Tygard 491 Bellwood Ave. c) Elizabeth Mascia Child Care Center 174 Valley Street Announcements: None. a) Alessandro Carissimo The Public Notice was read aloud. Alessandro Carissimo stated that the fence was needed for his children's safety. He described how basketballs and other toys go over a regular fence. The additional height is needed to keep things from going over a regular height fence. The Chair stated that the applicant had submitted the following: 1) Drawing 2) Application The Chair asked if the Board had any comments. Jim Galgano asked if the applicant had asked his neighbors about the fence. Alessandro Carissimo stated that none of his neighbors had a problem with the fence. Linda Moiron asked what was there before. Alessandro Carissimo responded that nothing except for some bushes. �*- The Chair opened the public hearing. Jim Moribito made a motion to close the public hearing. Eliot Martone seconded. It was unanimous. John Moribito made a motion to approve the application. Jim Galgano seconded. Eliot Martone amended the motion to add that the motion also includes ARB approval. Peter Koffler seconded. It was unanimous. b) Mitch Weitzner/J. Tygard The Public Notice was read aloud. Mitch Weitzner gave a description of the fence. He also stated that the fence was already installed. Mitch Weitzner stated that the fence was installed for the safety of his children. The Chair asked what the height of the fence is. , Mitch Weitzner responded that the maximum height is 4 foot high. The posts are also 4 foot high. The Chair asked if the Board had any questions. Since there were no questions, the Chair opened the public hearing. John Moribito made a motion to close the public hearing. Linda Moiron seconded. It was unanimous. Eliot Martone made a motion to approve the application based on the approval of the ARB. Peter Koffler seconded. It was unanimous. c) Elizabeth Mascia Child Care Center The Chair stated that this was a new application. The Public Notice was read aloud. Sam Vieira summarized the previous application. He also stated that there is no solution to provide parking for the building. Additionally, there was never any off-street parking available for the building. The building owner can secure two (2) spaces by leasing from the adjacent property. The Chair asked who owns the adjacent property. Sam Vieira responded that the applicant's brother is the property owner. Sam Vieira responded that whatever legal documents are needed to tie-in two spaces with the lease could be used. The Chair asked about the other required 10 spaces that are needed for the building. Sam Vieira responded that other spaces are available at the adjacent property. The Chair asked how many spaces would be allocated for the apartments. Sam Vieira responded that he did not know. He also added that the applicant is asking for a variance for two (2) spaces, which is the required spaces that are required by the applicants occupancy in this space. The Chair stated that the building owner needs a parking plan for the other spaces. Jim Galgano asked why did the applicant pick this location. Maureen Barbalette responded that she had been looking for five years for a good location. The day care center needed to be on the ground flood and close to the high school. Ed Lammers stated that spaces would be allocated to the building. He also stated that something should be placed in the file. Jim Margotta stated that something needs to be placed within the building records. Maureen Barbalette stated that no more than two (2) spaces would be used for the child care center. The Chair asked if the building owner will approve of the number of spaces. Sam Vieira responded that he did not know. The Chair stated that the variance could be approved with the condition that the building owner secure seven (7) spaces. The Chair opened the public hearing. Since there were no comments from the public, John Moribito made a motion to close the public hearing. Eliot Martone seconded. It was unanimous. The Chair made a motion to grant the variance under the condition that seven (7) spaces be allocated for the building. The building owner also must prepare signage to properly indicate that the parking spaces are dedicated for the building occupants. Additionally, the tenants are to be notified. Jim Galgano seconded. It was unanimous. Zoning Board Meeting, September 20, 2000 3 �Other Topics: The minutes for July 2000 were reviewed. The following corrections were noted: On page 3, change " Diana Abboud responded that it was advertised in the penny saver for 3 months." To read, " Diana Abboud responded that it was advertised in the penny saver for 3 weeks." Eliot Martone made a motion to approve the minutes as noted. John Moribito seconded. It was unanimous. There was an open discussion on the use of Robert's Rules. Adjourn to next meeting.
