Lofaro moved that the Board accept Mr. Sinnott»s definition of the word "use" and further moved that "It is the opinion of the Board that the premises known as #20 Cedar Street may be used for any business excepting those which would be prohibited by the Zoning Ordinance"* The said motion was duly seconded by Mr. Mullon and unanimously carried* The next question taken up by the Board was whether or not the conducting of a live poultry business was one prohibited by the Zoning Ordinance. I j �business and noxious and offensive and would endanger the health of the people In the neighborhood, Mr. Mullon said that such a business would be offensive to the senses and render the enjoyment of life and property uncomfortable. The Board then considered the character of the particular neighborhood. Mr. Schmidt said that he made an inspection of the neighborhood and within fifty feet of the premises in question there is an apartment house and that in the entire block he saw but one and two family residences. Mr. Page told the Board that Mr. Tornello could not obtain a permit to allow him to connect the sewer in the existing building with the Village sewer as the Sanitary Code of the Village prohibits the connection of same and that the disposal of the refuse and remains of the slaughtered chicken must be kept on the premises. He said that the odors would be very offensive* Mr. Tornello told the Board that at the present time there were two live poultry markets in the Village and that one of them was being conducted in a store over which there resides, twelve families. Mr* Chessari, Attorney for the owners of premises in opposition to the live poultry market, submitted to the Board a brief on the law regarding change in use and on the obnoaciousness of such a business. The Board read the said brief and felt that the remarks of Mr. Chessari were well taken* After considerable discussion on the question, the Board felt that if it had the power to compel the proprietors of the two such businesses to discontinue the operation of same it would do.so. Mr, Schmidt them moved that the conducting of business of slaughtering, killing and dressing of poultry on premises known as #20 Cedar Street be prohibited as being obnoxious and detrimental to the residential character of the district* The motion was seconded by Mr. Mullon and the vote of the Board was as follows; Mr. Mr. Mr. Mr. B8r# Page - Aye Muilon - Aye Schmidt - Aye Lofaro - Aye Gould - Aye Mr. Lofaro then moved that the Building Inspector's decision denying the right of Garmela Tornello to permit a live poultry business to be conducted on premises #20 Cedar Street be affirmed. The said motion was seconded by Mr. Page and unanimously carried. There being no further business to transact, Mr. Lofaro moved to adjourn to September 15, 1951.
