M. to discuss a variance previously granted on March 2?th, 19^0 to Mr. John H, Tinker, address Ii5>7 Bellwood Avenue, North Tarrytown, New York. Present: Mr. Mr. Mr. Mr. Neil Gollogly, Chairman Stephen Benedict John Kowalski Patrick Powers, Jr., Village Counsel Chairman Gollogly called the meeting to order at 7:30 P. M. and stated the purDOse of this special meeting was to examine the contents of the variance granted Mr, Tinker on March 27th, 19^0 to extend the structure of his present building to a point not less than 9 feet from the rear line of his property. A recent survey has disclosed that the addition extended 6 inches further than the variance called for, therefore, the present structure is 3 feet 6 inches from the property line. Mr. Kowalski: When the variance was granted in 19^0 did any of the adjoining property owners object, to this variance. Mr. Gollogly: As far as the information contained in the minut«s therm was no objections. Mr. Benedict: Which part of the structurt projects 6 inches, is it the roof overhang or the foundations, as some homes have quite an overhang that could be corrected without too much cost and avoid the changing of the variance. Chairman Gollogly: Mr. Tinker indicated to me it was the foundations, and therefore, would be almost imDractica] and costly. These fractional errors occur often in buildings and this is not a serious one, it is just a matter of having it registered in the village records as 5 feet 6 inches from the property line instead of 9 feet. Mr. Powers: This change has to be approved by the Zoning Board in order to be acc«pt«d as legally amended even though it was only a fraction of an inch. �Mr. Kowalski: I move that the variance be changed to 8 feet 6 inches instead of 9 feet as previously granted. Mr. Benedict: I second.the motion. Chairman Gollogly: I agree with this motion and will notify the village clerk that the provision of Section Nine "Rear Yards* granted to Mr. Tinker, March 27th, 19!?0, be amended to maintain the present building at ty?7 Bellwood Avenue, 8feet 6 inches from the property line. This amendment to take effect immediately,carried unanimously. Meeting adjourned at 3:30 P.
