Present James Friere, Chairman Peter Esteban James Margotta John Arcate Edward Swaby David J. Whelan, Counsel Joseph Jelenek, Bldg. Inspector Chairman Friere called the hearing to order at 8:00 P.M. Clerk Fallacaro read;the notice of hearing to consider the request of Edward and Virginia Brown of 5 Webb Road, North Tarrytown, N.Y. for relief on appeal from a1 decision of the Building Inspector in denying a permit on applicants proposal to erect a six ft. fence and for a variance from the provisions of Article IV, Section 62-13, paragraph F-2 of the Zoning Ordinance requirements that no wall or open or solid fence in excess of five (5) feet in height shall be erected along the side yards and rear yards in any residential district on property known on the Tax Assessment Map of the Village of North Tarrytown as Section 11, Block 1H, Lot 11. Chairman Friere asked if there was anyone present who would like to speak for or against the proposed variance. Mrs. Brown stated that the reason for the six ft. fence is because dogs in the area can jump over a five ft. fence. She said that she would also like to keep her dogs enclosed. She stated that there is an eight ft. stockade fence on both sides of her property and she would also like to keep the height in line with the other fence. Mr. Reiner, a neighbor residing in the back of the Browns, stated that they had no objection to the six ft. fence. Several questions were asked of Mrs. Brown during which she stated that the fence would not be seen from the road. An affidavit was received from Mrs. Srown certifying that property owners within 200 ft. were notified of this request. No further questions, James Margotta moved, seconded by Peter Esteban that the hearing be closed. Carried. �EXECUTIVE SESSION Following a general discussion of the request for a variance, Edward Swaby moved, seconded by Peter Esteban that due to lack of evidence of a hardship, the request of Mr. & Mrs. Edward Brown for a variance to erect a six ft. fence be denied. Carried. No further business to come before the meeting, the same was duly adjourned.
