Dear Mr. Lofaro:
The Board of Direotors of the Philipse Manor Improvement Association has
again instructed me to write to you for information upon what seems to be a most
peculiar situation.
On November 13th I wrote inquiring about the status of the case against
Red Gables. I received your reply of November 16th stating that you had written
Village Attorney Siniiott and the Board of Trustees and would communicate with me
further upon hearing from either or both. We have had no further word from you,
but we have heard as follows from Trustee George W. Hutchinson, who called upon
me about December 6th and volunteered these reasons for the inactivity of his
associates.
1. A general feeling that the legal case is weak, because a
permit had been issued, even though this was subsequently
revoked.
2. Mr. Hutchinson had been informed that even should the
Railroad Building and Loan Association meet with defeat
in an initial legal action, it would plan to carry the
case to the highest possible court.
3. A belief that this would involve the Village in a costly
litigation.
4. A feeling that the Village would not be favorable to the
idea of expending the necessary funds.
Will you please advise us in this matter. Did not the Zoning Board of
Appeals decide after a public hearing, that the Zoning Ordinance was being violated and direct that such violation be stopped? If this is correct, how can the
Board of Trustees permit a continuation of such a violation? Is that not a matter
for the Supreme Court?
