Tarrytovm, II.Y., held at
the Corporation Rooms in
said Village on the 28th day
of June, 1932.

The meeting was called to order by Chairman Gould at
8:05 P.M.
The minutes of the regular meeting of May 19th, 1932
and the minutes of the Special Meeting held on June 7th,
1932, were respectively read,and approved.
An undated and unsiged letter, received by mail on
June 9th, 1932, addressed to Secretary Lofaro complaining
of certain alledged violations in Webber Park was read and
placed on filed. In- connection with the matter, Mr. Lofaro
informed the members of the Board that on June 11, 1932, he
caused the following notice to appear in the Tarrytown Daily
Hews:

The Board thereupon unaminously confirmed the acts of
Secretary Lofaro and suggested that since no formal action
could be taken by the Board, the complaint souldtoebrought
to the Building Inspector's attention for investigation.
A letter from Building Inspector, Percy G. Minnerly
dated June 20, 1932, was read. Mr. Lofaro said that upon
receipt of this letter, he communicated by telephone with
Dr. Eugene H. Lehman, who said that he would immediately
apply to this Board for a variance. An application from
Dr. Eugene H. Lehman, dated June 20, 1932, to grant him a
variance permitting him to conduct a tea room on the Highland Manor School property during vacation months terminating
early in September, was read.
Dr. Lehman appeared before the Board and testified in
substance as follows:
1.
That during the past twelve years, he had conducted and
is still conducting the business of a tea room and inn during
the vacation months on premises known as the Highland Manor
School.
2.
That this was and is done to cut down the overhead expenses in the operation and maintenance of the said school.
3.
That Cottage number 4 on College Avenue and Broadway
is now adopted for a tea room Inasmuch as the school equipped
the said cottage for its Domestic Science Classes. That Cottage
number 1, situated in Tarry town was formerly used for that
purpose.
4.
That very little income is derived from the tea room
business, averaging two or three customers daily.
5.
That the accomodation of over night guests is by far
the biggest item. Some nights there may be a considerable
number of guests and other nights a few . That these guests
are distributed throughout the campus and are more apt to be
lodged in Tarry town than in North Tarry town.
After careful consideration and deliberation by the
Board, Mr. Lofaro moved that Dr. Eugene H. Lehman be granted
permission to continue the operation of the tea room business
and inn upon the following grounds:

1.
That the Highland Manor School is located in Tarry town
and partly in Worth Tarrytown.
2.
That premises in question are located in Residence "Bn
district.
3.
That Private Schools and Boarding or Lodging houses not
primarily
for transient guests are a permitted use in Residence
M
B" district.
4.
That Dr. Lehman has been conducting a tea room business
and inn on school premises during the vaction months for the
past twelve years.
5.
That although the business is not a continuous one throughout the entire year, it may be considered so in these particular
circumstances to spell out a non-conforming use.
6.
That in this particular case the strict letter of the
Zoning Ordinance as applied to the specific premises could
not be applied and that unneccessary hardship would result to
Dr. Lehman.
The motion was duly seconded by Mr. Mull on and on the
roll call was unaminously carried.
There being no further business to transact, the meeting
adjourned at 8:45 P.M.

A gasoline station is planned for
the corner of Broadway and Pierson
Avenue by Timothy F . Nolan, who
filed a request for permission to establish one with the • North • Tarrytpwn Board of Trustees Friday
n i g h t r The board referred it to the
Street and Sidewalk Committee for
report.
Mr. Nolan is awaiting a reply
from the board following the comrnlttee's report next Friday night.
He said- today that he is certain of
his r i g h t ' to establish the gasoline
station there. In the deed to his
property he is not prohibited from
running a business on it. ,
He has conducted business there
for approximately 15 years. The
property is more desirable for business t h a n residence. Broadway is
actually a "railroad" and should not
be zoned under Residence A which
applies to high class residence property, he stated today. •*•
He contends t h a t his is the only
unrestricted property in the manor
section.- The cemetery, he contends,
is a business and adjoining the cemetery is a tombstone cutting plant
and a gasoline station. South of
that it is zoned entirely for business
to Bedford Road.
North of Belle wood Avenue on t h e /
west side of the. street there is busy
ness in" operation. , He feels that he
IS entitled:'.-to conduct business on
his property and will fight for the
right to establish a- gasoline station
if 'the.' village does not approve it.
W i t h huge trucks and other traffic running over Broadway now,
residents along the Philipse Manor
frontage on the hill cannot sleep, a t
night with the noise and they a r e
disturbed in the daytime also, He
awaits the report of the board's committee.
