After duly published notice, a hearing was held before the Zoning
Board of Appeals of the Village of North Tarrytown, N*Y« on the above
date •

Chairman Friere called the hearing to order at 8 P.M.
Counsel Chessari read the notice of hearing to consider an appla~-tio?
by Howard Kissling, as owner, and Tappan Motors as lessee, of premises hereinafter described for the following variances from the Zoning Ordinance:
1. Variance from Section 62-8B-CI, Col. 7 of schedule of regulations
thereof of said ordinance, Rear Yard Requirements, to permit said
applicants to construct a second story addition at the rear of the
building located at the northwest corner of New Broadway and Route 9 on
premises designated on the Tax Assessment Map of said Village, leaving
a distance of five feet from the rear property line of said premises
instead of the required twenty feet, and 2. variance permitting alternate
off-^ite parking space on premises designated on the Tax Assessment Map I
of s^id Village as Section 15, Blfcck 1H, Lot 17 as authorized by Section^
62-lH-B(if) of said ordinance instead of compliance to the provisions of \
Section 62-14-B(l) of said ordinance requiring on site parking space on ;
the Same lot appurtenant to applicant's business.
?Mr« Peter Blasi submitted proof that registered letters were sent
to surrounding property owners.

'Counsel Chessari read a letter directed to the Board of Trustees
from the Neighborhood Association opposing the granting of the variance.
Mrs. Mary Ward stated that there are anywhere from 10-15 cars
parked daily on New Broadway and inquired if there were going to be the
same number of cars on the street or will there be more.
Mr. Peter Blasi stated that parking is
plan which has been submitted.

Mr* Blasi stated that additional space for parking has been made
in the lot across the street and employees will be instructed to use it
if the variance is granted.
; Mr, William Patten stated that he was delegated by the Webber Park
Association at a meeting held on May 3rd and presented a petition sir ;
by residents of the Neighborhood opposing the variance*
; Mr. Friere stated that anyone can park on any street as long as
there is not a sign prohibiting parking*
Mr. Gasparovic stated that in the original parking facilities for
his building, there is provision to park on site and there if off-street
parking for 15 cars*
As far as the new plan submitted, Mr. Gasparovic
stated that they will park 7 cars and will have a loading spane.
Additional cars will be parked on Lot 17, said Mr. Gasparovic. This
would be ample room for parking if it is complied with, he said, and
aloo complies with the Zoning Ordinance.
'; Dr. Brady inquired if there was anyway that the police can see
that there should be a certain number of cars parked in the lot.
Counsel stated that the Zoning Board can restrict the number of
cars to be parked•
•Mr. Blasi stated that if the variance is granted, it would be
granted as per the plan presented. If it is violated, it will be on the
same purpose as the permit issued by the inspector, said Mr* Blasi*
The Inspector would be in a position to either file a notice of
violation or to pressure whatever remedies are available in the law or
Zoning Ordinance, said Mr. Blasi*
\ Mr. Blasi stated that he understands the Neighborhood Association
would have some questions and qualms, however, the Village passed a new
ordinance which created the setback change*
Mr* Blasi stated that Mr*
Matspn, the architect, is trying to make an improvement of the build: ^,
This•would eliminate the throwing of debris, etc*, said Mr* Blasi* If
it were a new building and we wanted to come in within five feet, then
thejfe might be cause for complaint, said Mr* Blasi* The existing
building is five feet from the line, said Mr# Blasi.

.Mr. Swaby inquired as to what is the usage now as far as the
occupancy is concerned and how many cars * are being parked in the building
and pn the parking lot there now.

Mr. Gasparovic stated that there were no requirements at the time _
because it was non-conforming* An agreement had been made with Mr*
Kissling to park 15 cars*
Mr* Swaby stated that this would not relieve the congestion on
New proadway*
Mr. Patten stated that he consulted with the Chief of Police and
was told that there was no way legally to force employees to park on
the lot.

Dr. Brady pointed out that we-were not interested in the parking,

Mr. Blasi stated that his client would instruct the employees to
park in the lot. As far as the parking plans are concerned, there are
more than enough, said Mr, Blasi. If the Trustees want to pass
regulations there is nothing we can do about it,said Mr. Blasi.
Mr. Friere stated that the variance being asked has enough spaces
sufficient for parking.
In answer to a question by Mr. Patten, Mr. Friere stated that we
as a* Board would never stop property owners from building. If the
building was not already on the property, we would not even consider
the setback. All the property owner is doing is asking for the building
to go straight up, said Mr. Friere.
; Mr. Blasi stated that Mr. Benny Ginnetti, adjacent owner, brought
out a point whereby he did not care to have the windows facing his
property. Acccv- !ing to the plans, the windows are on the north side,
however, if Mr. Ginnetti does not want them on that side, a solid wall
would be made instead, said Mr. Blasi.
It was thought that the
windows would be more attractive, said Mr* Blasi.
&lt; In summing up, Mr. Friere stated that there are enough spaces for
parking in this request for a variance and it could be stipulated in the
variance that they must park in their lot. It would be up to the
building inspector to report any violation and have a summons issued.
^Counsel Chessari stated that if the Board decides to grant the
variance, it can impose certain conditions•
It would be a must that
Mr. Kahn, as well as Mr. Kissling, would have to direct their employees
to pkrk across the street in the*other lot, said Counsel.
Mr. Friere informed the applicants that the Board will make a
decision at a future date.
\The Board reconvened in executive session and it was stated that
before a decision is made, a plan of the lot on North Broadway should be
submitted to the State Dept. of Public Works for their approval for
egress and ingress.
The Clerk was instructed to inform the applicants'
of same.
