September 2, 1965 // f { ° Two public hearings for variances were held before the Zoning Board of Appeals of the Village of North Tarrytown, N.Y* on the above date. Inspector Absent David Jarema Applicant present: Charles Margotta Applicant absent: J. W, Kreuttner Chairman Friere called the meeting to order at 8:00 P.M. Counsel Chessari read the notice of hearing to consider an application by Charles T. Margotta for a variance from the Zoning Ordinance to permit said applicant to install and attach to the building located at 332 North Broadway a wooden sign, 36" wide and 44" high, said sign to extend 42" over the sidewalk. i Mr. Gasparovic stated that he received a call from Miss Lee, of the 1 Van Tassel liquor store who voiced opposition to Mr. Margotta s sign. Mr. Gasparovic stated that upon investigation, he informed Mr, Margotta that the sign was in violation of the Zoning Ordinance and henceforth, this request for a variance* Mr. Gasparovic stated that Mr* Margotta can erect a sign which could extend six inches from the building. In the discussion which followed, it was stated that there might be other requests for overhanging signs and if this request is granted, the others would have to be also* Pat Lupi moved, seconded by John Gross that Charles Margotta1s request for a variance from Section 4*375, subdivisions 2-3-4 of the Zoning Ordinance to erect an overhanging sign at his place of business at 332 North Broadway be denied. Carried. Counsel Chessari read the notice of hearing to consider an application by Joseph W. Kreuttner for a variance from Section 4.220-7-R-2 to permit applicant to subdivide premises located at the southeast corner of Bellwood Avenue and Millard Avenue by reducing the east-West depth of said premises from 200 ft. to 125 ft. and reducing the distance of the rear lot line from the existing residence to 19.47, instead of 25 ft. Mr. Gasparovic stated that the Planning Board met on August 31, 1965 to discuss Mr. Kreuttner's request for resubdivision of his property. The Planning Board finds that no hardship exists since the dwelling presently located on said lot was intended to occupy the entire lot, said Mr. Gasparovic, . * v -- *- 'I™- x^-'-^A--s*ia&J^-^ii>iW*^£S£53^^ �To subdivide the said lot which would create a new lot, would in the opinion of the Planning Board, tend to downgrade the adjoining land values and would also cause to create an existing dwelling, which at present j is conforming to be nonconforming in regard to rear yard setback requirements as per section 4*220 R-2-7, 25' -8" rear setback line, Mr. Gasparovic stated that the status of the present lot is conforming, and to change it as per Mr, Kreuttner's request would be in violation of Section 4.120 which reads as follows: "No building shall hereafter be erected and no existing building shall be moved, altered, added to, or enlarged, nor shall any land or building or portion of a building be used, designed, or arranged to be used for any purpose unless in conformity with all of the regulations herein specified for the district in which it is located." In the discussion which followed, it was stat ed that the Planning Board has denied Mr t Kreuttner's request for re-subdivision oh Section 14, Block 18v Lot 3 and a variance should not be granted* Pat Lupi moved, seconded by John Gross that in view of the report submitted by the Planning Board in denying Mr. Kreuttner's request for re-subdivision, the Zoning Board of Appeals has no jurisdiction to grant such a variance and that said request be denied. Carried. There being no further business to come before the meeting, John Gross moved, seconded by Pat Lupi that the same be duly adjourned, Carried.
