After duly published notices, two public hearings were held before
the Zoning Board of Appeals of North Tarrytown, N.Y. on the above date.

Chairman Friere called the hearings to order at 8:10 P.M. and
read the following notice:
"PLEASE TAKE NOTICE that the Zoning Board of Appeals
of the Village of North Tarrytown will hold a Public Hearing on
November 6, 1963, at 8:00 P.M. in the Municipal Building, 28 Beekman
Avenue, North Tarrytown, N.Y., to consider the following application
for a variance from the provisions of the Zoning Ordinance of the
Village of North Tarrytown:
The application of Julius and Maria Suchy for a variance from the
provisions of Section 9 - Setback Building Lines - and for permission
to construct a one family dwelling which shall be set back five (5) feet
from the northerly side property line on property known and designated
on the tax map of the Village of North Tarrytown as Section 17, Block 15,
Lots 1 and 2 located on the westerly side of Anderson Avenue and on the
southerly side of Tappan Avenue.
All taxpayers, residents and parties in interest are entitled to
appear and be heard."
Chairman Friere read a copy of a letter sent to Mr. S Mrs. Suchy
informing them that the Planning Board does not feel that a hardship
exists and the variance does not warrant granting.
Counsel Chessari stated that the letter is merely a recommendation
from the Planning Board, but the Zoning Board has the final decision.
Mr. Steve Horecky, appearing in behalf of his parents who have
requested the variance, stated that it would be a hardship on his parents
if the variance isn't granted. The house would be long and narrow if
40 feet of the area is taken away, said Mr. Horecky.
Mr. Gasparovic stated that although the building department has no.
objection to the variance requested, he has to abide by the Zoning Code.:
No other comments for or against the variance, Anthony Maffucci
moved, seconded by John Gross that Mr. S Mrs. Julius Suchy*s;request

The application of Lawrence and Genevieve Kosilia for a variance
from the provisions of Section 9, Setback Building Lines, and for
permission to construct a one family dwelling which shall be set back
ten feet from the front property line on property known and designated
on the tax map of the Village of North Tarrytown as Section 15, Block 4,
Lots 2, 3 and 4, located on the west side of Kendall Avenue,
All taxpayers, residents and parties in interest are entitled to
appear and be heard."
Mr. Kosilla presented a petition signed by thirteen residents of
Howard Street and Kendall Avenue stating that they have no objection
against Lawrence and Genevieve Kosilla to construct a one family
dwelling which shall be set back ten feet from the front property line.
Chairman Friere read a copy of a letter sent to the Kosillas from
the Planning Board who felt that no hardship existed and a variance
is not warranted.
Chairman Friere.stated that the four houses on the street are set
back approximately ten feet from the curb.
Mr. Kosilla stated that his house will be the last house on the
street and he would like to keep in line with the other homes.
Mr. Gasparovic stated that although the building department has no
objection to the variance, he has to abide by the zoning ordinance.
There being no other comments for or against the variance, John
Gross moved, seconded by Anthony Maffucci that Mr. S Mrs. Lawrence
Kosilla's request for a variance from the provisions of Section 9,
Setback Building Lines, for permission to construct a one family
dwelling which shall be set back ten feet from the front property line
on property known and designated on the tax map of the Village of North
Tarrytown as Section 15, Block 4, Lots 2, 3 and 4 located on the west
side of Kendall Avenue be granted.
Carried.
There being no further business to come before the meeting,
Anthony Maffucci moved, seconded by John Gross that the same be duly
adjourned.
Carried.
