ZONING BOARD MEETING - October 23, 1986

The next meeting of the Zoning Board will be on November 20. Mr.
Arcate advised the Board that he had established with the Village Clerk
that if Village needs permitted the Zoning Board would not have meetings
more often than two weeks apart and that no more than three hearings
would be considered per meeting.
There was a short discussion regarding Mr. Kuntz1 application.
The Board reviewed the facts and photographs as well as a photo copied
drawing of Mr. Kuntz1 property, with his proposed shed location.
Based upon a review of the facts and Code paragraph 62-2 and
62-40C, Mr. Arcate proposed a resolution: the shed should be located
in the rear yard; there are reasons to warrant waiving the 5 foot side
yard requirement in this instance. Mr. Kuntz was advised that the best
use of the property would be to bring the shed closer to Farrington
Avenue and line it up with the rear wall of the house, approximately
23 feet from the rear property line. Mr. Paolantonio made a motion to
grant a variance based on Mr. Arcate's above statement and Mr. Swaby
seconded the motion. The Board voted in favor of the motion. The Board
pointed out to Mr. Kuntz that this variance applies only to the life of
the shed as it exists at this time; any change would require another
variance.
Mr. Kuntz was advised by Mr. Ponzini to move this shed promptly
because at this time he is in violation of the Code and therefore he
should consult with Mr. Margotta as to the exact location that has been
approved. Further he advised Mr. Kuntz that this matter will move into
Justice Court if it is not taken care of promptly.
Ms. Hogan-Felix moved to adjourn the business meeting at 9 p.m. and
her motion was seconded by Mr. Ceconi and was approved unanimously.

�ZONING BOARD HEARING - October 23, 1986

Chairman Arcate opened the hearing at 8:10 p.m. to consider the
application by George Kuntz, 7 Farrington Avenue, to move a metal
storage shed to the northwest corner of his property.
The clerk read the Public Notice of hearing and Mr. Arcate
addressed the Board stating that the first Public Notice was for a
hearing scheduled for August 7 which was postponed at the applicant's
request; the second Notice was for a hearing scheduled for September 18,
however, the applicant failed to satisfy the requirement of notifying
property owners within 200' of his property. The October 23 hearing is
the third hearing for which the Village gave notice.
Mr. Arcate requested that Mr. Kuntz

Mr. Kuntz explained that the shed is a metal shed which is bolted
together and which he has had to move from the east side of his property
because it was on the paper street. He wishes to keep it at the northwestern corner of his property. Mr. Kuntz was questioned as to whether
or not the paper street has been cleared and if the wood will be removed as well. Mr. Kuntz replied that the property would be cleared.
Mr. Arcate asked Mr. Kuntz what constraints he saw that would
require that the shed be placed on his property line and if the western
or eastern property line would be equally preferable. Mr. Kuntz said
either side is fine, however, if the shed cannot be on the property line,
it will be in the middle of his back yard.
The Chairman then stated that the Code paragraph 62-13E requires
that the shed be placed 10 feet away from the principle house, 12% feet
from the rear property line, and no closer than 5 feet from the side yard
line.
Mr. Paolantonio made a motion to adjourn the hearing; Mr. Swaby
seconded the motion and the Board voted in favor of the motion.
