�Zoning Board of Appeals
Special Meeting
North Tarrytown, New York
December 5th, 1991

A special meeting of the Zoning Board of Appeals was held on
the above date in the Village Hall, North Tarrytown, New York.
PRESENT:

Jerome Fine, Chairman
Costas Boumis
John Morabito
Mary Galgano
George Fitzpatrick

ABSENT:

Frank Paolontonio
Juan Pujadas

ALSO PRESENT:

James Margotta, Building Inspector
Robert Spencer, Village Attorney

Chairman Fine called the meeting to order at 8 P.M. and stated
the purpose of the meeting was to discuss the application of
Elizabeth Akin.
Robert W. Spencer, Village Attorney, advised the Board that
the New York State Supreme Court vacated the granting of the Akin
area variance. The Planning Board approved the sub-division of
Lots 1 and 8, subject to the granting of the area variance by the
Zoning Board of Appeals. The Court ruled that the grant of the
variance must be rejected because the applicant applied for an
interpretation of the Zoning Law, not an area variance. Hence, the
Board lacked jurisdiction to grant the area variance.
Mr. Sam Watkins, Attorney for Elizabeth Akin, presented
information regarding the application for an area variance for lot
1. Lot 1 on the survey contains 13,569 square feet (15,000 square
feet is required). Mr. Watkins stated that Mrs. Akin is presently
in a nursing home and is represented by her son William D. Akin
through Power of Attorney. Mr. Watkins made a presentation in
favor of the variance. (Copy of Mr. Watkins statement is attached
in official minutes.)
Mr. Edmund Stoecklein, resident of Sleepy Hollow Manor and a
member of the Sleepy Hollow Manor Taxpayers Association, stated his
objections to the granting of the area variance, and asked that the
Board deny the request for an area variance.

that the

be granted. He felt it was not the intention of the owners to keep
it a green area and felt it was up to the residents of the area to
buy and maintain it as a green area. He felt the Village should
allow this property to be buildable.

After a discussion, Mr. Bounds moved, seconded by Mr.
Morabito, that an area variance be granted for Lot 1, as requested
by Elizabeth Akin, owner of said property. Carried unanimously.
There being no further business to come before the Board Mr.
Fitzpatrick moved, seconded by Mr. Morabito, that the same be duly
adjourned. Carried unanimously.
