ZONING BOARD OF APPEALS MEETING -APPROVED
February 18, 2004

The meeting was called to order by Eliot Martone, Acting Chairman at 8:07 pm. The Chair
noted that a quorum was present.

Announcements:
The Chair stated that since only four (4) members were present, the Board had to reach a
unanimous vote to pass the proposed variance. He discussed the possible options available to the
applicant.

1) Leslie Ward This is an application for an area variance to construct a new front porch on the
applicant’s house where the proposed construction creates the following noncompliances:

Proposed
Front yard setback 6’-0”
The Chair read the public notice aloud.

Required
Min. front yard setback 20’-0”

�The Chair noted that the Board has received the following:
1) ZBA application
2) Short EAF
3) Project plans
The Chair asked if the returns were received.
Sean McCarthy responded yes.
Leslie Ward is representing his application. He briefly described the existing house
layout. He described in detail the proposed changes, which included replacing the main
entrance doors and constructing a porch.
The Chair asked if the new construction would extend further than the existing porch.
Leslie Ward responded the new construction would add three (3) feet to the front of the
house. He stated that the Village owns an additional nine (9) feet of property in front of
the house. He stated that the total distance from the road is actually 15-feet in total. He
also stated that the Architectural Review Board (ARB) has approved the proposed work.
Tom Capossela made a motion to open the public hearing. Jim Galgano seconded. It
was unanimous (4-0).
Jim Palantonio (43 Amos Street) spoke. He stated that he was in favor of the proposed
work.
Since there was no further public comment, Jim Galgano made a motion to close the
public hearing. Tom Capossela seconded. It was unanimous (4-0).
Tom Capossela made a motion to approve the proposed variance. Jim Galgano seconded.
The Chair stated that this variance is the minimum variance that could be approved. He
stated that it is not a self-created hardship and that the proposed work is not out-ofcharacter with the neighborhood. He also stated that the project would not affect the
surrounding environment. Lastly, he stated that the ARB had already approved the
proposed project.
The request for a variance was approved unanimously (4-0).

2) Laurentino Rodrigues There was nobody present for this application.

Jim Galgano made a motion to adjourn. Tom Capossela seconded. It was unanimous (4-0).
