After duly published notice, a public hearing was held before the
Zoning Board of Appeals of the Village of North Tarrytown, N.Y., on
the above date.

Chairman Friere called the hearing to order at 8:00 P.M.
The Clerk read the notice of hearing published in the official
newspaper of the Village as follows:
"PLEASE TAKE NOTICE, that the Zoning Board of Appeals of the
Village of North Tarrytown will hold a public hearing on Wednesday,.
September 26th, 1962 at 8:00 P.M. i* the Municipal Building, 28 Beekman
Avenue, North Tarrytown, New York to consider the application of the
First National Bank of North Tarrytown for a variance from the
provisions of the Zoning Ordinance of the Village of North Tarrytown,
as follows:
A permanent variance from the provisions of Section 4, "Residence
' B1 District Uses", to permit construction, use and maintenance of an
Off-Street Parking Area for automobiles, in connection with the banking
business conducted in the building and premises known as U9 Beekman
Avenue, North Tarrytown, New York.
The property for which said variance is sought is known and
designated on the Tax Assessment Map of the Village of North^Tarrytown
as Section 15, Block 13, Lot ID, located on the east side of North
Washington Street, and is contiguous with and adjacent to said
petitioner's building and premises."
Mr. Henry J. Logan, representing the First National Bank as their
attorney, 199 Main St., White Plains, N.Y., stated that a parking
problem exists on Beekman Avenue and in an attempt to relieve the
situation the Bank has entered into a contract with the adjoining
property owner on Washington Street to use their property after
removal of the building for a parking area provided that the variance
is granted.
Mr. Logan stated that the lot would be used solely for the purpose
of parking for bank patrons and will be landscaped.
Mr. Logan stated that granting of the variance would not only
assist the bank business, but will also help the business areas.
Mr. Charles Freyler, cashier of the First National Bank, 62
Hudson Terrace, stated that if the variance is approved, the bank will
have an investment of approximately$40,000 in the property.

�-2Mr, Freyler stated that they would like to remain an individual
bank and in order to do so must advance. Mr. Freyler stated that he
has been told by people that they do not bank at the First National
because of lack of parking space.
The lot will be able to hold about
fifteen cars at a time, said Mr. Freyler.
Mr. Maffucci inquired as to what the plans are after banking hours.
Mr. Freyler stated that the lot will be locked,
Mr. Logan stated that the variance will be granted for a specific
use and that the bank cannot, after permission is granted, use the
lot for anything else.
The economic use of the property would be for
parking, said Mr, Logan.
Mrs. Helen Guilfoyle, 255 No. Washington St., inquired as to how
the lot would effect the rest of the zoning area.
Mr. Friere stated that no other property would be affected by this
variance.
Mrs. Guilfoyle stated that beer parties are being held in the
playground and wondered if they will be held in the parking lot.
Mr. Freyler stated that if necessary, a private guard will be
hired.
Mrs. Alice Vavra, 258 No. Washington Street, inquired if the
entrance or exit will be on Washington Street.
She stated that she
had heard rumors that the bank will tear down their building on
Beekman Avenue and make an entrance to the parking lot.
Mr. Freyler stated that the entrance and exit to the parking lot
will be on Washington Street.

Mr. Freyler stated that property on Beekman Avenue should remain
for business and not for parking, and that it is not the intention to
take away office space on Beekman Avenue.
At this time, Mr. Friere stated that a letter has been received
from Counsel Chessari disqualifying himself, as Village Attorney, from
any and all participation in the application of the First National Bank
of North Tarrytown for variance on premises-254 North Washington St.
for the reason that he is the Attorney for Mildred Poidomani, the owner
of 254 No. Washington St., who has entered into a contract for the sale
of said premises to the First National Bank.

There being no further comments on the variance, Mr. Gross moved,
seconded by Mr. Maffucci that the hearing be closed.

Mr. Friere advised Mr. Logan that the Board will notify him of
a decision.

EXECUTIVE SESSION
The Board reconvened in executive session and following a short
discussion, Mr. David Page moved, seconded by Mr. Anthony Maffucci that
the following resolution be adopted:

�-31. The property for which the variance is granted is bounded and
described as follows:
ALL that certain plot, piece or parcel of land, with the
buildings and improvements thereon erected, situate, lying
and being in the Village of North Tarrytown, Town of Mount
Pleasant, Westchester County, New York, and bounded and
described as follows:
COMMENCING at the northwest corner of the premises hereby
conveyed and running thence in a southerly direction along
the east side of Washington Street,south two degrees thirty
minutes east (2° 30 * E.) forty-two and fifty-three one
hundredths feet (42.53 feet) to the southwest corner of the
premises hereby conveyed; and running thence in an easterly
direction
south eighty-seven degrees thirty minutes west

(87° 30 W.) ninety-six and thirty-two one hundredths feet
(96.32 feet) to lands now or formerly of one Nathan Rosenberg;
and running thence in a northerly direction north no degrees
eighteen minutes twenty seconds (0° 18' 20") east forty-two
and fifty-eight one hundredths feet (42.58 feet) to the
northeast corner of the premises hereby conveyed and running
thence in a Westerly direction
south eighty-seven degrees

thirty minutes (87° 30 ) west ninety-eight and forty-one
hundredths (98.40 feet) to the point or place of beginning,
be the said several dimensions more or less.
Said premises being designated on the Tax Assessment Map of
the Village of North Tarrytown as Section 15, Block 13, Lot ID.

�-42. The purpose for which the variance is granted is as follows:
(a) The off-street parking of automobiles during banking hours
only.
(b) If any other use is sought to be made of the property, at any
time, or if the use permitted is discontinued, then, and in that event,
the variance shall lapse and shall no longer be in force and effect.
3. The conditions which must be met for the granting of said
variance are as follows:
(a) The parkiriQ area must be blacktopped, fenced in and closed
after banking hours f
(b) All work on the parking area must be done under the supervision
and control of the Building Inspector of the Village of North Tarrytown.
All plans for construction must be submitted prior to starting work.
(c) The parking area must be properly "screened off", or
separated from the surrounding residential property by adequate
shrubbery or other planting.

declared the motion carried.
Mr. Gross moved, seconded by Mr. Maffucci that the meeting be
adjourned.
