�REGULAR MEETING

NORTH TARRYTOWN, NEW YORK
September 21, 1994

A regular meeting of the North Tarrytown Zoning Board of Appeals was held on
September 21, 1994 at 8:00p.m. in the Village Hall, 28 Beekman Avenue, North
Tarrytown, New York.
PRESENT: Frank Paolantonio, Chairman

John Morabito

ALSO PRESENT: Janet Gandolfo, Attorney
James Margotta, Building Inspector

Chairman Paolantonio called the meeting to order at 8:20p.m.
1. Public Hearing: Laurentino Rodrigues, 83 Depevster Street
Clerk read the notice of Notice of Public Hearing to hear and consider an appeal by
Laurentino Rodriguesfroma decision of the Building Inspector which denied a certificate
of occupancy for premises at 83 Depeyster Street, North Tarrytown, New York ( Section
16, Block 11, Lot 15 on the tax assessment map of the Village of North Tarrytown ) as a
three (3) family residence. The Building Department records list the premises as a twofamily residence.
Chairman Paolantonio asked if there was anybody present who wanted to address the
board.
Mr. Rodrigues came forward and submitted the attached affidavits to the board members.
He stated that he bought this building and that it has been occupied by three families for
the past three years.
Chairman Paolantonio asked if there was anybody else. There being nobody else, he asked
for a motion to close the Public Hearing.
Mr. Morabito motioned and Gary McLean Second.
Discussion followed. Chairman Paolantonio felt that the affidavits presented stating the

�house as a three-family were not acceptable. Mr. Occhipinti stated that affidavits
presented in the past for similiar cases were accepted. Questions on how long the house
had been occupied by three-families arose but with no definite answers.
Mr. Cappello made a motion to grant Mr. Rodrigues' application.
Mr. Gary McLean second.
Motion carried unanimously.

2. Public Hearing: A &amp; S Machine Shop, Cortlandt Street
After some discussion, Mr. Schiavone, the applicant, withdrew the application.

The Board also voted to approve the following attached resolutions:
Renovation for a 17 unit apartment house
Regan Development Corp.
52 College Ave., No. Tarrytown, N.Y.
Premises are known as Section 16, Block 17, Lot 9

Construction of a single family residence in the R-3 District wherein the two side yards
together would total 14' instead of the required 15' and wherein the front yard setback
would be 17' instead of the required 20'
John and Maureen Petry
Webber Ave., No. Tarrytownb, N.Y.
Premises are known as Section 17, Block 7, Lot 20

Permission to use premises for the installation of electrical wiring for lights, sirens and
radios on Fire and Police motor vehicles at premises located at 80 Chestnut St.,
No. Tarrytown.
Dominick Pulsoni, Jr.
80 Chestnut St., No. Tarrytown, N.Y.

Permission to construct an addition to premises located at 15 Elm Street, No. Tarrytown,
N.Y.

Motions to approve these resolutions were made and passed unanimously.

Minutes for August 17, 1994 were approved.
