Two Public Hearings were held before the Zoning Board of Appeals
of the Village of North Tarrytown, N.Y. on the above date.

Mr. James Friere called the meeting to order at 8 P.M.
Counsel Chessari read the first notice of hearing to consider
application of Joseph Migliarese for a variance from Section *f.220,
R-5-5 to permit the applicant to construct a four-family apartment
building on an area of 6250 square feet instead of 6500 square feet on
property located at 152 Depeyster Street and also known as Section 16,
Block 8, Lot 14 on the tax assessment map.
Mr. Gasparovic stated that the Building Department sees no objection
and recommended that the variance be granted.
Mr. David Jarema moved, seconded by Pat Lupi that Mr. Migliarese
be granted a variance from Section *f.220, R-5-5 of the Zonning Ordinance
to permit him to construct a four-family apartment building on an area
of 6250 square feet, instead of 6500 square feet on property located
at 152 Depeyster Street and known as Section 16, Block 8, Lot l»f on the
tax assessment map.
Carried.
Counsel Chessari read the notice of hearing to consider an
application by Edmay 8 Lewis Realty Corp. for a variance from the
Zoning Ordinance from Section 4.356 to permit applicant to install and
maintain an ornamental wicker type board fence eight feet in night
instead of five feet at the rear of premises at 9 Barnhart Avenue and
known oh the tax assessment .map as Section 15, Block 7, Lot 6.
Mr. Gasparovic stated that he was in receipt of a telephone call
inquiring about the 8 ft. fence whichvMr. Martin had erected. Upon
investigation, Mr. Gasparovic stated that he informed Mr. Martin that
the fence was in violation of the Zoning Ordinance which calls for a 5
ft. fence. Mr. Gasparovic stated that Mr. Martin informed him that
he wanted to enclose the yard, which was being used as a beer garden, so
that it would not be objectionable to residents; however, he informed
Mr. Martin to either take the fence down or obtain a variance.
Mr. Neimark, attorney for Mr, Martin, stated that the fence was a
great improvement to the property.

�-2Mr. John Gross stated that he had talked to neighboring property
owners who informed him that they had no objection to the fence.
Mr. Neimark stated that if neighbors had any objection to the
fence, they would be here tonight.
Mr* John Gross moved, seconded by David Jarema that a variance be
granted to Edmay &amp; Lewis Realty Corp» to install and maintain an
ornamental wicker type board fence eight feet in height instead of five
feet at the rear of premises located at 9 Barnhart Avenue and known
as Section 15, Block 7, Lot 6 on the tax assessment map.
Carried.
There being no further business to come before the meeting,
John Gross moved, seconded by Pat Lupi that the same be duly adjourned,
