A special meeting was held before the Zoning Board of Appeals
of the Village of North Tarrytown, N.Y. on the above date.

Mr. Friere called the meeting to order at 8:00 P.M.
Mr. Patsy Marmo, owner of premises located at 76 Chestnut Street,
No. Tarrytown, N.Y. appeared before the Board. He stated that he
intended to operate a blacksmith shop in the garage on his premises:
that he would operate it on a part-time basis. He stated that he is
presently employed at the General Motors Plant and that he planned to
start operating after 3:30 P.M. every day.
He added that the operation of the blacksmith shop would consist
of sharpening tools, making iron fences and railings, and general
blacksmith work; that he intended to install a hearth for the purpose
of burning co^e coal for heating iron, etc. and to also install a
chimney of sufficient height that smoke emanating therefrom would be
above the roofs of nearby houses. He admitted that there would be a
certain amount of noise connected with the operation of the shop.
The Board advised him that since his property is located in a
business zone, such use for a blacksmith shop is permissible under the
Zoning Ordinance.
He was further advised that, if he violated the provisions of
Section 5, Subdivision (b) of the Zoning Ordinance, the Zoning Board,
upon petition filed by residents in the immediate area of his property,
the Board would have to act on such petition.
The Board also discussed the matter of application for a variance
filed by Mary Abraham to enable her to construct a small addition to
her apartment house at 10 Pleasant Street (Section 15, Block 2, Lot 9B)
and also her application for a variance to enable her to continue to
maintain a structure built along the westerly boundary line of her
property on Continental Street (Section 15, Block 2, Lot 9).
Both of the above matters were referred to Counsel to prepare the
required legal notice for a public hearing.

In the Matter of the Appeal
of
Gerardo Patrignani and
Victoria Patrignani from a
denial of an application for
a building permit

Applicants had filed an application with the Building Inspector of
*j."ii. the :Til3 .£; of North Tarrytown for a permi': to erect a one family
residence with a studio for professional hair styling on property
situated in a Residence "A'1 District under the provisions of the Zoning
Ordinance of the Village of North Tarrytown.
The Building Inspector denied the application on the ground that such
use of applicants' proposed building or premises does not come within the
purview of Section 3&gt; subdivision 2, Reciden^-e "A:l District uses of the
Zoning Ordinance of the Village of Ncrth Tarrytown.
Applicants filed an appeal with this Board from the determination
made by the Building Inspector denying applicants' application.
After published notice, this Board duly held a public hearing on
December 13, 1961.
At such hearing, applicants personally appeared with their
attorney

who addressed this Board at length in support of applicants application.
Many residents and taxpayers, most of whom reside in and about the area
where applicants' property is located, also personally appeared objecting
to and opposing applicants' application.
In addition, a resolution adopted by the Philipse Manor Garden Club,
objecting to and opposing applicants' application, was filed with the
Board.
After a considered..analysis of all the facts adduced in support of
and objections to applicants' application, it is the determination of the
Board that the erection of a one family residence with a studio for
"Professional Hair Styling" on applicants property, as proposed by
applicants, does not constitute an office cr studio of a resident
professional person, such as a physician, surgeon or dentist as described
in Section 3, Subdivision 2 of the Zoning Ordinance of the Village of
North Tarrytown; that such use is not within the purview or limitations
of Residence "A" District uses and that such use, as proposed by applicants,
is a violation of such Zoning Ordinance.

The decision of the Building Inspector is hereby affirmed in all
respects and applicants! appeal therefrom is denied.
