The meeting was called to order at 8:04 P.M. by Peter Koffler , Acting Chairman JT|ieCl^ir

Agenda:

Announcements:
There were none.
1) Bill Carraro This is an application for an area variance to construct an open porch. The applicant is
requesting a front yard variance from the required 30-foot minimum to a 26 lA footminimum.
The Chair asked if the returns were received.
Bill Carraro responded that he submitted them to the Secretary of the Department of Fire
&amp; Life Safety.
Bob Stiloski responded that he had not received them.
The Chair referred to the Village Attorney.
Ed Lammers stated that the Board cannot hear the application without proof of mailings.
He stated that the Board could not hold the public hearing.

This was adjourned to the next meeting with the understanding that the application was
properly noticed. If not, the applicant would be required to re-notice.

2) Charles PatemanThis is an application for a continuance of a previously granted area variance to construct
a 2-family residence. The applicant is requesting a variance from the required lot size,
side yard setbacks and lot coverage zoning requirements.
Charles Pateman is the applicant and is representing this application. He stated that he is
requesting an extension of a previously granted variance. He stated that due to some of
his health problems and the lack of an Architectural Review Board meeting in August,
the one-year time frame has elapsed.
The Chair asked if any work had been performed.
Charles Pateman responded no.
The Chair opened the public hearing.
Lee Thompson (151 Valley Street) spoke. He stated that he tried to purchase the same
piece of property many years ago. He stated that the Village officials (at that time) told
him that the lot was too small to build on. He stated that he is against the application. He
stated that the proposed plan would crowd his property.
Since there were no other public comments, Linda Moiron made a motion to close the
public hearing. Eliot Martone seconded. It was unanimous (5-0).
Jim Galgano made a motion to grant the applicant's request for an extension of the
previously granted variance.
The Chair asked if any circumstances had changed.
Charles Pateman responded no.
Eliot Martone amended the motion to approve the request subject to Architectural
Review Board approval. Tom Capossela seconded. It was unanimous (5-0).
3) Interpretation of rear yard setback for accessory uses Ed Lammers reviewed the rear yard setback requirements of other local municipalities.
He distributed copies for the Board.
Bob Stiloski stated that the Town of Greenburg based the setback on the lot size.

The Chair asked for the Tarrytown requirements.
Ed Lammers responded that he did not have access to the Tarrytown Code book.
The Chair asked the Board for comments.
The Board agrees that the Code needs to be adjusted with regards to rear yard setbacks
for accessory structures.
There was an open discussion on the proper setbacks to recommend to the Village
Trustees.
Since there was no further comments, Eliot Martone made a motion to close the public
hearing, Tom Capossela seconded. It was unanimous (5-0).
This will be continued at the next meeting.
4) Minutes of July 2002 and September 2002 meetingsThe minutes for July 2002 were reviewed. The following corrections were noted:
On page 7, delete "Peter Koffler stated that since the fence is not a stockade fence, he
does not have a problem with it."
Eliot Martone made a motion to approve the minutes as amended. Tom Capossela seconded. It
was unanimous (5-0).
The minutes for September 2002 were reviewed. Several corrections were noted. The minutes
will be re-submitted to reflect the changes.
Eliot Martone made a motion to approve the minutes as amended. Linda Moiron seconded. It
was unanimous (5-0).
Eliot Martone made a motion to adjourn. Tom Capossela seconded. It was unanimous (5-0).
