MIHUTES OF THE ZONING BOARD OF APPEALS OF THE VILLAGE
OF NORTH TARRYTOWN, N.X.

November 23,1945.
Members present; Meesrs. Page,Costello, Grimball, Dailey and Quain.
also Mr. J. Fitzpatrick,Building Inspector.
Absent; &amp;£r!e3ingaro,Counsel.
Present in the audience were Acting Mayor Patrick J. Powers and
Mr. and Krs Anthony Robertine.
The meeting was called to order by the Secretary because of the fact
that there is no Chairman now as a result of Mr. YAa. Schmidt's resignation.
The first order of business was t£e question of whether to elect a new
Chairman.
Mr. Grimball made the motion that for this meeting we would dispense
with the election af a Chairman and moved that the -Secretary, VJT, F.X.Quain
would act as temporary Chairman.This motion was seconded by Mr. Page and
carried unanimously.
Mr. Fitzpatrick, the Building Inspector was then requested to explain
what violations were discovered at 28 Dell Street that prompted'him not to issue
a permit for the erection of a garage at this address by LIr. Robertine.
His answer to the Board was that Mr. Robertine wanted to build this
garage in the same location where an old shed had stood for years and which
he recently demolished.By building it in this location, it would be only
about 32 feet from his front property line instedd of the required 50 feet
setback of Zone M B M residential area.
Further, &amp;r« Fitzpatrick stated that by building in this location,
it would shut off the light to one of the windows of his next door neighbor
to the east.This neighbor to the east,was contacted by Mr. Fitzpatrick,
and stated that he would not want the garage built in that location, but
would insist upon Mr. Robertine,abiding by the Zoning Ordinance by moving
the location of the proposed garage back to the required 50 feet from the
front property line.
I'.n Fitzpatrick then stated that under those conditions he could not
issue a permit and. advised Kr« Robertine that he v/ould have to request a
variance from the Boning Board of Appeals,

Mr. Robertine was then requested to state his reasons for desiring
a variance from the ZoneHB" restrictions.
He went on to state that where he wanted to build the garage was
about 32 feet distant from his front property line, but it did not block
any of his neighbor's windows, because the proposed garage would be about
13 feet away from his neighbor*s house.
l\v. Robertine then stated that due to the topography of his ground
it would cause him to go to considerable expense to conform to the Zone
H
B" restrictions which call for a 50 feet setback for garages.
He further stated that his neighbor to the east of his property was
alv/ays on good terms with him and recently offered his services in
assisting him in erecting the garage.
The following motion was then made by Kr. Grimball and seconded by
L'r. Costellos
That the Zoning Board of Appeals hereby grant ilr. Robertine the
variance to the extent that the front line of his propp^e^l garage would
not extend any nearer his front property line than ^J» rear line of his
neighbor's house and still maintain a distance of 13 feet from his
neighbor's west side house line; provided L!r. Robertine would get
a document or statement made up to this effect and signed by his neighbor
to the east, his neighbor to the west and any one other taxpayer or
property owner on the street.If this statement with signatures.was procured
by Kr« Robertine, Kr. Fitzpatrick was to issue the necessary building permit
upon delivery of said document to him personally.
The motion was unanimously carried.
l!r, and Llrs. Robertine thanked the Board and stated that they would
comply with the decision and deliver the necessary written statement to
Mr. Fitzpatrick.
Mr. Dailey, who was appointed to the Zoning Board of Appeals "by the
Village Board of Trustees,participated in the discussions but did not vote
on any of the motions, because he has ixot as yet been sworn in.
The motion to adjourn was duly made and seconded to adjourn.
It Was so ordered at 8$55 P.M.
