�A regular Zoning Board Meeting was held on January 15,1997 at 8:00 PM in Village
Hall, 28 Beekman Avenue, Sleepy Hollow, New York 10591

IN THE MATTER OF ANTONIO AND LUCIA RENTA. 76 NEW BROADWAY.
SLEEPY HOLLOW. NEW YORK 10591
Proof of return receipts were submitted to the Building Inspector.
Mr. Sam Viera, the architect for the applicant stated that the location of the detached
accessory shed is 5 V4 ft. closer to Spruce Street. The proposed plans are to make the
shed in line with the existing house. A variance requires 3 ft. east of the retaining wall.
There is a concrete walk used now which is not good access to the shed. The applicant is
requesting a 2ft. variance. This is not a permanent structure. If it were two feet from the
property line a variance would not be needed.
The hardship is that the land is sloped, it is difficult to take mowers and equipment in and
out. This structure would be moved not rebuilt. The hardship consists of the physical
confinement. The structure has been up for 12 to 14 months. It was put up without a
Building Permit.
A letter was submitted to the Building Inspector by Mr. Al Williams of 11 Spruce St.
(Official Minutes) stating that steel beams have been put up. Mr. Margotta stated that the
applicant intended to use them as grape bars and there is no violation if they are sunk into
concrete.
Mr. Viera stated that there is ability to access the wall. The shed could easily be taken
away in case of an emergency. Mr. William is fully aware that he can have permission to
go on the property if he had to.
Mr. Anello asked if this was an adverse impact or self-created. The shed was put up
without a Building Permit and it would be a matter of convenience which would
inconvenience the neighbors.

�PUBLIC HEARING
Mr. Williams of 11 Spruce Street submitted pictures to the Zoning Board, pictures of the
current shed. (Official minutes). Discussion ensued regarding the height of accessory use.
The wall is 2- 20ft. high.
Mr. Morabito made a motion to close the Public Hearing, seconded by Mr. McLean.
Motion carried unanimously.
DISCUSSION
Mr. Anello stated that the structure was installed without a Building Permit and also has
not heard anything that satisfies the criteria. This is self- created difficulty.
Mr. Morabito agreed with Mr. Anello, the shed could be turned around. It was erected
without a building permit. Mr. Morabito feels that the grade is not that bad. There is no
loss of square footage and it has the access of Spruce Street.
Mr. Timmings agreed and stated that the applicant could turn it 90 degrees and still
conform with the setback.
Mr. McLean stated that Mr. Williams does have a point. There is no room between the
shed and the wall to work. Mr. Williams will only be hurt. The applicant could take it
down and seek a permit.
Ms. Moiron stated that she feels it is self-created.
Mr. Anello made a motion to deny the variance, seconded by Mr. Morabito. Motion
carried unanimously.
IN THE MATTER OF ELLA SCHEINWALD. 469 MUNROE AVENUE. SLEEPY
HOLLOW. NEW YORK 10591.
Mr. Sean McCarthy is the architect for the applicant and submitted photos of the property
to the Board. The property was purchase approximately 12 years ago. The applicant
would like to put an extension on the south side. This would be a extended 5 feet for
additional space. Now it is being used as a playroom. To continue the existing structure
the applicant would have to add 5 feet in the front. If it was proposed from the rear it
would not be feasible; Adding the extension to the front would add aesthetic value. This
direction seems to be the most practical space.
Mr. Morabito made a motion to close the Public Hearing seconded by Mr. Timmings.
Motion carried. Mr. Anello abstained.
Mr. Morabito stated that he has no problem with the structure and that it will look
presentable.

�Mr. Morabito made a motion to grant the variance, seconded by Mr. McLean. Motion
carried unanimously.
IN THE MATTER OF CHRIS SKELLY. 130 NEW BROADWAY. SLEEPY
HOLLOW. NEW YORK 10591
Mr. Bob Shilmay is the architect for the applicant. Mr. Shilmay stated that the applicant
has a small home and would like to add a two story addition. Photos of the home were
submitted to the Board. The addition is conforming. Drawings show elevations, some
height and roof lines. The garage is basically in the ground. It is the existing structure
that does not conform, not the addition.
Mr. Ceconi of 120 New Broadway stated that the garage is one of the oldest in Webber
Park.
The extension would involve adding a family den, and the rear entry laundry area needs
additional space. The upstairs would involve replenishing the bedroom.
Mr. Mario DiFelice of 35 Gory Brook Road and Mr. Ceconi of 120 New Broadway are
both in favor of the addition.
Mr. Morabito made a motion to close the Public Hearing, seconded by Mr. McLean.
Motion carried unanimously.
Mr. Morabito made a motion to grant the variance, seconded by Mr. McLean. Motion
carried unanimously.
MINUTES
Mr. Anello made a motion to approve the minutes of September 1996 as written,
seconded by Ms. Moiron. Motion carried unanimously.
Mr. Anello made a motion to approve the minutes of October 1996 as written with one
correction, page two should read leeway, seconded by Mr. Morabito. Motion carried
unanimously.
Being no further business, Mr. Morabito made a motion to adjourn the meeting, seconded
by Mr. Timmings. Motion carried unanimously.
