A hearing was held before the Zoning Board of;Appeals of the Village
of North Tarrytown, New York, on the above date.
Present:

James Friere, Chairman
James Margotta
Edward Swaby
Morton Linzer
Robert J. Ponzirii, Counsel
Victor R. Page, Building Inspector

Chairman Friere called the hearing to order at 8:15 P^M.
Morton Linzer read the notice'and • appealconcerning the request
fora variance to overcome the refusal by Building Inspector ;to
grant a building permit to Mahue 1 arid John Cappello to" construct
a wall over 3 feet high at 44 Pocantico Street, North Tarrytown.
Mr. Margotta indicated the wall was a part of other wall areas and
much like other walls in the area.
Mr. Swaby reported the wall was "in keeping with the nature of other
walls in the area.
Mr. Friere read a letter from John Arcate, member who is on vacation,
indicating his agreement to grant a variance.

Mr. Margotta moved to grant'a variance to'construct a 4 foot 16 inch
wall at 44 Pocantico Streety North Tarrytown to replace the present
wall. Mr. Swaby seconded the motion.

All membersJvoted in favori;of the motion and Mr. Page was directed to
issue a permit to the Cappellos.
Mr. Linzer moved to: adjourn the meeting. Mr. Margotta seconded the
motion and the meeting was adjourned at 8:30 P.M.
