To the Zoning Board of Appeals, Village of North Tarrytown, Hew York. Pursuant to a communication from Mr. John J. Lofaro, your Secretary, under date of April 36, 1932, which letter in substance refers to the matter of wRed Gables" being an open matter and also requesting my attendance at your next meeting on May 19, 1933, and further to advise your Board as to the disposition of same and with reference to the enforcement of the Zoning Ordinance. I have examined into the Minutes of the meeting of the Zoning Board of Appeals of North Tarrytown, held on the 24th day of September, 1931, at which meeting all the members of the Zoning Board were present. In 1925 the property known as "Red Gable8* was purchased by Mrs. Ula Bass. Subsequent thereto and in February, 1928 without submitting any plans showing probable changes, a building permit was requested from the building inspector in office at that time. A permit was issued by said building inspect- or and three or four days thereafter the building inspector discovered that he was in error, revoked the permit and demanded its return. Thereafter in March, 1928, the building inspector wrote the owner, Mrs. Ula Bass that the proposed changes were contrary to the Law and again requested the return of the permit* The permit has never been returned. July, 1928, the same owner, Mrs. Ula Bass, made a building and loan agreement with the Railroad Cooperative Building & Loan Association for the purpose of financing changes which were started that month and which altered the house into an eight family apartment house—a type of construction and use prohibited in residence District A. Subsequently the property was used as an eight family apartment. On September 15th, 1931, a Public Hearing with re- spect to this violation was held after the new owners, the Railroad Cooperative Building & Loan Association were duly notified that a Hearing would be held on said date. Said new owners did not appear at said Public Hearing held on September 15th, 1931. Under Section 10 of the Zoning Ordinance it is provided as follows: "••...The Inspector of buildings shall enforce this ordinance under the Rules and Regulations of the Board of Appeals. * Under Section 11 it is provided as follows: "•....The Building Inspector, Board of Appeals and the Board of Trustees of the Village, or either, shall have the right to enforce the provisions of this ordinance by injunction and for other equitable relief." TELEPHONE 1 2 1 8 •JeTo the Zoning Board of Appeals june 4, 1933, Ordinance, the owner, agent, contractor, or other person interested as lessee, tenant or otherwise in any building or premises where such violation has been committed or shall exist, and who refuses to abate said violation within five days after written notice has been served upon him, either by mail or personal service, shall for each and every day that such violation continues be subject to a fine of twenty-five dollars and the collection thereof shall be prosecuted in the manner prescribed by Law or Ordinance effective in the Village of North Tarrytown." I am of the opinion that the injunction referred to would not be granted unless the act sought to be restrained is a nuisance. There is abundant authority for this opinion. The mere prohibition against the use of HRed Gables0 premises as an eight family apartment house does not make that a nuisance, which otherwise is not a nuisance* Courts will not undertake to restrain an act which violates a municipal ordinance unless the act is a nuisanoe. The remedies for enforcement of ordinances and penalties in case of violation thereof are exclusive and are to be strictly construed. In order to obtain an injunction as contem- plated by the Ordinance, it would be necessary for the Village of North Tarrytown to establish by a fair preponderance of evidence that a nuisance per se exists, and that in the case of a private individual, it would be necessary for him to show that damage or injury has been done or will done to his person or property. Under Section 17 of the Zoning Ordinance, the remedy prescribed therein is a Civil remedy by action to recover the penalty prescribed. Under Section 49, Civil Practice Act, it is provided that an action upon a statute for a penalty where the action is given to the person aggrieved or to that person and the people of the State, it must be commenced within three years after the cause of action has accrued.
