PRESENT: Robert Anello, Chairman Gary McLean Angelo LoMascolo Rhonda Mauhs ABSENT: John Morabito Frank Occhipinti William Taylor ALSO PRESENT: Janet A. Gandolfo, Attorney James Margotta, Building Inspector Chairman Anello called the meeting to order at 8:25 p.m. MS. MARY COLETTE ORE - CONTINUATION OF OPEN REAR DECK IN REAR OF HOUSE The clerk read the Notice of Public Hearing to hear and consider an appeal by Ms. Mary Colette Ore from a decision of the Building Inspector which denied a building permit to erect an open rear deck at the back of premises located at 26 Depeyster Street. The applicant's request has been denied for the following reasons: 1) The Schedule of Regulations, Part I requires a lot size of 4,000sq. ft. for a single family residence. The lot size is 75' x 51' or 3,825 sq. ft. 2) The Schedule of Regulations, Part I requires a rear yard setback of 25'-0. The survey indicates that the rear yard setback is 6'-0. The premises are known as Section 16, Block 15, Lot 5 on the tax assessment map of the Village of North Tarrytown. Chairman Anello asked if anyone was present to speak for the applicant. Mr. Richard Bucci, contractor for the applicant said that they wanted to build a back deck and they didn't have enough setback and for that reason they were before the Board. Chairman Anello commented that the deck was to be 10x15. He asked how far it was from the back property line. Mr. Bucci answered 6 ft. from the back. Chairman Anello asked if there was a hedge. Mr. Bucci answered yes, there was. Chairman Anello asked how high was it. -1•.K^-^—ASn-^'r ''k^^^s^A^M^A-iJ^^^S^^^ �/! Mr. Bucci replied about 3 1/2 ft. Chairman Anello asked how high the deck was going to be off the ground. Mr. Bucci said about 4 ft. Chairman Anello asked if they were going to use it for cooking, relaxing and if it was going to be exited from the kitchen. Mr. Bucci said it would be a second exit. Mr. Margotta commented that there was a set of stairs from the deck to the ground. Chairman Anello asked if the neighbors had any objections. They answered no. Ms. Mauhs moved to close the Public Hearing. Mr. Mclean seconded. Public Hearing closed. Ms. Mauhs made a motion to grant the variance. Mr. LoMascolo seconded. Motion carried unanimously. There being no further business before the Board, Chairman Anello moved to adjourn the meeting. Mr. McLean seconded. Carried unanimously.
