REGULAR MEETING

A regular meeting of the North Tarrytown Zoning Board of Appeals
was held on December 21, 199^ at 8:00 p.m. at the Village hall
2 8 Beekman Avenue, North Tarrytown, New York.

Chairman Paolantonio called the Meeting to order at 8:15 p.m.
1.

CONTINUATION OF PUBLIC HEARING RE: APPLICATION FOR AN ADDITION
OF AN APARTMENT BY JANOS VATAI, 106 POCANTICO STREET

Chairman Paolantonio re-opened the Public Hearing and asked if
anybody in the public had any comments.
Mr. Barstow handed out new lay-outs of the plans. He stated that
they took into consideration the suggestions that the Board gave
in the previous meeting. He went on to explain the changes.
Mr. Carpenter stated that he was a tenant of Mr. Vatai and had
lived at 106 Pocantico St. for 14 years. He said that he couldn't
afford a raise in the rent if his apartment was changed. He also
stated that he couldn't understand why the parking was a problem.
He went on to comment on the parking around the area. He finished
by saying "I don't like the idea of anyone leaning on my landlord
to expand."
Chairman Paolantonio corrected him by explaining that the Board
was not trying to penalize the landlord.
Janos Vatai, the owner of the building gave his view of the parking
situation and his plans.
Joe Margotta stated that he has been in the building for over 40
years and they have never had any problems with the parking in
the area.
Mr. Barstow said that the landlord was intending to move into the
apartment himself with his wife. He stated that they were caretakers at a church in Scarsdale for 25 years. That was another
aspect of the project.

Mr. Occhipinti stated that he didn't like the parking area
around the garbage shed.
Discussion on the garbage shed followed.
Discussion regarding the removal of the old garbage shed and
building a new one so to put a parking space, the new garbage
shed and the expense of doing it continued.
Chairman Paolantonio asked if there was any further comment from
the public. There was none.
Gary McLean moved to close the Public Hearing.
Frank Occhipinti seconded. Motion carried unanimously.
Discussion among the Board members on the number of units/
parking and the garbage shed ensued.
Mr. Anello stated that there was no doubt that there was a parking
problem and adding another unit disturbed him. He felt that this
variance should not be granted. Overcrowding the building is not
advisable.
Discussion followed on the size of the property.
Chairman Paolantonio commented that it was over-built by 15%.
Mr. Carpenter commented that other apartments were more expensive
and he was"happy where he was. He didn't appreciate the suggestions
of the Board that his apartment be expanded rather then a new one
built.
Chairman Paolantonio told him that the Public Hearing was closed.
The Board member was not directing the comment to him. Nobody
on the Board was trying to hurt anybody but trying to help the
gentleman with his problem.
Discussion again followed on the size of the proposed apartment.
Mr. Anello asked if the applicant was interested in having one
large unit approved or rather have the variance denied and go
back to the drawing board.
Mr. Margotta stated that he would not recommend denying it. By
denying it he can't come back in 6 months unless there has been
substantial change in the application. He would rather see it
adjourned.

Chairman Paolantonio asked the Board what they wanted to do.

Mr. Occhipinti recommended that the variance be granted with the
stipulation that the parking space #3*be moved where he suggested
and make use of one office and provide parking spaces by painting
lines to indicate the parking spaces.
Mr. Margotta indicated that they need a second means of egress.
A secondary means of egress can be a window on the first floor.
Chairman Paolantonio suggested that they leave that for the code
to dictate.
Mr. Morabito made a motion to declare this a Type II Action which
will have no material adverse impact on the environment.
Mr. Occhipinti seconded.

Motion carried unanimously.

Mr. Occhipinti made a motion to grant the variance with the following
conditions:
1. Store front be 1 store front occupied by 1 tenant.
2. Parking space #5 be moved to where there is a garbage
shed along side spot 3 &amp; 4.
3. Lines be painted to signify where the parking spaces are
located.
Mr. Morabito seconded.

Motion carried unanimously.

Chairman Paolantonio stated that the Board of Trustees requested
to be Lead Agency to a LWRP project. He said that he had no
objection and asked for any input. No Board member objected.
Mr. Turnquist and Laurentino Rodrigues came forward and gave the
Board a brief overview oh the combined project on 76 Chestnut
Ridge and 83 Depeyster Street. Adjourned to January meeting for
further discussion and Public Hearing.
Mr. Morabito moved to approved the minutes of November 16, 1994
as amended.
Mr. Occhipinti seconded. Motion carried unanimously.
There being no further business to come before the Board,
the meeting was adjourned.
