The Chair asked if the mailings were received. Sean McCarthy responded yes. Emilio Escalades spoke about the changes to the site plan. He stated that the change was due to site conditions. He spoke about the revised retaining wall system. He stated that larger blocks would allow the owner to install the required retaining wall with minimal excavating. He also stated that there was a concern about excavating so close to the adjacent property owners shed. Ana Maria McGinnis asked about the height of the original wall. Emilio Escalades responded that the original wall ranged between 2’-6’ with plantings above the wall. �Paul Wichmann asked for clarification on the location of the wall. Emilio Escalades clarified the location via the revised site plan. Elvira Aloia asked about the retaining wall in the front of the house. Emilio Escalades responded that the front retaining wall would be installed as originally planned. Paul Wichmann asked about the number of feet of cut required for the retaining wall. Emilio Escalades responded that 8-feet of cut is required. He stated that the original wall was 8feet high but the revised wall is only 4-feet high. Carter Sackman asked why the design change was needed. Emilio Escalades responded that the change was required due to the location of the utility meters. Sean McCarthy produced the original site plan that illustrated the placement of the original wall. He questioned the applicants ability to provide the proposed two 14’-long parking spaces. Romeo Cacandian responded that only one parking space would be provided in the driveway under the proposed plan. He stated that three spaces would be provided in the garage. Paul Wichmann asked if the wall steps back. Emilio Escalades responded yes. The Chair opened the public hearing. Anthony DelVecchio (22 Bedford Road) submitted a letter to the Board. He summarized the letter. He stated that the construction at the site was eroding his property. He also stated that he was concerned with the safety of his young children. There being no further public comments, the public hearing was closed. Paul Wichmann spoke about the retaining wall system. He questioned the elevation of the wall that would effectively restore the neighbor’s property back to its original grade. Emilio Escalades stated that the wall could be constructed higher in order to restore the neighbor’s property. The Chairman responded that the applicant is obligated to restore the neighbor’s property. There was a suggestion that this application be referred to the Planning Board to make sure that it is a solid engineering solution. There was an open discussion on whether Planning Board review is required. Emilio Escalades stated that the wall would be built whether the Board liked it or not. He stated that the applicant is running out of money and needs to move into the house immediately. The Chair asked Emilio Escalades to leave the meeting. Elvira Aloia stated that she would like to see renderings of the wall and the house together. Romeo Cacandian spoke about the original retaining wall system and the construction benefits of using the revised retaining wall system. He stated that the revised retaining wall system will require very little excavating. Paul Wichmann asked about the size of the blocks. Sean McCarthy responded that the blocks are 2’ x 4’ and weigh 3500 lbs each. He stated that the revised retaining wall could be used as a temporary wall system so that the permanent stone retaining wall could be constructed in front of the temporary wall. Paul Wichmann stated that the blocks look very heavy. Carter Sackman stated that the blocks would be very visible. Barbara Fina stated that the proposed product is too industrial for a residential application. She asked why the utility meters could not be raised to the first floor. Romeo Cacandian stated that the location of the utility meters are based on Con Edison requirements. Carter Sackman stated that the applicant should contact Con Edison to coordinate the utility meter locations in the field. Paul Wichmann made a motion to deny the application. Barbara Fina seconded. It was unanimous (6-0). 2) Berkowitz There was nobody at the meeting to represent this application. Sean McCarthy summarized the application for the Board. He stated that the fence was installed on the Village Right-of-Way. Paul Wichmann made a motion to deny the application. Carter Sackman seconded. It was unanimous (6-0). 3) Larry RodriguesThis is a continuation from previous meetings. Larry Rodrigues showed photos of the installed fence. He stated that the chain link fence was removed and replaced with a new steel fence. The Chair opened the public hearing. Since there was no public comments, the Chair closed the public hearing. Paul Wichmann made a motion to approve the fence based on the photos submitted by the applicant. Carter Sackman seconded. It was unanimous (6-0). 4) Vieira’s Service Station This is a continuation from previous meetings. Paul Wichmann summarized events from the last meeting. Linda Standley submitted an ExxonMobil color chart. She stated that the gray color is preferred since it hides dirt. She showed several photos of other gas stations that have gray exteriors. Paul Wichmann asked if the applicant could install a simulation brick product on the bay door to match the brick exterior. Linda Standley responded that she could install a simulation brick product. She stated that she would rather remove the wood and paint the doors silver until Exxon Mobil makes the renovations. The Chair opened the public hearing. Since there was no public comments, the Chair closed the public hearing. Barbara Fina made a motion to deny the application and ask that the door be visibly restored. In addition, the glass was to be visibly concealed with a solid surface on the inside so that products are not visible from the street. Paul Wichmann seconded. It was unanimous (6-0). 5) Minutes of the October 2004 meeting – The minutes for October 2004 were reviewed. Paul Wichmann made a motion to approve the minutes as submitted. Carter Sackman seconded. It was unanimous (6-0). 6) Other The Chair stated that the Village Trustees have changed the structure of the Architectural Review Board from a 7-member board to a 5-member board. The possibility of a meeting in December was discussed. There was an open discussion on fence installations and surveys. Paul Wichmann made a motion to adjourn. Barbara Fina seconded.
