At a Regular Meeting of

David Page, Jr.
John J. Lofaro, Secretary
Mr. Gould called the meeting to order at 8:10 o*clock
P. M.
The minutes of the regular meeting held on November 18th,
1931 were read and approved.
The Building Inspector's report dated November 28th, 1951
was read and ordered to be placed on,file.
In connection with the Building Inspector's report, the
Board noted that the Standard Oil Company of New York was
granted a Building Permit No. 388 on November 17th, 1931,
affecting property on the Northwest corner"of Broadway and
Depeyster Street. Inasmuch as no official change of the
District from Residence to Business was brought to the attention of Board of Appeals by the Board of Trustees, a motion
was made by Mr. Mullon and duly seconded, to instruct the
Secretary to write to the Board of Trustees for a certified
copy of the minutes of the Board of Trustees so that the said
changes will appear on the records of the Zoning Board of
Appeals. Mr. Page then moved that this Board suggest to the
Board of Trustees to provide new copies of the Zoning
Ordinance containing all the amendments and revisions; the
said motion was duly seconded and the Secretary was again
instructed to take the matter up with the Board of Trustees.
There being no further business to transact, the meeting adjourned at 8:45 CI clock P.M.

On November 13th I wrote inquiring about the status of the c
Red Gables. I received your reply of November 16th stating that you £
Tillage Attorney Sinnott and the Board of Trustees and would communica
further upon hearing from either or both, We have had no further word
but we have heard as follows from Trustee George W. Hutchinson, who ce
me about December 6th and volunteered these reasons for the inactivity
associates.
1. A general feeling that the legal case is weak, becau£
permit had been issued, even though this was subsequv'
revoked,
2,

C

o
cf

O

P*

Mr, Hutchinson had been informed that even should thcRailroad Building and Loan Association meet with defc
in an initial legal action, it would plan to carry +'
case to the highest possible court,

cf

P1
f-»

V£>

3. A belief that this would involve the Village in a cc
litigation,
4,

A feeling that the Tillage would not be favorable to
idea of expending the necessary funds.

Will you please advise us in this matter. Did not the ZoAppeals decide after a public hearing, that the Zoning Ordinance wa»
lated and direct that such violation be stopped? If this is correc*
Board of Trustees permit a continuation of such a violation? Is the'
for the Supreme Court?
